NJ Homeowner charged after fatally shooting armed robber

The charges were not related to the shooting itself. Yet.

Dillard is charged with possession of a firearm while engaged in drug activity, receiving stolen property, tampering with physical evidence and drug-related offenses, police said.

Even though it is legal in NJ,  You cant have weed and guns because it is still illegal federally....which is about to change as the government has started the process to remove weed from the controlled substances list.  When that happens there wont be jack shit they can do in NJ if you have some weed and a legal gun...as both will be legal.  Until that time happens,  off to jail you go.  And you lose your firearms rights for life.

They will be out to get any gun owner anyway. In this case the charge would be possession of a firearm while in possession of weed with the intent to distribute without a license

Yes.  I assume that was the reason for US marshalls' involvement, to charge him federally.  Legalization has tied law enforcement's hands except under certain circumstances, one of which i believe is a significantly large amount of marijuana.

It appears in this particular case the homeowner was not the good guy, but rather a low level drug dealer who happened to own a gun. We don't know if the gun was legally owned or not. We do know the charges though: Dillard is charged with possession of a firearm while engaged in drug activity, receiving stolen property, tampering with physical evidence and drug-related offenses, police said. 

Even if he didn't have marijuana, he still may have been charged on "receiving stolen property" etc..

There have been cases in NJ though where the gun owner was not charged, i think the drugs and the other charges played a role here.
