Hi Everyone I just Read the article in the Political report in Shooting Illustrated about The July ruling By the US Court Of Appeals that found DC's "good reason" to be granted a CCW unconstitutional. Wouldn't the conflicting rulings between the DC Federal Court and the Jersey District Federal court force the SCOUS to a hearing to resolve the conflict? This is old news from back in July I'm just hearing about now. If its already been discussed please direct me to the thread. Thanks
  6. Can anyone help me find the stats on how many people in NJ apply for CCLs, and how many of those applications get rejected? I'm having an online argument on a military forum (I'm a retired Marine). Some guy thinks concealed-carry-restrictive states such as New Jersey and California are not violating the 2nd Amendment since they have a process for getting a permit, my response is it is a de facto ban if the vast majority of permit applicants are denied, but it's hard to make that argument without stats to back it up.

Some have recently said that now is not the time to file a case for carry in NJ, they said, we need to wait for the right time, the right case. but we, at the Po6 ask, when is it the right time, what is the right case? Is it post mortem? Maybe Carol's case would have been the "right case" Or maybe one of the other, now dead NJ innocent victims that waited for help? Will you, or a loved one be the next one to be "seriously harmed" while waiting? What about when we had a favorable Federal court to the 2A during the bush years? We appreciate everyone fighting in NJ, but we cannot rely on just 1 organization or person, this must be a multi-prong attack that includes Education, legislation, and litigation that may help in policy change in NJ. Do you know it takes years to reach the SCOTUS on a case, or to settle a Federal case? We may very well be in to the 2020 election by the time we reach it there, and that is no guarantee we will make it to be heard. but we need to be in the fight, in the pipeline. If you’re not in the fight, you're not winning. It may be a California case, Hawai’I case, a D.C case or maybe the NJ case, we don’t know, but we must fight and be in it, to win it. We, the Plaintiffs in this NJ case cannot gamble with politics, with time or with past lost cases, we must press on. We must fight. This challenge is different from the Drake case, it challenges the face of JN, the burden imposed on us meeting it and other challenges. Read the complaint attached, as the details are there.   8. Just learned that I will be going to Dallas-Fort Worth area of Texas next week for 10 days for work. I plan to get my Texas License to Carry while there (formerly known as a CHL). I have today submitted my non-resident application online at the Texas Dept of Safety website and am in the process of scheduling an appointment with Identogo/MorphoTrust(in Texas). My question is has anyone here done this in the DFW area and have any recommendations for a training facility. I did find several thru a Google search but wanted to check here for any recommendations. Once I complete this process I will post a full write-up. Thanks

  10. In light of the poor ruling against the 2nd Amendment today by the 9th Circuit court, the Almeida / Tumminelli v. NJ case moves forward and will be filed at the Federal Courts in Newark on Friday, June 10th 2016 by the law firms hired to move the case forward. The 3 law firms involved are out of Pennsylvania, Mississippi and California. The details of the complaint, law firms involved and updates will all be made public for your viewing after the approval on the release of such is obtained by the lead attorney. This case is being funded 100% by us, the laypeople (we, the people) and their supporters.   11. We are now entering phase 2 of this #2A campaign for NJ permits to carry gun “rights”. My case is scheduled for the 19th of this month to be heard at Sussex Co. Superior Court. Although I have hired the law firm of @Evannappen, I am confident that Richard Gilbert will present a very good argument on my behalf. Of course there is a 50/50 chance of us prevailing, but I am a realist and I place my odds more at 95/5. The low odds are not because of my case and arguments, but because that is just how NJ rolls on this issue. We have 2 other good cases pending on this issue in NJ, one is in NJ, and the other one waiting may be heard by SCOTUS. Even though these two other pending cases are strong, they do not have a police reported, documented death threat like it does for my case. For this is the reason why this case must continue to move forward. We must prove that in NJ, regardless if you have a profession that involves large amounts of cash and you fear of becoming a victim to an armed robber, if you are a good, law abiding citizen in NJ that wants a handgun for everyday defense of your life or a loved one, or if you are a person like me that has a documented credible death and robbery threat against you, in NJ you are not afforded your 2A right to defend yourself with a handgun outside of your home. We must continue litigation against the unjust “Justifiable Need” Admin code in NJ, regardless of how many cases are pending and of the outcome of my case on the 19th, this campaign must continue fighting for us all in NJ and that is my plan. Without your support, this may not be possible to continue moving forward and we will allow NJ’s unjust laws to prevail.   12. I know that this bill is a stretch, but could it be possible that this bill goes through? A800 would remove the "Justifiable Need" and replaces it with an approved Safety Course as well as a Use of Force course. It changes the $20 - 2 year fee with a $100 annually fee. And finally it stiffens the laws for crimes committed with firearms. ITS A TRUE COMMON SENSE BILL...That's why I'm skeptical.   13. A1233 seems like a dream come true for CCW in NJ. Could it get thru the Assembly? Is there a Senate Bill? I can see as a going away present Christie sticking it to the anti-gun crowd, with nothing to lose.

Chris Christie is taking heat from both Democratic lawmakers and Second Amendment rights activists over the Governor's proposed plan to broaden access to concealed carry permits in New Jersey.   15. CT Gov. to sign EO prohibiting gun permits to those on the terror watch/No Fly Lists... Cue the Lawyers! Will be very interesting to see how this plays out. Especially since, I believe, those lists are "names only" and not "individual identities" (i.e. name + soc. sec. + address + phone, etc.)...
  16. Detroit Free Press - Gun Licensing to change in Michigan, Effective December 1st. Apparently, an improvement in the process by eliminating "county boards" that can deny permits or require the applicant to show "justifiable need." One concern: The article states that the Michigan State Police will be conducting the background checks "...to see if applicants are legally disqualified due to their age, criminal history, mental illness or other factors." Age??? Since when has that been a factor? As long as a person has no physical or neurological issues that would hinder the person from operating the gun safely, why should age matter?
  17. R.I. Supreme Court sides with applicant for concealed weapon permit Reading into this article, and other articles regarding this story. It appears that "Shall Issue" in Rhode Island is closer to reality or in fact shall issue depending how you read it. Interesting that Rhode Island has a "good reason" clause for getting the permit. Is that the same as "justifiable need". http://www.providencejournal.com/art...NEWS/150429594 "The Rhode Island Supreme Court ruled Wednesday in favor of a man claiming he was wrongly denied a concealed weapon permit by the former police chief of East Providence, a city that had not given such a license for 10 years." However, read this.... "In October 2012, the police chief sent Gadomski a letter denying the permit based on what the chief deemed a lack of need and because Gadomski had two misdemeanor charges from 20 years earlier. The charges — destruction of property and possession of alcohol by a minor — were both disclosed in the application and ultimately dismissed." The police chief was accused of abusing his position by putting his own discretion on the conceal carry license. But the State Supreme Court ruled in the applicant's favor. While it would seem that "Shall Issue" is now the order of the day in Rhode Island with this ruling. Does it only apply to this particular case only? Or where a city like East Providence has denied issuing carry permits? The article doesn't come right out and say that Shall Issue is the order of the day, although it sounds like it. "Rhode Island law dictates that authorities in any city or town "shall" issue a license or permit to carry a loaded handgun to a person 21 or older "if it appears that the applicant has good reason to fear an injury to his or her person or property or has any other proper reason for carrying a pistol or revolver, and that he or she is a suitable person to be so licensed." So is Rhode Island really "shall issue" now? It does appear that a "good reason and/or proper reason' clause works with shall issue.

Four cases are presently working their way towards (or are are already before) the U.S. Supreme Court, and the National Rifle Association just filed an amicus brief supporting the plaintiffs targeting New Jersey’s “may issue” concealed carry licencing scheme: The National Rifle Association is supporting a Sussex County man’s lawsuit seeking a permit to carry his handgun outside of his house, the organization announced this week. The national lobbying group said it was backing John Drake’s lawsuit with a forthcoming amicus brief, in support of Second-Amendment rights in New Jersey, the organization said. Drake, and other plaintiffs involved in the lawsuit, petitioned last month to have their case heard in the U.S. Supreme Court. “Law-abiding citizens have a constitutional right to defend themselves beyond their front doorstep,” said Chris W. Cox, the executive director of the NRA’s Institute for Legislative Action. Drake, of Fredon, is a business owner who owns and services ATMs – and who carries large amounts of cash, according to a report on NJHerald.com. The suit challenges New Jersey law requiring “justifiable need” to acquire concealed-carry permits, according to the report. To date, the “bearing” argument is still a minority view in the court system (as patently absurd as that is), but one that seems to be gaining ground. It will be interesting to see how this case proceeds, as I’m sure that the New Jersey government will fight this tooth and nail all the way to the U.S. Supreme Court.

  25. I am looking for someone who is in a legal profession, and has gone thru the process themselves, or as an advocate for a client, to help me with the application process. I figure it may increase my chances, however slim, if I was to consult someone with experience. If you have information on what works best please let me know. I know it's almost impossible to get one, so if you do not have anything more than that to add then please do not respond. I need constructive input, and solid advice. Thanks in advance.
