Supreme Court sends concealed carry reciprocity case back to lower court for reconsideration

Recommended Posts

This could be big:

21-1160 MORIN, ALFRED V. LYVER, WILLIAM, ET AL.
The petition for a writ of certiorari is granted. The
judgment is vacated, and the case is remanded to the United
States Court of Appeals for the First Circuit for further
consideration in light of New York State Rifle & Pistol Assn.,
Inc. v. Bruen, 597 U. S. ___ (2022)

This was a case where a concealed carry permit holder in MA was arrested in DC for carrying (dude went to a museum and tried to 'check' his gun with police when he saw a no gun sign).

Could have impacts for National Reciprocity

"The case in question, Morin v. Lyver, centers around a controversial Massachusetts law that imposes strict restrictions on the possession and purchase of handguns, including the need for a license in order to purchase or posses a pistol. The law also includes a lifetime ban on purchasing handguns on anyone convicted of a nonviolent misdemeanor involving the possession or use of guns."

I think it's the right case, but the interpretation I heard (and used) may be incorrect.  That's why I always admit to not being a lawyer.

It seems that the Supreme Court is kicking the case back not because of the charges for carrying in DC, but for MA refusing to renew the guy's carry permit after pleading guilty to gun misdemeanors in DC.

ok,  they sent it back down to a lower court.   can a injunction be put in place util the lower courts begin the glacial pace of it working it back up,   what time frame are we looking at.     next,  whats to stop MA from classifying ANY firearm related incident as a felony to get away with this or any other state for that matter.

The fight needs to be about loosing your rights period any rights in my opinion.    unless you committed a violent criminal act and were convicted than rights should not even be mentioned.

I don't think this is a carry case. Part of the case does seem to include a "permit to purchase a pistol".

In MA you need a carry permit to purchase a pistol. Pre Bruen it used to come with restrictions for target and hunting. Just like NY.
