Will You Ever Be Able To Legally Carry A Gun In New Jersey?

I sure hope so, but all these freedom-loving people fleeing NJ is not helping.  We need people here to fight for liberty.  I don't plan to leave this state in the foreseeable future so I will do my part.

We had the best opportunity after defeating Florio and giving Republicans a veto proof majority.  OF course, Republicans screwed gun owners over by sabotaging CCW plans at the time.  And promises to repeal the AW law.  They are the same if not worse today.

Gays got marriage allowed in all 50 states because it was legal in over 26 states.  Gun owners seem to have ignored this 14th Amendment argument for CCW that was held 9-sip by the US Supreme Court.

Sometimes you have to do what you have to do. If you're working in an "unpleasant" area in Rahway and you keep a gun in your tool pail and don't hide that fact, the local denizens keep back. That's just a rumor of course. No one would actually do that, certainly not me.

I lived in a black area of Jersey City and carried my .45 often.  Once I walked down to the corner liquor store to purchase a 6 pack for my dad right before 10 PM.  I had my 1911 in my back.  At the door, the store owner let me in and then locked it saying he was closing.  When I left some black guy outside begged him to sell him some cigarettes so the store owner let him in and locked the door behind him as he did me.

The store owner was murdered, shot dead.  In just a matter of seconds it could have been different and life changing.  I called police to say I had seen the murderer as I left the store.  No one ever showed up to even take a statement.

was that ocean ave?   I live in JC more than 30 years ago. Cops in JC won't even goto some areas

There are 2 very important 14th Amendment issue which I hope have been included.  The first is essentially the gay rights SCOTUS decision which said rights enjoyed by individuals in 26 states could not be denied to the other states.  This is the heart of the gay marriage decision and one we should be making.  The other is that retired cops can legally carry, and have just a rubber stamp process to go through.  They are not any more in need of every other NJ resident but get favorable treatment in violation of 14th.

I have never heard those arguments made.

The difference here is those marriage rights legally didn't exist.  The 2A rights in NJ are only "de facto" banned in that the law allows for it, it's just that in practice it's rare for someone to be granted a license.

How about it is a 2nd Amendment violation the right to keep or own and bear or carry shall not be infringed. That is how the decision should be written with a clarification that the militia part was a statement and has nothing to do with the right. From the questions being asked by the 6 GOP appointed Justices we may get something that broad and game changing.

Nice idea but it will never happen in NJ.  First, NJ has no 2nd Amendment in its constitution.  None.  Republicans have taken gun owner support and screwed them royally at every opportunity.  DiFrancesco, Ray Zane and the critical vote for Clinton's AW ban, Gormley - paid off by Florio for his vote for Florio;s AW ban.  8 years of Christie's promises and nothing.

To the corrupt and Democratically Socialist controlled NJ government, the Constitution doesn't mean shi  t.

It's not a nice idea, it's the constitution that rules our nation. The bill of rights defines fundamental civil rights to all citizens, which supersedes and invalidates state law. The Court decides the interpretation and state abides by the interpretation.

I don't disagree with the sentiment.  But at least we have legal recourse and semblance of the rule of law... At least in theory if not always in practice. And I do believe and still have a little faith that the right ruling from SCOTUS will change things in NJ-but I'm sure the state will find loopholes.  My answer to the original question of this topic is that we can legally carry in NJ, but the state doesn't recognize it (as you say, good luck with that).

I believe we're moving in the right direction, and we're still way better off than most other nations, even in NJ.

It's not perfect, but it's more perfect.

Your 2nd amendment rights are guaranteed by the US Constitution. Different states put different requirements on your ability to get guns and carry guns. There is no need for a 2nd amendment in a state's constitution. For example, you can get a handgun in NYC, but the amount of paperwork and the hoops you have to jump through make it PITA and deter a lot of people. It's even evident in different towns in NJ. I just got my last 2 P2P's in 10 days. My cousin in Wall has to wait 4-6 weeks.

When politicians throw such roadblocks in front of a Constitutional right it denies that right.  The court has held that you cannot license a right, the most notable with the Jehova Witness being forced to acquire permits to speak.  That was struck down.  The courts are the resolve to such criminal intent but when the courts themselves are corrupt - where do you turn?  Hellier defined 2nd Amendment as a personal and not government right - yet it changed nothing here in NJ.  Nothing - even though it should have nullified every one of our f'd up laws.  Yes NYC residents have the same rights as those of Phoenix or Dallas, but in reality - they have none. N Neither do we.

The fact is that NJ Constitution has no 2nd Amendment protection, which has been used over and over in various court pleadings to argue that NJ residents have no right to a firearm, period.

This is in the NJ constitution

 

                                               ARTICLE I
                                    RIGHTS AND PRIVILEGES


   1.   All persons are by nature free and independent, and have certain natural and unalienable rights, among which are those of enjoying and defending life and liberty, of acquiring, possessing, and protecting property, and of pursuing and obtaining safety and happiness. 

 

How do they expect us to defend and protect it, if not with a weapon?

All the states can do is make it harder to get guns or make changes to the types of guns we can get. Pinned stocks, 10 round mags, etc. 

Get everything you want now, cause Bucky Beaver is in for his final term and you know he's gonna come after all the JACK supporters

Bucky and his pos AG are going to get their asses handed to them in court after Scotus defines which test to use for constitutional rights and sends the mag capacity and carry cases back down to the lower courts. Just my humble opinion.

Just remember - Every single gun owner should absolutely vow to NEVER convict another gun owner of any paperwork induced crime.  He had a fukll auto UZI - Not Guilty.  Belt fed 50 cal, Not Guilty.  40 round AR clip - Not Guilty.  All government prosecutions at this point should be viewed as corrupt and unjust - takes just 1 juror to not convict.

Just Vote No.

The prosecutors will probably dismiss any gun owners from those cases. More people need to own guns.

If this country keeps going the way it is, more will.
