This almost seems like a self fulfilling prophecy. Many LEO don't know the exact verbiage of the law by heart, but the fact that Nappen says that a loaded magazine can be considered a loaded gun, many LEO might believe it thinking that because Nappen specializes in NJ firearm laws he would know it better then them. So if Nappen would STFU and stop making up this BS, this would not be an issue, ever!!!

And, when pressed, cannot cite a SINGLE INSTANCE to support his assertion. This, and his "US Law Shield" venture, has caused me to lose the respect I once had for Mr Nappen.

A lot of what Nappen says, is Nappen law and not N.J. law. It is often "suggestion law" designed to avoid placing yourself in a scenario where you encounter a law enforcement officer who believes something to be true, which is not so. The bottom line is that no intelligent prosecutor would seek to prosecute a loaded magazine arrest as a loaded firearm.

Can't remember what state it was in (not NJ, CA I think) but IIRC a guy was arrested for a loaded firearm as he had loaded magazines not in the gun. The prosecutor argued that a firearm is loaded if any part of the firearm is loaded with ammunition, for example the tube magazine on a pump shotgun, the firearm is loaded. Apparently the jury or judge bought that idea and they guy was convicted. The conviction was immediately overturned on appeal. If the magazine had been in the gun it could he considered loaded even with an empty chamber. No way would a loaded magazine, separate from the firearm, be considered a loaded firearm. The case law established by the appelate court says a loaded magazine is not a firearm.

Actually, my wife is neutral, she really doesn't say much or care about the money. On occasion, when I bring something home or cleaning something, she'll pick it up, but has no interest after that. I don't have a basement, so it's tough to find place for the ammo, can't put all that weight in one place. When she sees the cardboard box in the closet, all I hear is, "another one????" Mine has never yelled, I just use the "You never said anything when I bought all those cordless drills, saws and other tools to do all your renovation projects...". Works every time!

My wife isn't a fan either of the firearms or the ammo, or the sport in general. But she realizes that its not fair to push her wishes/beliefs on others. She refuses to go to the range with me (that could be a good thing). When something new follows me home, she just looks the other way. When the UPS/Fedex guy shows up with a box, and it looks like he's getting a hernia, she just shakes her head (and goes to off to Kohl's). So, we have an informal agreement. I don't count the number of shoes, outfits and purses in her closet, and she doesn't count the number of firearms or cases of ammo in my possession. See how easy it is to "compromise"? You should try that.

High and dry today! Not sure if nature was helped out or she did it all by herself, but all ranges were high and dry. GREAT day for shooting too.

My attitude is I wouldn't worry about it. There are thousands of guns in NJ that people owned before they moved to NJ. Many of these guns changed hands several times before they wound up in NJ. Yes, it's a different thing but remember it's up to the prosecution to prove your guilt. Having things to prove your innocence helps but they have to prove your guilt.

Buy my book, it will keep you out of jail. Buy the law service I sell in case you get arrested anyway. I'm all for capitalism, but not at our peril.

From handgunlaw.us The only way to resolve this age old dilemma is to force NJ to define the meaning of "loaded". I believe the state is intentionally leaving open the interpretation so the state may prosecute based on their whims. If one gets arrested for having a loaded magazine, the defendant will surely win (eventually), but at a cost of many thousands of dollars. I am looking around the interwebs to find a NJ case where someone has been arrested for transporting a properly secured loaded mag, that was not attached to a firearm. It may very well be that there is a president setting case, however, the state continues to intentionally maintain the ambiguity of the matter. Basically, the state knows it [probably] cannot successfully prosecute, but intentionally keeps the law vague, in order to make the financial burden of defending one's self so costly, it essentially achieves the goal of forcing law abiding citizens to bow down before the state.

This! Get your kid into shooting and teach him about gun safety and to respect firearms. You will be teaching him valuable life lessons and spending great quality time with him. When your wife sees that she will likely warm up firearms, even if only a little. It's a win, win, win!

I don't care about the prosecuter at this point, I care about an LEO arresting me for something a lawyer said MAY be illegal. By the time it gets to the prosecutor I will be out at least a few grand. A lawyer saying something MAY be illegal puts that thought in the back of everyone's mind, as witnessed in so many of these threads, including the minds of LEOs. If Nappen never said anything, this would not even be a subject of discussion and hence would not be in the back of an LEOs mind when he pulls over to help you change a tire on the side of the road, with your trunk wide open, and a loaded magazine lying there in plain view!!!

Congrats on the 92! Great choice. Now get the the .22 conversion kit. Now you have 2 hand guns. (kinda) Cheaper to shoot and easy to learn on. Next, start getting your son interested. 12 is a great age to start him if the schools haven't brain washed him yet. Anything you can do together and spend time doing is a plus. Your wife can't complain about that. After all, you're doing it for your son.

I read through and you’re right it isn’t your fault. I’d get the 700 in 6.5 for a couple reasons. While .308 is ubiquitous and there is plenty of good ammo choices I’d choose 6.5 because it’s more BC, there’s als a lot of god ammo choices and, important to me, noticeably softer shooting. I have 6.5x47L and it has very light recoil. Id go 700 because of the large universe of aftermarket support. RPRhas gotten quite a following but I’d still go 700 action.

I know, right? My wife doesn't think about Ammo at all. It is as if it doesn't exist, unless she sees too much money being directed in that direction. Only the first gun in the house was a big deal. Much better to get guns that look alike and never put them next to each other. Even a Glock and a Smith & Wesson are similar enough to pass the test. Get all revolvers in stainless format so that they all look alike. Rule of thumb... never ask about shoes unless she brings up guns or ammo. I would avoid supporting Dicks, as they don't respect our personal liberties.

My wife gets really pissed when I buy guns or ammo. More so with new guns since she has no idea how much ammo I have. She yells at me then she is fine a few hours later.....But in the end it's well worth it since I still have my new gun!

https://www.pcgamesn.com/assassins-creed-unity/notre-dame Ubisoft has announced that it’s donating €500,000 ($564,000, £433,000) “to help with the restoration and reconstruction” of the Notre-Dame Cathedral, which was severely damaged in a fire that saw the building’s spire, and roof destroyed, as well as much of its original woodwork. In a press release issued earlier today, Ubisoft also announced that “we want to give everyone the chance to experience the majesty and beauty of Notre-Dame the best way we know how.” To that end, the company is giving away Assassin’s Creed Unity – which is set in Paris and features a highly-detailed digital version of the Cathedral – for free. The deal is limited to PC, and you’ll be able to download the game via Uplay or the Assassin’s Creed website for a limited time – Ubisoft’s press release says it’ll be available for one week, meaning you’ll have access to it from 16:00 today until 09:00 on Thursday, April 25 (depending on your local time).

I feel you're over thinking this. There are plenty of people with plenty of guns they acquired legally before they moved to NJ. I haven't heard of anyone with any problems because of this.
