This will be interesting since SCOTUS has essentially ruled this sort of requirement unconstitutional. The NJAG's office will be in the position of either complying (unconstitutionally) or actually interpreting the law as unconstitutional in the post-Heller world: 3. The handgun ban and the trigger-lock requirement (as applied to self-defense) violate the Second Amendment. [**2787] The District's total ban on handgun possession in the home [bold]amounts to a prohibition on an entire class of "arms" that Americans overwhelmingly choose for the lawful purpose of self-defense[/bold]. Under any of the standards of scrutiny the Court has applied to enumerated constitutional rights, this prohibition — in the place where the importance of the lawful defense of self, family, and property is most acute — would fail constitutional muster. Similarly, [bold]the requirement that any lawful firearm in the home be disassembled or bound by a trigger lock makes it impossible for citizens to use arms for the core lawful purpose of self-defense[/bold]and is hence unconstitutional.

So why does NJ law mention members of rifle and pistol clubs: f. Nothing in subsections b., c. and d. of N.J.S.2C:39-5 shall be construed to prevent: (1) A member of any rifle or pistol club organized in accordance with the rules prescribed by the National Board for the Promotion of Rifle Practice, in going to or from a place of target practice, carrying such firearms as are necessary for said target practice, provided that the club has filed a copy of its charter with the superintendent and annually submits a list of its members to the superintendent and provided further that the firearms are carried in the manner specified in subsection g. of this section; when they aren't treated any differently under the law?? Except to have their names sent to the State Police annually.

Nice job. You might also consider replacing 'flash suppressor' with 'muzzle device' and then split to legal or illegal based on the type of muzzle device. The ultimate standard, as I understand it, is a two-part test (NJSP): (1) What is the design intent of the device (compensator, brake vs. flash hider) (2) Is the terminal opening close to the bore size (can you stick your pinky finger in it - if you can it's a flash hider) This might assist someone coming into the state with a rifle already configured. A threaded muzzle is fine so long as a permanent (pinned/welded) non-flash-hider device is installed. Ironically, the one of the muzzle devices most often used as a NJ-legal device has an ATF letter saying that it's not a flash hider, yet it is advertised as being one.

My question was quashed tonight by the League of Women Voters. I've never seen more naïve, stupid, liberal claptrap in all my life. NOBODY allowed to put forward a challenging question. All candidates spouting off about "the evil Tea Party" blah blah blah. At least on Thursday people will be allowed to ask real questions, "hopefully."

For the purposes of this section, "deviations as are reasonably necessary" means includes collecting and discharging passengers whose transportation is permitted under paragraph (2) of subsection b., subsection e., or paragraph (1) or (3) of subsection f. of this section, purchasing fuel, using a restroom, and contending with an emergency situation. A person transporting a weapon pursuant to this subsection shall comply with all other applicable State laws relating to weapons. Right?
