  2. I am more confused than when I first asked. I just wanted to know if it’s legal before I formally ask a lawyer and not seem like a dunce but now I am even more confused.
  3. I trust that. Just worried about what would happen if I did this, acquired it legally, but brought it back to my NJ home and had to use it in self defense and questioned how I got this firearm while denied an FID

  5. Sorry for my ignorance. Am trying to learn and be lawful. Would you need an FID to do this? I’m in the process of getting straight with one as we speak, as I got the classic de facto denial with no reason and no history of psych/arrests/restraining orders/nothing but would like to get my hands on something in the mean time in light of current events. I’m no stranger to firearms, been a member of hunting clubs all my life with my father and hunted wild bore in Florida. Even enlisted in the army. But now I don’t live with pops and can’t have anything here at this house since I was denied for whatever reason. So, using this method, I could LEGALLY own without an FID even though I was denied? In your opinion, of course, which I understand is not legal advice.

  8. I agree with you. But like we know, these laws are designed to trap us and go against us, which they did to me at the time, being a naive 18 year old. I didn’t have the knowledge to go beyond asking for an appeal or know to do that. I couldn’t afford a lawyer at the time. They blind sided me, seemingly purposely, which I didn’t expect with a clean record. Now I’m coming to you guys trying to figure this out and set it straight before I take action. I won’t do anything until I speak to a lawyer and the NJSP first. Hopefully, possibly, Nappen, can simply ask why like you said and ask if the issue has resolved itself or what we can do to get approved. I don’t know. I am not a lawyer, haha. But I figured I could collect my thoughts with you guys here before anything else.
  9. Wouldn’t the same police station just see me come up again and auto reject me since I didn’t apply and appeal their last decision not to issue me an FID?
  10. You might be right. I’d rather be arrested in that situation than die in a home invasion, one might reason.
  11. I’m worried it may be used for home defense at some point and the cop will ask to see my FID. That would be scary. I have 3 parking tickets from high school. That’s the entirety of my record. I know I can legally posses in Florida, I just hope the cops agree here. I will have to ask.
  12. That’s the plan. I can do a private sale in Florida legally since I’m seen as a resident there under ATF laws and their gun statutes, then bring it here and have bought it legally. I’m worried a prosecutor may disagree with this though especially if I got denied an FID already :/

I would just really appreciate some advice from knowledgeable people on this. I’m smart enough to know I’m in a real tough position but too dumb to know how to get out.
  15. I’m not sure who you guys think I am. I’m sorry if I said something rude? I can link to my old Reddit posts about this from 2 years ago when I was first denied. It also has a picture of my denial letter as proof. I’m sorry if I didn’t follow posting standards with this I could show you my denial letter if you’d like. I posted it on Reddit two years ago when tbis happened with the appropriate info crossed out. It was two sentences long. It was tough to do anything when leaving for basic 3 months after.
  16. You are both hilarious and very informative. Thank you for the response. Hahaha I am very close to a choir boy! I am involved in my church but for real I’ve never ever been detained or anything by the police. Most I’ve done is get a detention for skipping class and get a parking ticket. My name is very unusual. I was also enlisting in the Army at the time and completed all that without a hitch. My recruiter at the time was also shocked with this since I saw him a fair amount and liked to talk to him as a cool guy. But end of the day, I was denied. And I can’t appeal since it was ignored. But I also have a place in Florida with my father. A nice little prefab by the beach. And I saw a ‘loophole’, so to speak, to get out of this mess and just be a gun owner. We belong to a private range and club with limited members and it pains me I am neutered with that and my rights. Thanks for the input, all. I’m sorry if I came off too casually or if I said something. I’m not trolling. I really would like help with this. I can link to my Reddit posts about this from two years ago.
  17. I agree with you. But no, I will tell you honestly I was a naive 18 year old when applying and didn’t know how to handle it that far without legal advice that I could’nt afford at the time. The PD clearly wants to deny people and trap them in the process which they did to me. Now I’m in quite the predicament trying to fix this. My record is still spotless so that’s good I’d hope for an eventual appeal.

But for the sake of argument, here is a quote by Nappen in his book New Jersey Gun Law Guide quote — Please note that under Federal law, dual residency is recognized for handgun purchase purposes under Title 27, CFR Part 478.11. This Regulation as defined gives the following definition and specific examples of dual residency: The State of Residence is the State in which an individual resides. An individual resides in a State if he or she is present in a State with the intention of making a home in that State. ... The following are examples that illustrate this definition: ... Example 2 - 'A' maintains a home in State 'X' and a home in State 'Y'. 'A' resides in State 'X' except for weekends or the summer months of the year and in State 'Y' for the weekends or the summer months of the year. During the time that 'A' actually resides in State 'X', 'A' is a resident of State 'X', and during the time that 'A' actually resides in State 'Y', 'A' is a resident of State 'Y'. ... A person who qualifies under the Federal requirements may purchase handguns in other states while a resident of the other state and lawfully transport them and possess them in New Jersey without needing a NJ FPID or PPP or registration under the Federal law of USC 18 926A and the NJ law exemptions of NJS 2C:39-6. — sorry for the walls of text. I’m about to do it to you again. Here’s some ATF quotes on ID. "Licensees may accept a combination of valid government-issued documents to satisfy the identification document requirements of the Brady Act. The required valid government-issued photo identification document bearing the name, photograph, and date of birth of the transferee may be supplemented by another valid, government-issued document showing the transferee's residence address. A member of the Armed Forces on active duty is a resident of the State in which his or her permanent duty station is located, and may satisfy the identification document requirement by presenting his or her military identification card along with official orders showing that his or her permanent duty station is within the State where the licensed premises are located. “ Heres some of their secondary forms of ID.. The following secondary forms of ID are acceptable: • ⁠A current lease. • ⁠Evidence of currently paid personal property tax or real estate tax. • ⁠A current utility or telephone bill. • ⁠A current voter registration card. • ⁠A current bank check. • ⁠A current passport (must include an address). • ⁠A current automobile registration. • ⁠A current hunting or fishing license so, my father could simply use a quit claim deed and get me off it and make me a lease holder under him and this would satisfy it since the bills are in his name alone. Seems like considering all this, IMO, I look good. Though I’m a fool so don’t listen to me.

  22. Yes. My bad. I am not a Florida resident. I meant I would be treated like one under their laws and wouldn’t need to present an FID. You’re correct. To clarify — Since I I was denied an FID, for what reason, i don’t know, but still acquired a firearm legally in Florida, I could take it back to my NJ primary residence and keep it here legally. Is that correct in your opinion? I plan to call Nappen and the NJSP in the coming week to further clarify. Figured I would run it by you fellas first to not seem like a total clown when asking.
  23. Hey guys, I have a question for you. I’ve asked this on Reddit but I’d like a 2nd opinion. I was rejected an FID here when I was 18. I had no prior arrests or detainments and zero psych history. Not even a speeding ticket. Yet I was denied and the reason given was due to my background check(?). I then filed for an appeal. This request was ignored and they never got back to me. This was two years ago. Now I have a residence down in Florida with my father and the deed has both our names on it. If I understand correctly, I do not need an FID here if I legally purchase one in florida without an FID and bring it back to my NJ residence. Since I only need an FID to purchase here as a jersey resident, I would purchase in Florida as a Floridian resident under ATF law, no? And then legally transport it and keep the firearm here. I’ve read about others doing this but it seems to good to be true. Can anyone settle he legality of this?
