Some feel that if you call the NJSP Firearms Investigation Unit they will go to bat for you and remind the local PD that they are not in compliance. Sometimes when the Chief finds out you are over 30 days he/she steps in and fast tracks things. They don't want headaches or bad press. I've read that a polite letter informing the chief that the PD is stepping all over state law and your permits are over 30 days may gets things going.
  4. I did the hav-a-heart and garbage can filled with water once only because it was a skunk. Since then, my buddy showed me how to cover the trap holding a tarp up to conceal myself as I approached. We were able to cover the trap and take him for a ride in a pickup. He now lives by the power lines some distance away. The ground hogs also go for rides, across a river and past a 4 lane so they won't come back. About 15 years ago I was told by someone at the state level that you can live trap and release only on your own property, mainly so you don't relocate a rabid animal. They may have lifted this sanction, at the time a few rabid raccoons supposedly from PA made it across the Delaware River to the Garden State.

  6. I spoke with one of the board members while loading my car the other day. When I asked when he figured the pits would be done he told me about the Pinelands Commission woes. I asked if we had an attorney who has dealt with those folks before and he said yes. As of a few days ago I heard the machines that process soil running so they still must be removing the lead.
  7. I just picked up another handgun from my local FFL today. Yesterday was the 30th day since the last purchase. We got to talking about the moronic law and how NJ was regulating it. He said that NIC's doesn't have a clue when the last time someone purchased and was not advised on the matter in any way. His contact at the NJSP said that the law was in effect but again wasn't clear on how it would be administered. Not wanting to be a test case, I waited 30 days. The dealer had an interesting point in that who's to say I didn't make a buy the same day somewhere else. NIC's doesn't seem to have a mandate so even if the people on the phone recognize the name they're not in a position to police it. I'm guessing that someone, probably one of our useless legislators, will demand an arrest or two to show everyone that the law is working and keeping all the dangerous guns yadayada. Then some poor shlub and maybe even an FFL will have to do the perp walk on NJN.
  8. I'd have to agree, the oral arguments are minuscule compared to what goes on during the debating, voting and the long process of writing the opinions. Not to mention the amount of time the justices read and collate documents. I listened to the full oral argument for Heller v. DC the other day and I was amazed at how attorneys were constantly interrupted, sometimes not even able to finish a thought. I don't believe it's for show but I'm certain it's so the justices can home in on their sticking points or things they want to hear first hand from the lawyers. If I was to go by the oral for Heller I'd say that Gura was not necessarily the winner. IMHO it'll probably go 5-4 for some sort of incorporation. They'd have to go back on Heller to vote otherwise.   9. You'd think, but if that were the case then why can you be arrested in NY and NYC fore doing just that? They have some goofy law that says you need a special permit to traverse NYC with a handgun irrespective of the federal law. You'd think that law would be irrelevant but that doesn't stop NYC PD from arresting people. So for instance if I leave NJ and stow my 45 and ammo as prescribed on my way to a state in New England where I can legally carry, I can still be arrested. Unfortunately even when a federal law is supposed to preempt the state laws a local can still arrest you and you have to go to court. Then you're still at the mercy of the a local judge. Look at DC, even though SCOTUS knocked down their law someone still had to to sue to get it enforced. Chicago, DC, NY, NJ, CA and similar will all go kicking and screaming no matter what the Bill of Rights says. I read where the goons in Philly actually tried to ignore CCW when it first became the law of the state and it took the attorney general coming out and saying he'd march in there with the state police if they didn't tow the line. They tried to pull some crap about a class 1 city. Even to this day I hear that the Philly PD will harass people with valid CCW permits.

  12. Here's an interesting tidbit: I'm a NJ resident and my FL card is "Concealed Weapon or Firearm License" I was told that FL doesn't make the distinction between resident and non-resident. The only giveaway is my home address printed on the front of the card. My VA card is a "Nonresident Concealed Handgun Permit" card, so they make the distinction.

  14. There was an original 1789 4th amendment of the New Jersey State Bill of Rights that is almost the same as the federal 2nd amendment. Not sure why it's not there now. http://www.njarchives.org/links/treasures/usconstitution/billofrights.html Maybe my wording was misleading but the NJ Dept of State posts this and says in part, "On November 20, 1789, NJ became the first state to ratify the Bill of Rights" so it appears the state adopted the then Bill of Rights which included the 4th. It is now our 2nd amendment. Not sure if its too much of a stretch to say that by signing onto those amendments made them recognized by our state.

If you get involved politically on a local level and are known by the chief and a county judge these things can happen. It's all about networking. They gave him a limited CCW at first, probably to test the waters so to speak. He got an unlimited CCW at renewal. Ironically, when his friends retire he'll loose the CCW because the new guy may not buy his "justifiable cause" for carry. The "justifiable cause" is legally the weakest point of law IMHO because it is vague. The part of the code that should become void once McDonald v Chicago is settled favorably is the exemptions. NJ says no one can own a gun "except". Well if keep and bear is ruled to be an individual right in the states like SCOTUS did in Heller v DC then NJ has a chance. I'd like to see Christie demand the legislature fix the codes to line up with the bill of rights once this gets ruled on.

  17. In Pennsylvania for instance, you can legally conduct a face to face long gun transaction even at a gun show, totally legal. It's referenced in the state code. The state leaves it up to the seller to confirm if the buyer can legally purchase. No need for paperwork in this case. Any FFL in PA can also sell without having to transfer to a NJ FFL. You need an FID card and have to pass the NICs. I've done both.

While this promises to me something of a circus, sometimes, circuses can be both entertaining and productive. The advocates of fiscal restraint, tax cuts, etc., will be present; Steve Lonegan anticipates bringing down quite a few supporters. Presumably, the public employees will attend en masse.
