Federal Court Rules CDC’s COVID-19 Eviction Moratorium Is Unlawful

Maxine Waters tells the CDC to ignore the SCOTUS... still think there's the Rule of Law in this country?

I don't buy that the CDC can't extend the eviction moratorium - something it has already done in the past!
 
Who is going to stop them? Who is going to penalize them? There is no official ruling saying that they cannot extend this moratorium.
 
C'mon CDC - have a heart! Just do it!

Weighing in on the CDC's moratorium extension is constitutional scholar Jonathan Turley, who says "President Biden took an oath to uphold the Constitution, not to violate it when he can use the delay in any final order to get the money out the door."

...What was astonishing is that Biden acknowledged that it is still likely unconstitutional but that they could tie it up in courts to get the money out in the interim... In so doing, he is admitting that he would be spending federal money without constitutional authority.
 
Biden admitted that "the bulk" of the constitutional experts consulted said that extending the moratorium would be unconstitutional. Yet, he indicated that he would still like to pursue it due to a couple of scholars encouraging him.
 
Given the ideological makeup of law school faculties, it is chilling that most of the preferred advisers to the Biden Administration admitted that this would be likely unconstitutional. It is equally unsurprising that there are a couple dismissing such constitutional concerns.
Top comment; "If the CDC ignores the ruling coming from the SCOTUS then why would any property owner feel obligated to obey the CDC?"

I still don't get where it's legal for Murphy to get in between a contract between a landlord and tenant. And, in true form, he discriminates... saying the Walmart worker gets protection during job loss, but the upper manager doesn't.'

New Jersey’s eviction moratorium will end early for families above a certain income threshold under a sweeping bill Gov. Phil Murphy signed into law Wednesday that will also provide $750 million in aid for residents who have struggled to keep up with rent and utility bills during the coronavirus pandemic.

Under the moratorium, landlords have been unable to evict or lock out tenants, though more than 60,000 cases were been filed with the courts between April 2020 and April 2021.

Under the first of two laws Murphy signed, renters making less than 80% of the area’s median income will be shielded from eviction through Dec. 31. Those with income above 80% of the median will see the moratorium come to an end on Aug. 31.

i'm ot talking about just now. i mean at all. not a single one of these alphabet agencies has the constitutional right to make any law. for anything. and yet we've been seeing it for the better part of 30 years.....

Well, check me on this. Here's how it works:

1. Congress (the supreme legislative body) creates an 'alphabet' agency and cedes their control to them.

2. The agencies start doing shit.

3. Congress complains and says they have 'oversight', but never get around to it.

4. Agencies do what they want to do. (Thank you Pelosi et al.)

5. Congress complains again. But they don't have any guns. And the LE agencies are in on the whole deal.

6. Agencies do what they want to do.

7. President admits they're doing illegal shit, but who's going to stop them?

8. Supreme Court rules. But they have no guns either. And the LE agencies are in on the whole deal.

9. Agencies do what they want to do.

10. Rinse and repeat.

The 'Administrative State' is now the greatest threat to our freedom. And who's gonna stop them?

It will have to be somebody with guns.

 of those renters/homeowners that are behind, and face eviction or foreclosure, how many of those have had the income(even if it was unemployment with the enhancement) to pay their bills, but chose not to? it should be easy to find, as they've all got tax records, they've all most likely got credit/debit cards. easy to see if their spending habits changed any. i'll bet they did. i'd bet that at a bare minimum one half of those "at risk" "gamed the game" and could've payed but used this govt created mess to not pay.

None of that matters.  Who is going to hire the lawyers , investigators and forensic accounts to "prove" what people were doing.  The landlords who havent' been paid in over a year?  They dont' have the money or the time to waste.  The banks that weren't being paid by the landlords?  They just tacked the unpaid mortgage payments on the back of the mortage.  The owners / renters were ony doing what they were being allowed to do.  The government was paying people to stay home and telling them they didn't have to pay their mortgages / rent if they were in any way, shape or form effected by Covid.  If they had anxiety that they might be laid of due to do Covid then that was enough justification to them to stop paying.  NONE to very few of those people saved that money.

What matters is the the governement tried to "help" (or at least alleged that's what they were doing) and created another HUGE looming problem.  Eventually it will be time to pay the piper.  Some are saying when it finally hits it will make 2008 look like a picnic.

D.C. Judge Rules Biden's Eviction Moratorium Can Remain In Place, Makes Clear She Thinks It's Illegal

A federal judge in Washington, D.C., on Friday rejected a request from a group of landlords to block the Biden administration’s renewed eviction moratorium, appearing to overrule The Supreme Court's ruling that the moratorium is unconstitutional.

As The Hill reports, the ruling by U.S. District Judge Dabney Friedrich, a Trump appointee, leaves intact the Centers for Disease Control and Prevention’s (CDC) new freeze on evictions, which is set to run until early October.

Judge Friedrich said that she does not have the authority to halt the eviction ban, and any stop to the moratorium must come from a higher court.

In other words, she punted it up the chain of command...

Anyone know where Kavanaugh disappeared to?? Or, is this just ANOTHER SCOTUS punt? Did Biden give him a three month paid vacation to Europe?

...."Kavanaugh’s opinion wasn’t law. It was politics.

Had Kavanaugh done what a judge ought to do, the moratorium saga would have ended in June. Instead, he put us through another partisan fight, forced those harmed by the moratorium to go to court again, and ensured that the Supreme Court will face the same issue a second time.

Will Kavanaugh own up to his mistake or will he say that because the new moratorium is set to expire in October, he’ll permit just a little more lawlessness?

Well... it's time to pay the piper. It must have been nice for these people, they didn't have to pay their rent or college loans for over a year and a half. Gave them lots of spare cash for DoorDash.

What happens next week?

......"New Jersey's moratorium on evictions is scheduled to lift Saturday after the state prevented most families from being displaced for the past year and nine months with some of the strongest protections in the country as a public health measure to contain the spread of COVID-19. 

Landlords will be able to evict low-income tenants who miss or are late with January's rent, though it's unclear how long the court process will take — judges face a backlog of close to 52,000 landlord-tenant cases as of the end of November.
