Collecting NJ sales tax

I received my FFL and NJFL. I now need to file so my buisness can collect sales tax. Not sure where I go online to set this up. Step by step instructions would be helpful. I don't want to file under the wrong thing. My business is a LLC.

Call the Divison of Taxation and request a "Sales Tax Certificate of Authority." They'll ask you for an activation date. Then they mail it to you. You have to display it prominently in your primary "brick and mortar" office location.  As an LLC, I have one myself, but I deal solely in :"house calls," so my "prominent location" is my laptop's case. :D

 

You then have the pleasure of filing quarterly sales & use tax reports, but you can do that on-line

you need to fill out a form NJ REG to apply for a sales tax certificate.  You will then be required to collect sales tax on sales and pay that sales tax to the state either monthly or quarterly depending on how much sales tax you collect.

 

All payments must be done electronically and if your records are kept well takes about 10 minutes each quarter once you figure out the form.

 

As a side note:

When setting up your books, keep in mind that you'll need to keep separate categories for taxable sales, non taxable sales, and sales tax collected.  Our first year, we weren't very tax savvy and kept our books in a way that made sense for us.  When printing reports for taxes at the end of the year, nothing worked right since we weren't using the same categories that the tax man uses.  That required a major re-do for a year's worth of records.

It seemed as though he had already done the Bus. Reg. Certificate when the LLC was formed. I had done that as well, but did not file for a Sales Tax Cert. of Authority immediately thereafter. I wasn't sure if I were going to provide services that are/were taxable. I do, now.

My invoicing program takes care of that. I just create product/service items and I can indicate which are taxable and which are not. I then simply produce quarterly invoice reports before I do my on-line filing -

Needless to say the drone on the other end of the phone was shocked that a) I was disputing it and b) could prove they were wrong. Still took them another 7 months to recognize their mistake AFTER I had to snail mail off the proof. (even though it was on their system and they could clearly see it was their mistake.)

Yeah, my invoicing program creates PDFs which are e-mailed to my customers (and I bcc: a copy to myself). I don't send paper to anyone.  So, I have that, plus the database, from which I can generate the reports I need.

I had an LLC for many years before I ever got a TIN (tax ID number.) I only had to get it and start collecting sales tax after a change in tax law. Having an LLC doesn't make it automatic for collecting sales tax or needing a TIN.

You also must go to your county and register your business name with the clerk then you can open a bank account. They ask for that paperwork along with your state and federal tax id #. Don't forget to register with the IRS as well, just call them same as the state. One more small piece of advice coming from a fellow small business owner. Open a second bank account solely for sales tax. When you collect the sales tax for the state as required by law, if your one day late paying it the fine starts at $100. I always take what I collect and deposit it into its own account, that way when the quarter ends I always have the money to pay them. Also even if you don't collect one cent for a quarter you still must file. All lessons I learned the hard way. I actually have a third account I use for credit card transactions only, makes doing the books easier to keep those transactions separate from cash sales.

First... IANAL, so if you have any questions, I strongly urge you to consult a business lawyer to answer them. I can give you a recommendation for one, if you like. PM me.

 

That said, if you follow all the instructions on this web site,  I think a lot of your questions might be answered. 

 

I formed my LLC to gain the "corporate entity protection" it offers... "Limited Liabilty..." :) At the time, it seemed :crazy: to me to risk exposing my personal SSN as part of the corporate entity... So I got a FEIN, and then used that to file the NJ_REG business registration certificate. I had those for almost two years before I decided that I would offer services that would be taxable. I then filed for the Sales Tax Certificate of Authority and got it almost immediately.

They never asked me for that (i.e. reg. with county clerk). Then again, I opened the business checking account at the same bank as my personal account, and they insisted on linking it to my personal account (two separate account numbers, but both linked together). They said they could not open a bank account solely under the corporate identity... that there had to be an individual "human" identify associated with the account... This... thanks do dear ol' Mr. Bin-Laden... :mad:

 

At some point, i probably should close the business account and open it under a different bank, in order to keep the assets totally separate. If/when I move to FL, I would also relocate the business (I am incorporated as a "foreign" LLC there as well), and I'll switch banks at that time.

I tried to initially open my business account with the same bank I did my personal banking with and they gave me the same answer. I went to another bank lol. But both needed proof of a business existence before they would open my account. Tax id form and the registration paperwork from the Morris county clerk's office showing my business name was registered. It was a pain in my rear end for sure. But I didn't argue just did what they wanted like a good sheep in the herd. Hahaa.

He's an LLC, he doesn't need to go to the county clerk's office to register, that's already been done through the state. But as you said earlier, he needs to get a tax ID number from the IRS and then file for a NJ tax ID number.

 

All this can be done online and gotten instantly.

 Could you imagine if NJ made internet sales collect sales tax --  How would they (NJ) collect it?  

 

Do they actually think merchants in other states would File NJ sales tax online like we are forced to --- all for free???

I had to shop around to find a bank that would let me open a business account without the county's business registration but I found one.  It was quicker to spend a few minutes on the phone calling banks than it was to fill out the registration paperwork (in person only) and wait the 3 weeks they said it would take to research to make sure the name didn't already exist.

Cool I only registered once, I didn't become an LLC until about a year after I was already in business. Had a lawyer take care of that for me. That's good he can skip that step. And I agree getting the tax ID federal and state was simple, one phone call to each and done.

Yep you open a business in Jersey, you just became an agent of the state. Collecting money for them for free. And as I said earlier, don't be late with sending their money. It's what I would call "racketeering", similar to how the mafia famously earns income.

They do, where the merchant has any presence within the State (a warehouse, an office, anything that gives the merchant "tax nexus").

 

That was the problem with Amazon.  After several years, they finally got Amazon to build two big warehouses in the Avenel area in NJ.... which gave them instant tax nexus. Amazon now has to collect NJ tax on all items sold to NJ residents from any warehouse. But ONLY items "Sold by Amazon LLC."  There are plenty of items that are "Sold by ABC company and fulfilled by Amazon" for which they do *not* collect tax. Of course, you are responsible for reporting those as "use tax" on your NJ 1040.  :D

I managed to get my temporarily tax certificate online. The 10 digit state iD number that I needed was right on the LLC formation document..Oakridge Firearms was 100% correct in me not needing to file at the county as when I formed the LLC I was automatically registered with the state. I had already set up a business checking acct. without any problems. All the bank needed was my LLC papers and FEIN  number to open the acct. All that's left to do now is open some wholesale accts, and sell guns! Thanks to all for your help and insights! This is a great forum group to be a part of.
