  1. Not sure you get this principle. If you were in a sensitive place with a gun prior to Dec 2022, that wasn't sensitive, you can't be charged. I fulfilled all the licensing requirements at the time, per statute. It's literally post defacto to change the law and then say I didn't.
  2. When you applied, per statue, and were granted a licenses prior to Dec 2022, you fulfilled all the requirements to obtain and retain a license for 2 years. Why would I or anyone else look at the post Dec 2022 law and believe we applied under it when it's amendments didn't exist?
  3. I did not apply under "this section", as it was legislatively amended after the fact. I did not get my permit under the current (Dec 2022 rev.) 2c:58-4, that's the entire point of ex post facto. You can't change any part of a law and have it apply retroactively. It makes no difference if it's adding or amending sections, subsections, paragraphs, subparagraphs or clauses. A section is not simply defined by its nomenclature, it's inclusive of everything found within it. By your standards, the legislator could just change sections to anything they want and claim they always existed... That's not even a different argument, it's the entire argument.

  5. Supreme Court has ruled on ex post facto laws, many of us have our permits prior to the passage of and/or when the laws went into effect. "A person who obtained pursuant to this section" doesn't apply to people who obtained them when that law didn't exist. Even better, the NJSP refer to the requirements as "interim" Indicating its not even "established", as it can change based on that language. It would seems the State is not doing itself any favors.

  7. We're still missing the point. The law doesn't allow for them to revoke an approved license unless specific conditions are met. There is no retroactive statute on qualifications. My quals were done under the letter of law, and reviewed by a chief of police and Judge using the then current NJSP directives. It's not probable that my chief of police would even rescind my license without a statutory reason. I can just see how many people would end up in the cross hairs of a civil rights violation. I dont think my town would be willing to bet millions of dollars in lawsuits to revoke a handful of licenses.
  8. Cite the law. NJSP don't write the law buddy. They recieved some BS directives from an NJ AG that doesn't follow the law.
  9. Cite. The. Law. What does the law say I have to do to retain my license? I can't find where it says I am required to meet state qualifications. Qualifications are required by statute to obtain or renew a license... not retain.
  10. Like I said, nothing in the law states that a license can be voided for failure to qualify under these circumstances. It's. That. Simple. They can attempt to pull this BS, I WILL NOT COMPLY. My permit is valid, by law... until it expires or a statutory violation is met.
  11. No, it's not law. I checked the laws, and cannot find where it says a current permit holder needs to requalify under these new standards. Matter of fact, I plan on being proactive in this respect and will be doing 2 things if this comes to fruition. 1. File a criminal complaint against whom ever attempts to illegally void my permit. 2. File an ethics complaint against the NJ AG to have him either remanded or disbarred for an illegal attempt in knowingly limiting my civil rights.
  12. No problem, I will sue the state for fraud and violation of my civil liberties. Watch how fast they drop the charges. I have the resources. My permit was not issued with contingencies of qualifications to retain within the 2 year period, by law. This is purely scare tactics, from a legal standpoint none of this holds water for people with issued permits. The law does not give them power to void our permits under these conditions.
  13. The only thing I can find that says you need to requilfiy is Evan Nappan... of course. If it ends up being true, Everyone who has a permit should go down to their PD and file a criminal complaint for fraud against the NJ AG(cost you nothing to do it). We paid money for a 2 year permit, and they were issued by them. Anything less than 2 years constitutes fraud by the state since these permits cost money.

  16. Are you trying to get the state to pay for it? Anyone can pull an inground tank for about 2k if it's not leaking and it's a clean pull, permits and inspections and critical. I have not seen any requirements to install another tank above ground and used for a period of time. I think the state runs a program to "move" the tank from under ground to above ground.. some restrictions apply because they don't want to fund people removing the tanks for alternative fuel sources which would eat away at the funds primary purpose. I've done a few projects requiring permits around the house, your best bet it to just call the building and permitting department in your town and ask them for any and all information on removing an inground tank.

  19. You have to be nucking futz to open an FFL with out at least a LLC. I thought there was no regulations on 02 and 03 SOT as an 01 or 07 FFL. You can still sell and bid on state contracts for NFA and sell to LEO and transfer out of state stampable items? As an 07, you would need a NJ manufacturer license, too.
  20. Committing a felony and being a felon are 2 distinct differences, even more so when they have to be classified a fugitive. It is illegal to harbor illegal aliens, so I would have to say I was wrong with that statement. Even DJTs admin didn't pursue that level of enforcement, which makes you wonder.
