Buy/Use handgun at Shop/Range while waiting for permit?

Has anyone ever considered and been denied or successfully purchased from a Shop/Range and they've stored and allowed you to use your gun (obviously there only) while waiting for purchase permit to come in?

 

Upside for buyer:

Practice with the gun they will be taking home once permit clears.

 

Upside for shop:

Gun sale, nearly guaranteed range fees, higher probability to retain customer.

 

Potential risk for the shop would be the customer is denied the permit, leaving them with a used gun. This could be prevented by the buyer & shop entering into a contract in advance stating something along the lines of buyer pays in full in advance of using gun, if buyer is denied permit the shop sells the gun as used and buyer is refunded the sale price minus any storage/transfer/consignment fees. On the flip side, the buyer is trusting the shop to not use the gun they have purchased as a demo/rental unit. 

 

Shore Shot has a section on their website about buyers leaving a gun there while waiting for the permit and then never coming back so they will no longer offer to store guns. It amazes me that anyone would shell out several hundred dollars and never come back, but that's what it sounds like happened. SS in response is declaring them abandoned property and offering for resale. While I imagine this increases time and paperwork, it also brings in more cash flow, so in the end a positive for the shop. I'm assuming that they feel the cash flow is not high enough to justify the extra paperwork??

 

Yes, I know best is to call around shops and ask; but if someone out there has already done this, that would save me legwork. I'd be willing to travel some for this ability.

Update:

Shore Shot had posted on their facebook page they had my chosen gun in stock. So I call fully ready to go there NOW with credit card in hand. Yes he says they have it in stock. Me: "Can you hold it for me while I wait on my permit to come, providing I pay for it?" Him: "No, sorry, legally I can not." 

 

????

There was no delay while he thought about it or checked with someone else. Immediate response was no.

What gun? Perhaps there is a range in the area that may have it in stock that will in fact do that for you.

Why would it be illegal? You buy the gun and it remains under the control of the FFL until the permit is granted and NICS is done/approved, so if the FFL has a range on-site it's not like your leaving the property with the firearm which would be illegal without a handgun permit.

 

If Shore Shot refuses to allow this ask them if NJ or Federal law makes mention of this being illegal, if they cannot provide an answer I would write them off and try another dealer/range and see what they say.

bob's little sport shop in glassboro held mine for me. sorta. i put it on lay away. paid on it every couple weeks.

Funny, I was at Shore Shot yesterday and held that M&P 9....very nice gun!  But i was more interested in the Ruger P95 they had.  The second i told him i wasnt allowed to buy anything until June 13th due to OGAM he IMMEDIATELY said "oh you can buy it now and we'll hold it in the safe until then"  Maybe its a different policy since I already have my permits?

 

The sad part about this story is that my wife wants me to sell my M&P40 before I buy something else....:(  I DONT WANNA!!!!!

I think some FFL's have been stuck sitting on guns purchased by someone, then they fail to obtain permits. I know of one situation where a guy bought at least 3 guns, put in for FID and permits, was then denied. Appealed. And denied. Those guns are still kicking around. It has been about 10 years and they are on their third FFL.

 

I got the back story when I saw the same Dan Wesson set with multiple barrels for sale, but marked sold forever in the case.

They would not allow me to in april. I paid in full up front and asked outright and was told "No, we don't allow that until NICS comes back"

 

I asked them about that too and they said that they used to allow it when NICS waits were up to a few days, but now that its two weeks, if too complicated for them to keep track of where your gun is exactly for each of those 14-18 days.  In other words, they store the guns in the order that they sold them and they dont want to risk losing one or having to take extra time searching for it if its been moved and used during the wait period.

 

Considering how many guns they are selling on a daily basis, they must be up to their eyeballs in sold merchandise that is waiting for NICS.

Interesting.   

I guess it's each dealer's prerogative to decide how much aggravation they are willing to deal with, but being able to 'keep track of where your gun is exactly' should be something an FFL holder is pretty good at.

It probably also depends on the FFL and if they know you or not. I had gone into RTSP with my wife and rented some 22's one night just to try out handguns since all of my experience growing up was with long guns. We had a great night and had already put in for permits and struck up some conversations while waiting for our radge time with some of the employee's. A few weeks later my permits had come in (my wife applied about 2 weeks after me) and I had stopped into RTSP and saw they had gotten in a few SR-22's that my wife really enjoyed. So I spoke to them and they no problems with her buying the gun even though her permits were not in yet. I did mention she already had her FID and that my permits were already in and hers should only be about a week behind at that point. So they let us buy the gun and we used it on their range later in the week. They were very accomidating there, However who knows if you get the same treatment if you are just calling on the phone or going into a store and talking to someone whom you had already done business with.

I was able to shoot my firearms while waiting for the NICS.

    • In 50 years of living in NJ I've never experienced any attempt to inspect the interior of the home, and only one definite inspection of the exterior for an announced reassessment of all properties and that was a drive by. About 9 years of that was living in an apartment, but still, uncommon. Every place I lived had either a finished attic, basement, or both. But they were also included in the habitable square footage on the taxes when we got there.
