Legality of receiving a complete lower with collapsible stock

Is there a legal issue if you purchase a complete lower receiver with a collapsible stock and have it shipped to an FFL and take ownership of it.. i would think it is legal as long as it is not put with any other "evil Feature" on the final build.

 

Just looking as most complete lowers only come with the collapsible stocks.

It's legal if you dont have an upper to pair with it (constructive progress) however im not exactly sure the ffl's stance on the matter of transferring a complete lower without the pinned stock. I know I had my lower completed for months before i chose an upper and pinned the stock

Isn't a pistol grip an evil feature too? Seems like the fact that both of those are on a complete lower receiver would make the firearm illegal in NJ.

 

However, I have not clue if just the lower receiver is considered a firearm before it is physically attached to the upper.

This would be the smart way to do this. A prosecutor could argue the lower itself being the serial numbered item is the firearm. The stock and pistol grip are evil features. Is there a prosecutor with so much time on his or her hands. I wouldn't think so but I also wouldn't want to risk finding out.

Does the same go for an upper with an evil feature like a flash hider? Can I get an upper with a non-pinned flash hider installed delivered to me? Then when I get it I take it to a smith to get the hider removed and a brake installed and pinned/welded.

Technically, the evil feature list applies once it is a complete rifle, or you have all the parts to make a complete rifle in the same vicinity/building.

 

If you want to have a complete upper sent to you with a unpinned flash hider, you can do that , but be sure you don't have the rest of the parts to build a complete rifle nearby/vicinity/building, etc.

 

I have my uppers sent to a relative's house a few blocks away. I then take it to the smith to have my choice of brake pinned on, then bring it home to marry with the rest of the parts to make it a rifle.

 

This is the madness we deal with.

To my understanding the gun must be shipped to a licensed gunsmith who prepares the COMPLETE firearm to be compliant BEFORE the transfer.

 

This is just a lower and not a complete firearm. Hence, no problemo. I did the same thing 2 years ago. My LMT lower came with a collapsible buttstock. I asked the guy who was selling it to just leave the buttstock separate of the lower in the box. Problem solved. Then when I got it I pinned it myself.

      I'm selling my (like new) AR mid length complete upper receiver chambered in 300BLKOUT 7.62 × 35mm manufactured by Special Ops Tactical.  Only put approximately 100 rounds through it. For those of you who don't know, this basically will fit on most AR lowers and uses the same AR magazines but gives you a .30 caliber (7.62 x 35) by just swapping the upper receiver if you are looking for a heavier load and more knock down power for hunting etc. (obviously state laws apply). I'm only selling it because I ended up buying a complete .30 caliber rifle.
