NJ2AS CARRY LICENSE APPLICATION SUBMISSION PROJECT (CLASP)

Has any progress been made on this?  Where does the project stand?

It has now been six months since I finished the submission.  Local PD tells me it was forwarded to Superior Court and I have heard nothing.  When I get back to PRNJ I will need to figure out how to follow it up.

 

I am in Peru at the moment and have found that the laws are not as strict as PRNJ.  If I make application and pass the live fire and psych exam, I will be able to carry here.

Isn't it more accurate to say that they were unable to secure enough people with the balls to follow through? That's how I remember it.

By "enough people with the balls" you mean our "leadership", then you would be correct.

I was willing to do it, but it didn't seem like NJ2AS or anyone else planned on actually doing anything with all the denials. I'm not really concerned with the denial if the plan actually gains some momentum, but I'm not looking to waste a bunch of time & money either and that's what it seems like it it will be if one of the big gun rights organizations doesn't push it.

I contacted the AG's office and received a phoen call from  a lieutenant at the Firearms ID Bureau of the NJSP when CLASP started.  He assured me that a denial of a carry permit was not cause to deny FID or P2P applications later - as long as the denial wasn't for something that would cause a denial of the other two.   I printed out my application and was ready to go but like several others, I wanted to know the plan.   There really wasn't one.

 

I'm not trashing the organizers of the CLASP project but I do think the members demanded that something be done about ccw, there was a lot of chatter (I mean ALOT! - probably thousands of comments) online from members who were saying we need to apply en masse.   So the organization started the project that the members were demanding.  There really wasn't a plan with what to do with the results.

 

I think many more people would get involved if there was a plan but I don't know what the plan could be.   Drake lost in the 3rd circuit. The opinion reads like it was contrived to avoid anything in the real world so this may not have really mattered - but the NJ AG was able to show that they approve 96% of applicants.   If we had applied before the Drake case, they couldn't have said that but I don't know what case we could help now.

 

Plus - the fact that NJ denies permits is clear.  It's right in the administrative code that you must have an “urgent necessity for self-protection, as evidenced by specific threats or previous attacks which demonstrate a special danger to the applicant’s life that cannot be avoided by means other than by issuance of a permit to carry a handgun,” N.J. Admin. Code § 13:54-2.4(d).   So I'm not sure that there is a need for additional proof that NJ doesn't approve permits easily.

Exactly. If we all got denied, it wouldn't mean anything other than us not meeting the requirements set forth by the State. THAT won't change a thing. Proving that they dont approve "x" amount of permits ALSO will not change anything. We need to prove it unconstitutional that those are requirements necessary to engage in our right to self defense.

The idea was to remove the defense they use of "oh we approve 95% of applications".  You're correct in that overall this would have zero impact on the law, it would just remove one potential argument.

I maybe going down this road solo. My boss asked me if I could get a carry permit because of our location and the size of our complex. I told him it would a long drawn out process and would probably incur some legal fees but is possible, provided HE stated my need for security purposes.

Might not be as hard unless you are in Passaic County. They made me wait a year for another hearing before I got mine. You may have a good chance. I forget what town you are in....

wouldn't that be considered carry for ones job? I would think that the armed security license would apply more to what you are saying. Either way if you go for the whole shabang good luck to you

    • In 50 years of living in NJ I've never experienced any attempt to inspect the interior of the home, and only one definite inspection of the exterior for an announced reassessment of all properties and that was a drive by. About 9 years of that was living in an apartment, but still, uncommon. Every place I lived had either a finished attic, basement, or both. But they were also included in the habitable square footage on the taxes when we got there.
