    Universal background checks don't erode Second Amendment

    When I voted for the Brady Law in 1993, which took effect Feb. 28, 1994, it was to keep firearms out of the hands of dangerous persons including felons and abusers.         Twenty-five years later — and 300 million background checks that have blocked 3 million purchases to dangerous individuals — few if any today seriously suggest that the Brady law should be repealed.

    I support the Second Amendment.  Universal background checks prescribed in H.R. 8 are an attempt to ensure that firearms are procured, owned and used by responsible, law abiding citizens.

     According to the Brady Campaign, about one in five guns now sold in America are done without a background check.  That’s a significant loophole.

    According to the CDC, there was a record 39,773 deaths from firearms in 2017 — 23,854 were self-inflicted and 14,542 were homicides.

    To mitigate gun violence in America, H.R. 8 expands Brady background checks to transactions by private sellers not currently covered by the law. 

    Multiple school shootings have led to robust, comprehensive action at every level to make classrooms safer.  I have visited many schools in my district, and I have found that while the threat is being taken seriously, no one policy, program or initiative can ensure the level of protection our students need and deserve.

    No constitutional right is absolute, including the Second Amendment.  The First Amendment’s freedom of speech, for example, has reasonable limits including the promulgation of slander and libel law. 

    To preserve public order, we accept reasonable restrictions on the freedom to assemble.  Even freedom of religion isn’t without some modest boundaries. In like manner, universal background checks don’t erode Second Amendment rights but do help ensure much-needed protection from gun violence for everyone.

    The fact that Smith talks about "transactions" and H.R. 8 talks about "transfers" means that he doesn't even understand the law.


  2. GOV. MURPHY ANTI-GUN "ROUNDTABLE"

    REVEALS MORE OF LEGISLATIVE AGENDA 

    February 26, 2019. Today, Governor Murphy held his second anti-gun "roundtable" in the State House, revealing more of Trenton's upcoming agenda on guns.

    "How can they call it a 'roundtable" when there was no one there to speak for NJ's one million law-abiding gun owners," asked ANJRPC Executive Director Scott Bach. "They always talk about wanting a 'conversation' about gun issues -- this was more like a monologue. They need to focus on severely punishing violent gun criminals instead of targeting tools needed by honest citizens to defend themselves."

    Claiming "our work is not done" and wearing a large red "F" pin on his lapel to commemorate the "F" grade he received from NRA, Governor Murphy declared as a goal for NJ to have the strongest "gun safety" laws in the U.S.

    During the meeting, more of the upcoming legislative agenda on guns was revealed, and it included:

    - A new "smart gun" initiative (replacing the failed 2002 smart gun law)

    - Requiring ammunition sellers to electronically record every ammunition sale (falsely assumes criminals obtain their ammunition from licensed sellers)

    - Mandating state-issued credentials to purchase ammunition (falsely assumes criminals obtain ammunition from legal sources)

    - Expiration date on firearms purchase credentials (falsely assumes criminals purchase firearms using NJ credentials)

    - Mandatory state-issued license for inheritance of firearms

    - Passage of redundant laws punishing various firearms crimes already prohibited

    Please get ready to do your part as anti-gun attacks ramp up in Trenton in the coming weeks and months.

    Per the NJ Courts:

    CONSTRUCTIVE POSSESSION

                The law recognizes that possession may be constructive instead of actual.  A person who, with knowledge of its character, knowingly has direct physical control over a thing, at a given time, is in actual possession of it.

                Constructive possession means possession in which the possessor does not physically have the item on his or her person but is aware that the item is present and is able to and has the intention to exercise control over it.  So, someone who has knowledge of the character of an item and knowingly has both the power and the intention at a given time to exercise control over it, either directly or through another person or persons, is then in constructive possession of that item.

     


  4. Constructive Possession

    The legal possession of an object, even if it was not in a person’s direct physical control. Often used in criminal law prosecutions for possession crimes, such as possession of illegal drugs. Generally, for a court to find that a person had constructive possession of an object, the person must have had knowledge of the object, and as well as the ability to control it. For example, someone with keys to a safe deposit box may have constructive possession to the contents of that box, and the owner of a car may have constructive possession of the contents of its trunk. 

    "Rendered Inoperable" - can't be reassembled into a functioning part.

If you're going to answer "yes" to question 26, which you should do if it's true, you should also concurrently submit a letter from the doctor who treated you saying that you're fine now.  If not available, see another one in the same profession who can review the file and do this.  It's common, even for police officers, to have had such treatment and in their case (I'm told by a psychiatrist friend) it's handled the same way.
