Hollow point arrest in Logan township

Doesn't say what else we did to get arrested for hollow points. Kind of curious.

 

Btw the mayor of this town is is Bloomberg's gang of mayors and he was looked at to be buono's running mate.

Maybe it was just one round rolling around the back of his car or truck.

 

If it had been a whole "brick" of .22 HPs, he might have been charged with 500-1000 felonies.

 

 

If he had a whole brick of .22 I'm sure the cop would have settled for a trade :)

It was a traffic stop, he was in violation of traffic laws say speeding or something stupid, he can be charged with having hollow point bullets because he was unlawful. 

 

I have mentioned this before in other threads just plain sucks on how they can charge you for hollow point ammunition.

So being pulled over for speeding on way to range can make you a felon in this state?

I'm willing to bet he was in possession of hollow point ammunition outside the listed exemptions in NJ law. Crazy, I know.

 

 

You are only allowed to possess hollowpoints in NJ under certain exceptions to the law. When people go around talking about "transport" laws they make people think they can have guns or hollowpoints but just have to be careful about how they put them in their car. Nothing could be further from the truth. You are not allowed to have them in the first place, unless you meet an exception.

Ok so hollow points are not allowed in NJ? Forgive my ignorance but its only been a year since ive been here.. What about jacketed hollow points? Cabelas sells the Winchester JHPs and when you look at them they dont have the typical hollow point look (as its jacketed). So whats everyone use for defensive rounds?

All hollow nosed bullets are legal in NJ ONLY under exemptions - home, place of target practice, place of business, or gunsmith. In fact you CANNOT move them to another home you own/lease, as we found out in The Aitken case. Yes jacketed hollow points are hollow nosed bullets. Yes the prohibition is on bullets not cartridges, so an inert cartridge like a keychain can get you arrested.

 

The alternative is to use a hollow nose bullet with a polymer tip like powrball or critical duty. These are ok under nj law.

OP link is very ambiguous - what else was he doing? Did he have a FID? Was the amo not locked up in car or trunk?...HP is legal as long as you follow the rules.

Provided certain conditions are met, a sportsman may transport and use hollow point ammunition. There are no restrictions preventing a sportsman from keeping such ammunition at his home.

N.J.S.A 2C:39-3f(1) limits the possession of hollow nose ammunition. However, there is a general exception that allows for the purchase of this ammunition but restricts the possession of it to specified locations. This exception provides that:

(2) Nothing is sub section f (1) shall be construed to prevent a person from keeping such ammunition at his dwelling, premises or other land owned or possessed by him, or from carrying such ammunition from the place of purchase to said dwelling or land . . . [
N.J.S.A
26:39-3g (2)].

Thus a person may purchase this ammunition and keep it within the confines of his property. Sub section f (1) further exempts from the prohibited possession of hollow nose ammunition "persons engaged in activities pursuant to
N.J.S.A
2C:39-6f. . . ."

26:39-3f. (1).

Activities contained in N.J.S.A 26:39-6f. can be broken down as follows:

1.A member of a rifle or pistol club organized under rules of the National Board for the Promotion of Rifle Practice and which filed its charter with the State Police;

2.A person engaged in hunting or target practice with a firearm legal for hunting in this State;

3.A person going directly to a target range, and;

4.A person going directly to an authorized place for "practice, match, target, trap or skeet shooting exhibitions."

this is not true.. 

hollow point ammo is NOT an add on charge... it is a charge if the person is not operating within the exemptions..

You are misinforming people on this thread.

 

Plugging a hollow point with plastic does not make it a full metal jacket.

 

 

 

Nobody even suggested that it made it a full metal jacket. What are you talking about?

    • In 50 years of living in NJ I've never experienced any attempt to inspect the interior of the home, and only one definite inspection of the exterior for an announced reassessment of all properties and that was a drive by. About 9 years of that was living in an apartment, but still, uncommon. Every place I lived had either a finished attic, basement, or both.
