The reality, however, is that if the judge will wait well beyond the date set in the Order for Hearing to give the state police, etc "extra time" to see if they file an objection. Basically, the judge will not treat silence as a non-objection. The judge will wait until he receives a formal notice from the State Police and county prosecutor that "there is no objection to Mr. Smith's expungement." Once the judge sees in writing that there is no objection, he/she will then sign the Final Order of Expungement.

But that's still not the end of it. I then have to send the Final Order signed by the judge to the State Police Expungement Unit AGAIN so that they can physically expunge the records from their database/files. When the State Police are done with this (usually about 6 to 8 weeks after I send them the Final Order), they then send me what I call the "blue letter" [because it is always on blue-ish paper with a NJ State Deal watermark in the center] which states that the NJ State Police have now expunged the records and cleared the criminal history file.

I tell everyone not to apply for an FID card until I mail them the "blue letter" stating that the State Police have cleared their record. Anyone doing their own expungement in NJ should be aware of this, as I could easily see a situation where someone receives the Final Order from the judge and rushes out to apply for their FID, only to be denied because the charges are still on your record (they could also tack on a falsification charge as well). Although a situation like this would likely be "fixable," it would create a huge headache and further delay receiving your FID.

Well just received my expungement notification from the courts. Does anyone know how long it takes the courts to notify the NJ State Police and for them to update their records.

I have been told right now its running between 13-15 weeks. How long after your court date did you the receive the notification?

Over 15 weeks now......

 

I put my expungement papers through a couple years ago for a theft a while back. a couple months ago I applied for my initial fid and 4 pistol permits. I got a call about a month later asking about that exact charge and a dui. I informed the officer that the theft should have been expunged and the dui was the same night but I wasn't able to expunge it. he told me that it shouldn't be showing up in his system if it was expunged although it actually was. he told me that if I was in fact correct that I should be fine. sure enough I was right and they gave me the permits... which leaves me to wonder how that information is still showing up after I already expunged it.

Somebody dropped the ball. You will continually have an issue everytime you get new permits. Follow up and have it corrected.

Was looking into an expungement for a friend of mine, shoplifting under $20, clean record besides that, worth being expunged?

There would be an arrest record for theft.  It will show up forever. Get it expunged if he can.

I have 2 attempted theft charges on my record.  Both over 25 years ago, both stupid mistakes with alcohol involved.  Never stopped me from getting my FID or permits.  I thought non felonies that weren't domestic violence related couldn't prevent you from getting FID/permits??

Well guys I got my state police letter today (15.85 weeks) saying they removed the files. I was told this is the golden letter and I should be good to go to apply now. If I have any issues I kept all my records wish me luck. I will keep updated on how long the permit process takes.

Do you have to explain those charges to the PoPo every time you apply?  An expungement would rectify that...

Court appearance on December 15 resulted in expungement of involuntary commitment which resulted in a NICS denial (commitment was believed to have been voluntary, over 30 years ago).

 

The last statement on the court papers reads:

 

“The Plaintiff is granted relief from federal firearms disability, and the County Adjuster shall take all steps to remove information regarding the civil commitment record from inclusion in the federal National Criminal Background Check System (NICS) databases.”

 

 

1. Is anyone aware of any additional forms or actions I need to submit or perform in order to clear a NICS report in the future?

 

2. if nothing more is required on my part, how long should I wait until I attempt another NICS check?  (assuming there is no way to "test the waters")

 

3. Do I have to wait for a letter from the state or is that just for criminal record expungements?

 

Any help would be greatly appreciated.

Court won't notify all the different agencies and databases you need. You or your lawyer needs to notify to be certain it is done right.

 

The state police letter alone won't stop the local PD from searching the right database and delaying or denying you. I had it happen on my second set of permits for expunged juvenile things.

 

Somehow there was a database not in existence at the time my expungement was done. Local PD didn't have access to database when I got my FID and initial permits. All they could find were the arrests not the dispositions, well because it was expunged. Luckily my mother saves every important paper going back to my grandparents service records. I was able to prove all charges were dismissed and expunged. Permits granted.

 

It would have taken much longer if I didn't have originals because police couldn't find any other info because of the expungements. I was in a catch-22 per se. Juvenile database was notified and record is now sealed there as well.

My guess is there is more than one agency and more than one database that needs to be notified. Your lawyer should know which they are.

Also a side note. No one should move from the state of NJ without having any and all arrests or convictions expunged if they are able to be expunged. For example California expungement is a lot harder and doesn't exist for many crimes. NJ expungement is one of the best in the nation.

I'm sorry, I should have stated that I had already met all requirements for FID and had obtained a P2P; it was the NICS which was denied at time of purchase.
