2c:39-4 Possession of weapons for unlawful purposes.

e. Imitation firearms. Any person who has in his possession an imitation firearm under circumstances that would lead an observer to reasonably believe that it is possessed for an unlawful purpose is guilty of a crime of the fourth degree.

 

(3) Any person who knowingly has in his possession any imitation firearm in or upon any part of the buildings or grounds of any school, college, university or other educational institution, without the written authorization of the governing officer of the institution, or while on any school bus is a disorderly person, irrespective of whether he possesses a valid permit to carry a firearm or a valid firearms purchaser identification card.

 

I know, the problem is, it's catch 22. An "observer" can say "i saw someone with some sort of blue gun on his hip." Then the officer will ask "Do you have a carry permit?" your answer would be "no, because it's a fake gun." However, at the same time you're also unlawfully in possession of a firearm because you're breaking the law by not having a carry permit for the alleged blue gun according to the "observer".

if arrested, that would be your arguing point. having a blatantly obvious fake gun, ie: solid blue, should be enough of an identification that its is NOT real, or to be used unlawfully. which is why every toy gun, even realistic looking ones, are always weird colors.

yes, but remember they sell real colored guns too. So it really depends on the observer. someone here posted a picture of 2 glocks asking "Which one is real?"

They “sell” colored guns?

 

Several people I know refinish them at their homes with gun coat or whatever. Not to mention the ones that are sent out for work. Some of the amateur work is pretty damn impressive. Cammo with leafs, or skulls and death scenes. And then there's always a pink gun thing (for young girls) or a blue/red gun for a joke.

They “sell” colored guns?

i have seen a few on gunbroker and Buds. usually pink or raspberry. i guess they cater to the female shooters. I also saw a blue one with a stainless slide, but i guess that's customized.

Thank you. It seems that there is no end to the inventory of insane gun laws.

 

Although I wouldn't want to be the test case, it would be interesting to see the outcome of a case challenging this law on First Amendment grounds if the fake gun was worn as a protest.

Umm... My point was, people change the "colors" of their guns routinely. You don't have to buy a gun in the color or pattern you want to get one in the color or pattern you want.

 

Oh yeah, I just remembered the brand, most of my friends use "dura coat" or something like that. They've done some pretty amazing stuff with it, and it does seem "dura"ble.

 

Of course, you can get any type of finish/coating you want, inside and out, for very little change.

Someone posted that a big protest happened in Trenton regarding the NJ '90 AWB, it was said that the press ignore the huge amount of people, focused on a sprinkle of grabbers, and low balled the attendance in the papers.

If there is going to be a protest by us (gun owners in NJ), this is the year to do it, preferably before the primaries. This is an election year and everyone is up for re-election.

 

Gun owners in New Hampshire (it started with the Free State Project) started doing open carry litter cleanup--they walked around various towns, open carry, cleaning up litter to attract positive attention to their cause. (you can check youtube for "open carry litter cleanups"--I don't have any links handy). This movement caught on in other states, and other groups started doing it.

 

Now, we can't do any carrying, but we could do an empty holster cleanup (or leave the holsters out together and just wear t-shirts or some other kind of mark identifying our cause). We can make our own videos of it, so the media can't downplay it or otherwise ignore it. We could clean up litter around Trenton. Our message "We, the gun owners of NJ are cleaning up the outside of Trenton. Now, we are asking the voters of NJ, to clean up the inside."

 

In all seriousness, who would want to do this?

CT just had a good turnout at the hearing, I think, for their state's 10round mag limit from the pro-2A side. I read it earlier in the week.

It seems AWB type legislation was introduced in statehouses all over the place after the Giffords shooting. Whether these will get anyplace is dependent on the state.

Illegal to have a solid plastic gun thats blue!!! This state realy is messed up.

I don't know if you ever saw demolition man but thats what it's looking like.

 

Demolition Man is loosely based off the book Brave New World. It's written by Aldous Huxley. They even use that name in the movie.

If there is going to be a protest by us (gun owners in NJ), this is the year to do it, preferably before the primaries. This is an election year and everyone is up for re-election.

I, too agree that this is a fantastic idea. I would be in as well, and would be happy to help organize it.
