  3. gov.uscourts.njd.249720.25.4.pdf in the brief from Dow.. on page 4 ...simply put; she says if nj allows citizens to carry,,violent gun crimes will increase... to me she's saying no law abiding person can be trusted ,,she wrote;while some may carry for self protection others will committ crime plaintiffs say judges have complete discretion and she argues they dont then says judges determine if applicant meets the requiremenmts all i read from her is; judges dont but they do..and you can but you cant.......end of rant....

I can top this story..the other day my 7 yr old nephew made a paper cutout of a hammer in school (old bridge)..yup, he got in trouble..the teacher called my sister and said he made a weapon in class and would not be allowed recess for 1 day.if he does it again he might be suspeneded....sis is now looking to pull him out of that school.....

I would agree if the suit was about nj being a "no issue' state...nj being a "may issue" might be seen as reasonable restriction but the "justifiable need" requirement is the target in this case..lets say our side wins and they remove the justifiable wording.. NJ will still have "May issue" on the books..could'nt they just deny for public safety reasons just like they could for an fid can someone explain how winning this case will make nj go "shall issue" without legislation that changes may to shall...
  7. it was like reading something pelosi would say..oooh the 60's..surprised she did'nt say nj could be a no issue state if we feel like it oooh the 60's..and she argues like the suit is about nj was a "no issue" then says we do but we dont want you to but you can..so the plaintiff has no standing..I read the whole thing and WoW is all i'm left with.. AG dow is something special...
  8. after reading the nj law its illegal to buy a non-firearm in free america and bring it back to nj without going through the process nj requires...other than being a nj compliant firearm; a resident of nj must comply with nj law, ie p2p/ffl or be in violation of the law...I'd love to get a black powder pistol but not bad enough to lose my freedom
  9. there is an on going disscussion at another forum (NJH)basically stating a nj resident can buy a BB HG or black powder pistol in Pa w/o a p2p and bring it home legally....I know BB guns arent real guns in Pa but you committ a crime when you cross the river into nj with a bb pistol, w/o a p2p and ffl transfere in nj right ?? I cant find the statue or law to prove me right..anyone know??
  10. we all know what needs to happen..but when we have lawmakers spending time on more important matters other than getting re-elected, they spend time making ,september "hystiocycosis month" or declaring everyone in nj should observe "earth hour" or requireing bicycle registration to protect the elderly... gun law reform in nj ranks right up there with designating BB guns as toys.....
  11. just saw on fox...a N.carolina dem and a Utah rep. lawmakers have stated they have carry permits but never carried but now plan to carry thier weapons in the wake of what happened in Az.....so maybe if they want to stay armed while in DC they'll have to pass some kind of legislation for that.... could this be the begining of something big?

I quickly skimmed the case file and while I dont agree with everything the court said; to me it seems the title of the article is a little misleading and or perhaps the courts opinion is the right one considering the circumstances... the guy was claiming 2a protection while being accused of a crime ;ie..carrying without a permit...so technically he violated the law right?? the transporting/possesion law in MD mirrior nj to some degree ...the guy was carrying a loaded HG in a back pack and the police saw him retrieve it from under a bush..most, if not all of us here would agree a permit to carry would pass constitutional muster and I believe scotus indirectly opined as much..no? so by claiming he did'nt need a permit because of the 2a was foolish because the state law says he needed one to carry legally....I would argue that if the pending HPID card is granted to a person that it should also be a defacto carry permit..I mean if you are not prohibited to buy a HG then why cant you carry it.....they(issuing pd) could just ad endorsements to it like a motorcycle lc. is to a DL....
  13. who cares about PA this a NJ law topic...my list is what I think would be possible in NJ ..and yeah I have issues with people that want a drink booze while carrying a gun....months ago an off duty did some drinking and left his gun behind...how does PA deal with someone that gets stopped for DUI while carring?? current law prohibits weapons in sensitive area's..I added posted area's cause privately owned store's or bars have a right to refuse service if they wish..ther's no way in hell NJ would allow open carry.....you cant apply logic when you use; Gun and NJ in the same sentence..this state is 90% sheep (most of them think thier better than anyone else) 7% us and the remaining 3% is the reason we want to be armed.....
  14. my gun law wish list;; these are based on someone not being prohibited... 1) FID w/photo to be shall issue, to be used for all purchase ie. long gun,handgun(age restricted),ammo...a 1 time $100 fee to cover all costs for issuance good for life or till you become a prohibited person by current standards 2) local PD records and NCIC to be used for criminal history check only 3) eliminate personal refs, work refs, credit history...(these are arbitrary and subject to opinion as to ones worthiness) 4) conceal carry permits to be shall issue upon completetion of NRA safe handling and use of force certs. 5) FID or permit to ccw shall be issued no later than 5 bussiness days after submission of application... 6) ccw permit to be renewable every 5 yrs on date of issuance..fee for int. and renewal shall be $100 with current course training certs. 7) non ccw transportation of fire arms to be lawfull with an FID card or valid hunting lic. to be unloaded and locked per current regs. 8) ccw to be illegal in sensitve areas or other posted public places 9) consumption of drugs or alcohol while ccw'ing is prohibited..
  15. maybe he's thinking gunowner's should have a carry permit of some type that only makes it legal to have a gun in the car for transporting only, perhaps eliminating the go directly to and from part of the legal by exception law; not the carry law we'd like to have..... if they push for the HPID card then that should be your "permission slip" to lawfully transport at the very least

  17. here's my take;;; if you get the H.P.I.D card you dont need the P.P if you plan to buy HG's on a reguler basis... if buying a HG is a one time thing, you can get a P.P without the added expense that goes along with getting the H.P.I.D card... its both good and bad...the current F.P.I.D. card should be all we need..... if you can buy a long gun now, why should getting permission to buy a HG be a different prosess..

I'm confused...lets say this bill passes..a person needs to take a couple of class room course's and live fire qualifyier to apply for initial ccw permit..as I read the bill, it states that renewal will be the same format.. then there's the part about semi-annual qualify....I quess my question is, will this still cost $500 a yr with the course study? or is it just live fire semi-annual and course study every yr ? or is course study semi-ann or a one time thing? the part about getting a judge, to decide issue or denial is b.s too..the issue should remain with the chief; just like the FID.. its stiil not "shall issue" in my mind..... I bet the first thing a judge will restrict is carrying while driving...
  19. in an article discussing vandrew's bill it reported that a little over 1,500 ccw's were issued in 09'; that figure did not include armored car guys,security and alike..it went on to say that, of those that were issued ccw; they went to well connected people or those that carry large amounts of cash or jewelry on a daily basis...

  21. i was thinking that this guy did not know that he is not obligated to consent to a warrant-less search of his vehicle beyond what could be easily seen and by doing so, his 5th and maybe 14th adm. rights were violated.... i remember reading something about a guy that allowed a search of his car not knowing he had a right to say no to a warrant-less search that would lead to self incrimination and the charges were dismissed....
  22. a florida man is arrested for posession of a handgun in nj..I think this should be a test case in the high courtnj.com or will nj screw this guy to the wall....

    Expungement

    just my 2 ct's..as long the offense does'nt disqualify you from gun ownership or ccw.. you can do the expungment without a lawyer for $150. I think...takes a few months..
