    Per ATF, a stripped or assembled lower is logged in and out as a "receiver". If it is a complete rifle than it is a "rifle". In order to be a "firearm non-NFA" which is the legal term used by the ATF, it must arrive to the FFL manufactured in that format. There is nothing special engraved on ours, it is the manufactured configuration and the transfer paperwork which classify what it is. Hope that helps.

    And just an FYI and a reminder from the M1 Carbine fiasco... If you want this to be okay... DO NOT contact the NJSP with questions... "Is this NFA/Pistol Brace thing legal?" That is exactly how the M1 Carbine got canned about 8 years ago.

    While I probably can get something better in Maine, I kind of want to buy one when I’m back in NJ... packing for the move. Maybe just knowing that and my TAC-14 were both middle fingers to NJ. Don’t know, but I’m very interested in pricing and who will stock them in Monmouth County. Hopefully HGW or Monmouth Arms (favoring Steve, since I won’t see him anymore). Shore Shot... too much bad blood over the years for me to walk back in.

    I do grow a bit tired of the comparisons the left makes with Australia (and New Zealand). It is deceptive in that for starters they have a higher "mass shooting" definition than the States, not to mention how some shootings, like the recent one, were ignored by the US media. Also, if they want to be balanced (which they dont) they can add 300 million people to their percentages (which would give them almost the same population as us) and then see how the numbers of Australia really match up.

    I call BS, why cant you build one from a legally purchased stripped receiver? If I slap together the same exact parts outlined in the letter there is nothing stopping someone from building their own. The only thing the letter outlines is the legal configuration of the "firearm", and in addition to it names the 2 submitted "firearms" in question as legal... I see nothing in the letter outlining that it must be purchased complete. If the question was.... can i take a NJ legally purchased rifle and convert it... then the answer is no.... Exactly how was the questios proposed when they said you couldn't build one?

    UPDATE. I got the letter. LINK HERE. From the NJSP: "The New Jersey State Police Firearms Unit finds that the submitted Troy Industries A4 "other firearm" as well as the Dark Storm Industries DS-15 Non-NFA Firearm Typhoon are legal for sale in the State of New Jersey and are NOT considered to be an "assault firearm." This opinion is based upon the two firearms reviewed, however if the design or dimensions change from those samples, it may change the classification of the firearm. ". From the ATF: "In conclusion, correspondence from our Branch is dependent on the particular facts,designs, charactersitics or scenarios presented. Please be aware that although other cases (submissions to our Branch) may appear to present identical issues, this correspondence pertains to a particular issue or item. We caution against applying the guidance in this correspondence to other cases, because complex legal or technical issues may exist that differentiate this scenario or finding from others that only appear to be the same. This determination is based on the sample as submitted. If the design, dimensions, configuration, method of operation, or materials used were changed, this classification would be subject to review." OAL: According to the measurements, they measure OAL from the buffer tubes. My opinion. I may have an unpopular opinion on this. First thing first, the GOOD news is that our state literally just acknowledged the LEGALITY of non-NFA firearms in NJ!!! That shit is f*cking huge in of itself. Like holy shit man. That is f*cking amazing..... Now, let's talk about this. The two sections of the letters are very clear to caution everyone not to use these letters to justify the legality of other firearms. It's pretty straightforward. Don't try and use this letter to justify why a AR pistol is legal, because the letter of the law is VERY specific as to why non-NFA firearms are legal, and the average folk may not realize that something as simple as removing a VFG would make it illegal. We are talking about a category of arms that would be a federal crime to own if it was only 0.60 inches shorter or if the VFG was taken off. OBVIOUSLY they are going to say this. They have to urge everyone to be careful, because the lines are already so god damn blurred with these senseless gun laws. It's pretty simple. Do NOT remove the VFG, DO NOT put a stock on it, it HAS to be >26". The gun is legal in its STRICT format. Any small variation (no VFG grip, shorter barrel, etc) will make it illegal! The ATF letter mentions if any of the following are changed, they would be subject to another review. NONE OF THEM SHOULD CHANGE REGARDLESS. design (non-NFA firearm designed to be used with two hands) dimensions (HAS to be greater than 26") configuration (NEEDS A BRACE, and a VFG) method of operation (semi-automatic, not automatic) materials (metal, plastic, same materials) The important takeaway for me is this. We know the LAW because they literally spent the whole letter explaining it for us. They then told us it was legal to own and purchase. That is literally a done deal. Some people may get scared from building their own because of this letter, I personally see this as a green light. You know what is legal, you know what is not. If you are scared of building your own because you want the states little stamp of approval, then I guess you should send in all your guns to NJSP! But in all seriousness, I simply cannot find a single law that would prevent us from doing so. The guidelines of legality are set SUPER straight, even by our own draconian AG's office and NJSP. Stripped lower receivers are marked as OTHER on the 4473, which is exactly what these non-NFA firearms are processed as. We are in NJ though so, the general disclaimer is to be a gun owner at your own peril

    If a cop offers a woman money for sex and she takes it without force it's still entrapment. If a cop offers me pot and I buy it from him it's still entrapment. They asked hey asked and NFA did. They knew very well what they were ordering and that they couldn't. They are law enforcement and they can't ask you to do something illegal and then prosecute you for it. If I ordered it and they shipped it and the cops did their job of investigating it and found out about it then it's not entrapment. But they are not allowed to go around inviting (which this is) people to break the law and the prosecute.

    Im not aware of any NJ state law that mentions a 26" or greater OAL requirement, other than the "sawed off shotgun" definition. "Sawed-off shotgun" means any shotgun having a barrel or barrels of less than 18 inches in length measured from the breach to the muzzle, or a rifle having a barrel or barrels of less than 16 inches in length measured from the breach to the muzzle, or any firearm made from a rifle or a shotgun, whether by alteration, or otherwise, if such firearm as modified has an overall length of less than 26 inches. I cant find anything else in the NJ law that has length requirements... so my non lawyer opinion would be that the NJSP can pound sand in terms of measuring OAL for a "firearm". For a modified rifle or shotgun, yes. I understand companies try and find a middle ground to get a product legal in as many states possible, that makes sense why you would go with a 12.5" barrel for that purpose.

    It’s definitely on the list. That’s why it makes me wonder how legit this list is? But again the citizen is at their own peril when it comes to gun laws in NJ. I guess it only matters when it does like when your in front of a jury looking at some time. Sorry just got called my buddy he sent me a pic of the Colt it’s not engraved AR-15 like he stated it was.     As Maks indicated, the US Carbine Caliber ML was approved by the NJSP by an email, then disapproved by the NJAG in about a week, because it was still an "M1 Carbine Type". This however is different. The non-NFA non-AWB Firearm approval is on NJAG letterhead. It will be overturned by the politicians in the future by passing a new law. It will take awhile to happen though.

    I think that would be an interesting case... You are then saying you have no responsibility to know what is legal and what is not? Or in essence... you bought a gun on the last day with 15 round limits before they went to 10. Now the limits are 10 and you still have 15 round mags. Whose fault is it? Yours? Or the Dealers? For the time being, however long this may be, these types of firearms ARE legal... Of course, this is NJ and you must understand how fine of a line these guns are made for... and as we have seen in the past, the AG can easily come out with another interpretation of what is compliant and what is not. While you would hope the dealers are up to date and reach out in case the guns are no longer compliant, it is ultimately your responsibility. While these new non-nfa firearms are currently legal, we all know the state of NJ and there will without a doubt be calls about this... from non-believers and MANY FFLs. If you want to risk it, or have money to lose, then go ahead and get one as soon as you can. Most people here will likely tell you and agree with me that this is not likely to last too long and either an AG will come down on this OR NJ will redefine gun definitions. As a reminder, they run the entire government... they can do it. So I give it a year, tops (if they have to go the legislative route). Keep in mind, unlike the silly M1 Carbine... these guns are the holy culmination of all that is despised by NJ... short barrel, flash hiders, pistol brace, over weight limit, small enough to conceal in a backpack and oh yes... evil looking. So if you want to taste freedom and give NJ an FU... go out and buy one as soon as you can... just know that 1. you will attract A LOT of attention at the gun ranges and 2. It may be a temporary purchase. By temporary I mean like California people quickly rushing out to buy 30 round mags before they appeal was put back in place and back to 10 round limits.

    Its not even about the middle finger. I figure, my wife gets home early from work (substantially earlier than I, 90% of the time) , and has access to something that will protect her and the family, finally available to us, that has ammo that is considered commonly available, easy to use, with minimal recoil. Unfortunately, the rest of the United States has had access to such items for a few years, and if it is the incentive of the commonwealth of NJ to tax firearms and ammunition, then making more things available to the people that aren't restricted, just makes sense. While I do argue taxes, especially in the great state of NJ, the taxation of firearms and such items, why even consider restricting any access to firearms that are similar in nature; yet benefit the state? Sometimes, I think both republicans and democrats and the typical ideologies of the typical politicians of NJ get it wrong more often than not and this is something that just makes sense.     Wow. This is great news. Looking forward to handling something similar to what the rest of America (roughly) has access to. While fully realizing there are some trade-off's compared to what the rest of America gets in every direction away from NJ, this is a benefit in every direction. Surely, this is something more compact that the wife would love. "i like this but it would be better if it was smaller"- Wife (at this moment I introduced a comment about PA, and got the stern NO) at least for now. And I've ironically never heard a woman ask for anything "smaller" in my life. So VFG and a Brace. Where to even start? Run a carbine system, h2 plug .750 gas port and a standard bolt and everything should be 100% operational around 10.5-12.5? Dont remove the grip and everyone is a-okay?

    11.5 pinned will 100% meet the requirement. I'm just trying to figure out if a 11.5" would, w/o having to pin and weld. It may fall just short, unless you get a slightly longer tube.

    According to the letter released on the legality of the non-NFA firearms, NJSP/ATF measured it from buffer tube to the end of barrel threads (or muzzle device if pinned). Until today I couldn't figure it out either.

    He's also retiring real soon.......... Problem with all this is the NJSP FIU is not going to make any decisions about the legality of a firearm. That will be left up to the NJ AG's office - which, considering the current administration, I can't see approving anything controversial.

    Bumping this thread, as @Franklin Armory poked the bear, me. I whole heartedly agree with @e92m3allday on this. As per Federal Law, one may acquire a stripped AR receiver, install the lower parts, add an arm brace, slap on a front vertical grip to a 10.5" upper, then hook the upper and lower together. Woola!! You've built a 26" firearm. It is not a pistol, as it is designed to be fired with two hands. It is not a rifle, because it does not have a stock which is designed to be fired from the shoulder. It is not an AOW, as it is over 26" and not concealable. In fact, it does not need to comply with the NJ AW Ban because that pertains only to rifles, pistols and shotguns. Okay, so who can word a letter properly to the NJSP or NJAG to address this legal issue, ie the shockwave approval letter. @JasonSeidman
