Brick Armory Closed by NJ Div of Taxation ?

few years back i purchased a handgun from phil paid in full took 4 months when it was only suppose to be 3 days.. then renewed membership and never recieved a new card pain in the ass every time i went in.. that was 3 years ago never went back..

 

Have you contacted the NRA ? This may help as they know higher ups...

I got an email from fid unit and letter from taxation & the Governors office saying Howell gun works will do the transfer but who the hell knows when ? Its still up to taxation to take their sweet time. My persistence is paying off despite what the nay sayers have said.

As the Division of Taxation releases the firearms to us, we will do the transfers.  They will only release the firearms as they identify the owners and notify them. Once they do that they are suppose to get them to us so we can conduct the transfer(s).

 

If they did not notify you, then your firearm is not ready for release to us for transfer for whatever reason.

 

we will only be charging the $15 NICS fee, no additional transfer fees.  You will need a permit to purchase a pistol for each handgun, and a FID Card for any long guns.

 

We were advised that if you are one of the people who had a handgun there, and you need to apply for a P2P, or multiples to start the process and submit required paperwork, then contact the NJSP Firearms Unit and they will attempt to assist in getting your P2P in a timely fashion.

 

If your firearm was there for gunsmithing, we were advised that the division of taxation will be releasing the firearm directly to you.

 

Any other situation will require the transfer through us.

 

We anticipate the first batch which is estimated to be around 19 firearms sometime late next week.

 

Im sure all of you are frustrated by what has happened to your property. Just remember we had NOTHING to do with that, so please do not take out any of your frustrations out on us.  (note, we are doing this for nothing, but if you do decide to take out your frustrations on us, expect a fee, likely a big one)  So again...WE HAD NOTHING TO DO WITH ANY OF THIS, WE ARE JUST TRYING TO GET PEOPLES LAWFULLY OWNED FIREARMS BACK TO THEIR RIGHTFUL OWNERS.

 

If your firearm was on consignment, or you no longer desire to have it, or for some reason your situation has changed and you cant for what ever reason ( finances, wife or girlfriend found out you bought another gun, wife found out about your girlfriend, etc) talk to us and we will work out something to sell your firearm for you.

to repeat, you are suppose to be notified by taxation when your firearm is released to us, so calling or emailing us everyday wont get it there faster.

I will speak for all of us saying we are all grateful as you guys are doing the right thing and will definitely get my future business. That is really the nicest and fairest thing that has come from this mess. Thank you very much Howell Gun Works and i look forward to meeting you all when i pick up my firearms.

But why is another dealer involved in returning the firearms?

It looks like a simple case of another dealer stepped up to offer their services before anyone else could. The new range isn't even open yet so i doubt they can handle such transactions at this time. The guns belong the NJSP now, not any business so i doubt they are going to show up to Tony's grand opening with a truck full of guns and say, "here, take these back!". Though with the headache of figuring out who's is who's, i bet they'd like to! :p

I met one of the owners of the the new "Garden State Shooting Center" , yesterday. Jeff is a stand-up guy, who returned to me, some consignment (Non-Firearms mdse)  He could have easily denied having them but was happy to return the products.

Jeff mentioned that he will be offering a discount to former members and will be getting the range up in about 2 months!

Guys at HGW are awesome. I stop in and usually purchase something to support the local shop. I have done transfers and purchased ammo and mags there. Great guys. Easy to talk to and run a tight ship. Kudos to them for doing a great thing for the people

update as of 2/12/15: TJ Sporting Arms & Garden State Shooting Center

 

The NJ Department of the Treasury has released to us some of the firearms inventory of the company previously doing business as Brick Armory (“BA”). During this transaction, a number of these firearms have generated many discussions with former customers, the former owner, and various government agencies that need to be addressed.

 

 

 

I’d like to begin with a quick disclaimer. No part of this transaction includes acceptance of any liability on the part of GSSC for any liabilities incurred by Brick Armory or any of its owners, officers or personnel, or for any prior transactions..

 

 

 

We understand that some of these firearms may be the property of former customers due to various types of incomplete transactions between these customers and Brick Armory. As a gesture of good will, GSSC will assist in returning as many of these firearms as possible.

 

 

 

The following is the situation as of February 12, 2015 and is subject to change at any time.

 

 

 

To expedite this process, it also gets slightly more difficult. As most of you know, firearms sales is a heavily regulated business requiring licenses from both the state and federal government. Until GSSC receives its appropriate licenses, my partner, Tony Altieri of TJ Sporting Arms (“TJ”, a NJ licensed dealer) will be acting as our agent in these transactions.

 

 

 

There are many different and difficult situations to address, so please bear with us. Records provided to us for most of these transactions range from minimal to non-existent. The NJ State Police (NJSP) have provided guidelines of the legal requirements of certain transfers and they may cause delays and expense to some beyond our control.

 

 

 

I’ll start with one of the most difficult and unfortunate types of transactions. If you paid a deposit to BA for the special order of any item, we probably can’t help. We can only suggest you obtain legal advice as to your recourse against the former business.

 

 

 

Gunsmith/Repairs: We expect these to be the easiest. These items were received by BA and logged into a special book allowing relatively simple return. NJSP requires us to obtain proof of ownership for any items left for repair and they may then be returned. Appropriate forms will need to be completed.

 

 

 

All other firearms received by a dealer are entered into a log book required by the federal government. Once in this book, they are considered the inventory of the dealer. There are no notations in this log as to the reason they were received.

 

 

 

There are at least 3 other types of transactions…

 

• Transfers: You used BA as your dealer for firearms purchased from out of state.

 

• Consignment: You provided a firearm to BA for consignment sale and have not received any compensation for the transaction.

 

• Incomplete purchase: These are firearms you purchased from BA, paid in full, was retained in BA inventory, and was clearly marked as being sold to you. Typically being held by BA until the purchaser obtained the proper permits.

 

We will require as much documentation as possible. Receipts, invoices, bills of sale, or anything else that will assist in determining true ownership. All approved deliveries will require a NICS check at your expense. Handgun deliveries will also require you to provide a current/valid NJ Pistol Purchase Permit. This is a new transaction and requires all new paperwork to be completed.

 

 

 

PLEASE: So we may document each case and resolve as many as possible in a timely manner please email questions, information and copies of all documents to [email protected]. We will process each request in as timely a manner as possible. We ask that you do not contact Tony directly by phone until he contacts you.

 

 

 

We hope that everyone understands that this is a challenging situation and will be time consuming for all of us. We also look forward to meeting every one of you and hope that you will visit the new Garden State Shooting Center in the future.

 

 

 

Garden State Shooting Center and TJ Sporting Arms are providing this service on a best effort basis and are working within the parameters given to us by certain authorities. We cannot make any guaranty or promise that every firearm will be able to be returned. The inventory received by us does not include every item from Brick Armory. Incomplete documentation or other factors beyond our control may also prevent returning an item. If we are unable to return an item you believe to be rightfully yours, we can only suggest you obtain legal advice as to your recourse against the business with which you entered the transaction.

Good on you guys for trying to untangle that morass, I hope that people that are in one of the situations do understand that there is a limit to what you can do. I can't blame people for being angry, I hope they direct their anger appropriately, preferably get legal help. Keep the updates coming, too bad you guys aren't open now, its too cold to be outside today, and the unheated indoor range at CJ is too cold for my blood these days :)

I get a bad stiff neck from those heatlamp things beaming down on me, not to mention the breeze from the ventilation system. I'll wait till it's 35 or above :)

Come on Matty it's not that bad as long as you can keep your entire body under the heat lamp. j/k :)
