siderman 1,137 Posted February 24, 2017 This is an interesting take on the judges duking it out in-house, this is a copy/paste from a post on the Beretta forum: What's really going on is one part pissing match and one part predetermined result.The district court originally ruled in favor of the state.On appeal, in front of the usual three judge panel, Maryland's AWB was struck down, as it should have been, under a strict scrutiny standard of review. The 2-1 vote saw Judge King, the author of yesterday's nonsense, as the lone dissenter in the three judge panel. In his original dissent, he went on at length moaning about mass shootings. The majority opinion was written by Judge Traxell, who wound up leading the four vote dissent yesterday.So, King gets clowned at the three judge panel level. He calls for an en banc review by all 14 judges of that appellate circuit because it only takes one.He has to get his moonbat opinion to stick, so he made up a test explicitly rejected in Heller, and totally at odds with Miller, and using the wrong standard of review. No problem, there are nine other Clinton/Obama gun grabbers on the panel. Presto changeo, a 10-4 gun grabber decision.Unfortunately, unless Gorsuch gets confirmed, and ideally Kennedy retires this summer so Trump gets a second 2A supporter onboard, the 4th circuit asshattery is going to stand because Roberts and Kennedy are 2A squishes and the four libs on the court are hardcore antis. Passing the bills we need through congress and getting as many conservative judges appointed to Districts, Appellate and the Supreme Court should be our focus.
