Out of State Rifle Purchase - Am I Missing Something Here?

Hey guys. I had a bit of an issue today at a Dick's store in Northern Virginia. I was in the middle of buying a Ruger 10/22 rifle...filled out all the paperwork, presented my FID card, did the CoE, and passed the background check. At the end of the infamous Dick's "walk of shame" to the cashier kiosk, a manager informed me they were not allowed to sell guns to residents of NJ. The manager stated ATF could "take away their license" if they sold a rifle to a NJ resident.

 

I promptly called Dick's in Deptford to see if that was merely a store policy or if NJ residents truly could not buy long guns in VA. The manager said I should have been able to buy it, but I didn't go back and make an issue out of it. I also called a Wal-Mart I am familiar with in VA, and the manager in the sporting goods department assured me that they were allowed to sell long guns to NJ residents.

 

Anyone have any idea what the deal is here? I've always been told that as long as you have your FID and you fill out the CoE, you should be good to go out of state when it comes to long guns - I've read that here on the forums countless times. In fact, I know quite a few NJ residents who have had no problems buying long guns in other states, as I'm sure many of you have bought guns out of state, including VA. Is this merely a case of people not knowing the law, or is it really illegal for us to buy long guns in VA?

You are 100%, the manager is a shmuck. You should have had him call headquarters while you were there and scolded him for wasting your time while you were there if they were closed.

 

I am looking for a CX4 and new shotgun and was going to check out a big place by my brother out of state. Its perfectly legal.

The same thing happened to me at Dick's in the Scranton, PA store 2 years ago. They had a great price on an 870 and I pulled out my FID card and was told we don't sell to Jersey residents. I was told it was Dick's corporate policy.

Thanks for the replies guys. :) I figured it was either a misguided group of Dick's employees or some sort of weird Dick's store policy, although it looks like before 2004, it was illegal for residents of states that did not border VA to purchase long guns in VA. This law was repealed by HB 1302 and the stroke of the Governor Warner's pen (http://www.nraila.org/Legislation/Read.aspx?id=1068). What's funny about that though is, the manager didn't even cite anything about residents of non-contiguous states not being allowed to buy guns in VA - he started spouting off about the ATF taking away their license if they sell to residents of states like New Jersey, California, New York, etc. (It truly made no sense, but at the moment, it made me worry that a friend of mine's VA long gun purchase was illegal!) If the manager was right, you'd think it would have been automatically denied when they ran my background check...then again, you'd think they would have told me I couldn't buy it the moment I pulled out a NJ driver's license! :roll:

I would have demanded that the federal form be ripped up/shredded in front of me if I was not actually going to be allowed to purchase the gun. You do not want that gun in your name if you don't have it.

 

I thought of the same thing - In fact, I asked the VA State Police about this whole situation via email, including what happens to the paperwork I filled out. Here's what they had to say:

 

"You are correct that Virginia law does not prohibit the purchase or possession of a long gun by any resident of any other state. However, the Federal Gun Control Act allows the firearms dealer to sell or transfer rifles or shotguns to residents of other states if in compliance with the laws of their customer

I would have demanded that the federal form be ripped up/shredded in front of me if I was not actually going to be allowed to purchase the gun. You do not want that gun in your name if you don't have it.

Uh oh...did the Woodbridge Dick's give you trouble?

 

Manager and Employee where adding "extra" guns to customers 4473 forms after they left, then sneaking them out the back door in trolling motor boxes. They were then sold to a local sporting good store for resale. The sporting goods store no longer has their FFL.

I was told by Dick's in DE they cannot sell me a gun because i was not an American citizen and people like me make trouble for gun owners!!!

I showed him my NJ firearms card, ID ,Greencard ect ect,he told me they all could be fake,i left the store and returned home and got on the net looking for dick's head offices.

I called dick's and stated my case and treatment at the store and what was there policy for selling long guns to NJ NON CITZENS, no policy,no problem and no restrictions .They could not apologize enough,the store manager then called and told me to come back to the DE store and he would discount me 30% off anything.The jerk at the gun counter was given the boot for the treatment of myself..........i don't shop at dick's anymore.

:o Coldsolderjoint, I had no idea that crazy stuff happened at the Dick's in Woodbridge...and I can't believe they treated you like that, Urban Grunt!!! How awful! Well, any respect I had left for Dick's has certainly gone straight down the tubes after hearing these stories.

Well the incident in Woodbridge was really the employee and the manager robbing the store, so Dick's was the victim, but they should have had better safeguards in place.

 

I've bought a gun from them, and their artificially inflated lengthy process is pretty annoying. Pack a lunch and lots of patience.

Yeah, I guess they were kinda the victim there...I still can't believe that happened though!

 

I've gotta say - I'm SO thankful for this forum. Finding information such as this (out of state purchasing info, etc.) is so hard to come by - even on the NJSP website. I did so much research before I went down to VA regarding all of this, so I was completely baffled by the Dick's experience.

Everytime I go to Dicks in East Hanover, the Dick behind the counter in the lodge is a real dick. So I go in acting like a dick...

Its actually pretty fun to tell them the law, and one time the guy told me nics was down, and I asked him "why dont you just call and see" he was off the phone with Nics in 3 mins...out the door in 5 mins, with walk of shame, but alot of dicks rewards points for me as well...my last case of shotgun ammo was 31$ for a flat of gun club 12ga...cant beat them for the prices, go to the store in Rockaway, they like guns at that store and would love to sell you one....

Yeah, you know, I'd just rather patronize the local shops from now on. I honestly didn't even know there were towns called East Hanover and Rockaway in New Jersey, haha! Then again, I guess some of you folks in Northern NJ wouldn't know of towns near me such as Ewan and Ferrell. ;)

 

Also, I edited my last post for spelling and ended up getting rid of a whole paragraph somehow, haha! I basically said aside from the bad experience at Dick's, I did have a good experience during my trip to VA to visit family/friends at the gun show in Roanoke. So, all is well - the next time someone has a question about buying long guns in VA, this thread will be there for 'em. :) In fact, here are a few good sites I've found pertaining to VA firearms laws:

About a year ago the guy in the Lodge in the East Hanover store escorted me to the register and then out the door when I purchased two boxes of handgun ammo. I kept trying to explain to him it was unnecesary for him to do that but he insisted. Made me feel kind of weird and dirty :lol: I still buy ammo there, but that guy isn't there anymore.

If I'm not mistaken, the FFL keeps it on file in case the BATF wants to look on it. I could be wrong about that.

Let me put this post this way..

 

Someone Who Isn't Me (cough cough, henceforth known as SWIM) has purchased maybe 4 LG's from Dick's in the past 3 mo's ... 2 in NJ and 2 across the river in PA...

 

SWIM got a Remington 597 .22LR in NJ right after getting card/permit... SWIM read lots of info on Mossberg 930SPX and was told how awesome it was , read MANY rave reviews online, etc... while looking for a Magazine for the Remington 597 in the Dick's in PA (SWIM was hoping to score a 30 rd mag or two... bad SWIM bad SWIM!!!) SWIM notices PA Dick's has 10-20X firearm selection than NJ Dick's.. asks employees..."Hey if SWIM sees something can you ship it to the NJ Dick's for purchase?" No..they say, but you can buy it here! Wow oh okay... a few minutes of looking and I am informed by the coolest guy ever, they have something pretty cool tucked away, a 930 SPX, heard of it?? 5 minutes later SWIM was filling out paperwork...

 

SWIM was later informed the magazine holds too many shots and Dick's should not have sold it and they should have realized that... And never allowed it to be done. SWIM has since corrected the problem by removing said magazine ext. and problem solved.

 

SWIM also fell in love with a Remington R-15 , and after finishing paperwork, passing check, doing everything, 1 mgr okay, was stopped by a SECOND MGR at the register as SWIM was about to swipe debit card, Nonono, can't sell that to SWIM, no "Evil Black Rifles" sold to NJ ppl... Sorry, SWIM was refunded Nics check $ and given $25 gift card for spending the time going through everything to be "foiled".. SWIM has been told by several people that Remington R-15 is perfectly fine/legal in NJ... 5 round magazine, fixed stock, no flash supressor or bayonett lug, doesn't say AR-15... not 100% sure but...

 

SWIM is pretty sure Dick's sold SWIM something they shouldn't have (in fact encouraged it a little, "Here check out my SECRET STASH etc..." ) and DIDN'T sell something they could/should have.

 

Oh those crazy Dick's peoplez.

Just bought a rifle from Cabela`s in PA , I m not a citizen.They were very informed,asked for my drivers license,alien nr , greencard and any utility bills for the last 90 days , made a copy no problems. I`ve also purchased from Utah with no problems , same routine.

The form (ATF Form 4473) is kept in the FFL's records. If the dealer ever goes out of business and such, the form is turned over to the ATF who then stores the records in their central storage. They have access to their forms there also, but are prohibited by the 1986 FOPA from compiling the information into any sort of database that can link guns to their owners. Try and make sense of that last statement. I dare you :)

I am much much happyier to be here. And the way I see it, when I encounter dooshbags here, we're all from Jersey, I have no problem letting a fellow Jersey person know, "Hey, you're a dooshdaddy!"

It's legal if it doesn't have too many evil features. I'm pretty sure most of them are set up as hunting rifles, so probably yes. Post a pic of the actual rifle and we can tell you for sure.
