NJ2AS FILES AMICUS BRIEF IN  PANTANO NJ SUPREME COURT CASE

On Tuesday, October 1, 2013, the New Jersey Second Amendment Society (NJ2AS) filed a "friend of the Court" brief in a State Supreme Court appeal challenging New Jersey's "justifiable need" requirement to obtain a Permit to Carry a Handgun.  The Plaintiff, Richard Pantano, is being represented by Evan Nappen, noted civil rights attorney and close friend and supporter of NJ2AS.

On page 11 they establish the exceptions that allow you to have a handgun in your posession. To/from range or gun show.  Also they address the hunting/fishing thing.

 

Then page 12-13 they say that Aitken was transporting between residences which would be legal if he could prove it.

 

So transportation between residences is illegal on page 11 but then legal on page 12-13... which is it?

What is the significance of an Amicus brief? Is this something that the NJ2AS does often?

 

It's simply additional input from outside parties, commonly referred to as "friend of the court" briefs. I don't think NJ2AS does this often.

Open carry would be a nightmare in this state... I'm pretty sure everyone would hate it. The antis would know exactly who to harass, and the people who carry would probably go nuts from all the "panic" people would cause over something that is completely foreign to them.

 

Personally, I think open carry is just about as effective as putting a giant target on your back... With a sign that says shoot me first.

I disagree. I like to think people in certain areas of the state would feel better protected knowing that there are good citizens around them that are carrying and would shoot to protect them should the need arise. But don't worry because this state has an overwhelming percent of "anti-gunners" so I don't ever see us getting the right to "bear" arms back. We can keep them at least.

Same here.  NJ2AS has done amazing things in its few years of existance.  The NRA should be ashamed.

So how do we know what the next step is? What is the process for the state to pick up and hear this case? Is there a certain date by which they have to address the case? Is there some bureaucrat that decides arbitrarily when it is heard?

 

Basically, when am I supposed to get excited about this case getting heard in a court room?

      A lot can be said about the various 2nd Amendment groups within the state of NJ, along with those on a national level.  In a perfect world they would join forces, put aside differences, and strive to move NJ to be more in line with the rest of the country in regards to 2nd Amendment rights & freedoms.  But whether or not you agree with any particular groups tactics or methods, these are the people who are fighting our battles for us.
       
      NJ2AS is running a "matching donation" event till January 2nd, 2016.  This was sent out as an email blast which can be seen below.
       
      Depending on your caliber of choice three boxes of ammo is roughly $30 to $45 (re-loaders aside).  Instead of spending that money on more ammo, this should be viewed as an opportunity to help further the cause of a 2nd Amendment group in NJ.  And with matching donations, your giving twice the assistance.
       
      I have "put your money where your mouth is" by making a $45 donation, and I ask of you to do the same.  New Jersey Gun Forums could be a powerful force if we could stand together.  I am hoping this is a start.

      Cherry Hill just announced a new Chief of Police, Capt. William "Bud" Monaghan.  I was wondering if anyone knows him personally or knows anything about him.  We're hoping he's 2A friendly, but he hasn't been tested, yet, to my knowledge.  As you guys probably already know, for FID/PPP, Cherry HIll currently requires an illegal and frustrating consent form for next-of-kin (aka Spousal Consent Form) and they also require both the next-of-kin (normally the spouse) and both references to have their forms notarized before they are accepted.  I was typically getting (relatively reasonable) 2-3 month turn-arounds on my requests, but this time I didn't place any status calls along the way, just to see how long it would take.  I submitted my forms in July (and my references got their forms back right away) and I have yet to hear from the PD so far (as of 12/9/13).  If this new Chief of Police is more 2A friendly than his predecessor, we may have some opportunity for an easy and amicable outcome with NJ2AS's Operation Establish Compliance (OEC) which has not taken on Cherry Hill, so far.   http://www.cherryhill-nj.com/CivicAlerts.aspx?AID=418

      I have registered and am planning to attend.  Anyone else planning to attend?  (I hope a bunch.)

    • Yup I see. Looks like right now you can only purchase the 2023-2024 permit still. I assume won't be able to purchase 24-25 season permit until July.
    • Just a heads-up for anyone who might also be in this situation. I joined USLS mid-April of 2022. Some time after renewing for 2023, I changed email providers, and dutifully reflected my new address on my account page. So, I have been anticipating renewal alerts at my new address, but those never arrived. I logged in to my account the other day, and was surprised to see that my subscription expired that same day. I went to my account main information page, confimed that my email address was correct, then went to the billing page, which showed my previous two payments, but which did not give me any apparent way to pay up for the new year. I requested support using the Customer Service form on the web site, but received no reply. Today I called their support number. Apparently changing the email address from my view of my account page did nothing to change the address that they use internally for billing purposes, including expiration notifications. Maybe they also use that address for replies to the support form, even if a different email address is entered there. Also, my account was set up to auto-renew and charge my credit card without my intervention, but that setting did not show on my account page in any obvious way. So, if you have USLS and have changed your email address since you last renewed, you might want to give them a call to ensure that they send renewal information to your correct address. The prospect of having legal coverage lapse while carrying in NJ was, for me, a less that confidence inspiring experience. I will note that the telephone-based customer service was excellent.
    • F*n imbeciles. They know damned well (or should) that, even if passed by the Colorado Senate and signed into law, virtually that entire load of crap is certain to fail Bruen/Heller scrutiny, and probably sooner, rather than later (SCOTUS). What a monumental waste of time (of course, how much can a dip$h*t's time be worth, anyway?) and energy. I passed through Colorado a few times in the 70s, and visited some clients there in the 80's & 90's, and, even by the end of that period, I had the impression that it was politically fairly conservative (with a few exceptions such as Aspen). WTF happened?
