  1. At Cheyenne's today I signed up with U.S. Law Shield. I would encourage everyone to do so. They said if I had signed up before my weapons were taken, they would have covered my fees 100% instead of me having to pay $1,600. For the longest time I resisted because I thought that I do not need it as I do not CC in NJ or other states. This ordeal has been an eye opener for me. In NJ, any person who is permitted by law to file a ERPO or DV can do so and it will be accepted by the judge, no matter how flimsy the case. Protect yourself and be careful out there!
  2. Just got my property back from Monmouth Couty Sheriff's. All items are accounted for and free from damage. Each LEO that I talked to was very sympathetic to my situation and felt sorry for the position that I was put in by the MCPO. To quote one of them "Just because we enforce the law doesn't mean that we agree with it". Good to know that the Anti-2A stance of the Prosecutors' is not shared at the local level, as least in the people I spoke with.
  3. Providing an update. After filing the motion and brief, last Friday my lawyer's office recieved a letter from the Mercer County Prosecutor's Office BACKDATED to November 13, 2019 (day 44 of the statutory 45 day period) that they were not objecting to the return of my weapons. I would like to thank the MCPO for not informing me or my lawyer of this back in November, wasting both our time and my money in drafting unnecessary legal documents to ensure their compliance with New Jersey statutes. I am going tomorrow to retrieve the rest of my property from Monmouth County Sheriff's Office. I thank everyone who has donated. Dave
  4. As of September (when I personally contacted Mon Co. and Colts Neck PD), the property was still in their possession. They confirmed this and said that they would not forward the property to the prosecutor until they received that request from the prosecutor's office. CNPD is holding all my non-firearms (competition archery bows and crossbows).
  5. It is my understanding that the County Prosecutor of the county in which the TRO was filled has to request the property from the offices which siezed them (in this case Monmouth County). Once in Prosecutor's possession, this starts the 45 day clock they have to object to their return. In this instance, dispite me reaching out to them in August and my attorney in September, they have not taken possession of them as of September. They were seized back in May. After September, I let my attorney handle it so I do not know the current status. Even if they took possession of them in September, it has now been over 60 days since my lawyer contacted them and we have recieved no word of a Hearing being scheduled. A Motion to Return Property has been drafted and will be submitted to the court along with a brief today. No official denial has been issued. They just stopped returning my attorney's phone calls and did not reply to his letters. Yes, your FID is seized along with any property. In this instance I has my FID for all of 6 months.
  6. There has not been a Weapons Forfeiture Hearing. The State has been holding on to my weapons since May and has refused to release them or even say if they object to their return. The TRO was filed in Mercer and I live in Monmouth. Therefore I would have to go through Mercer to get them back. -Dave
  7. I want to obtain a firearms ID card but I have a rather interesting situation. Over one year ago my now ex wife obtained a TRO against me. When we got to court she immeditly dismissed all charges and we entered into a Consent Order for Civil Restraints. We have since divorced and I have the final papers. I want to obtain a firearm for target shooting but should I even bother? Will the Civil Restraints be seen as not in the interest of safety and welfare? I have contacted the NJ2AS attorney and am waiting to hear back from him. Thanks, Dave
