NJ retail firearm license

hey guys havnt been on here in awhile...

 

wanted to sk a few questions to those who bobbed and weaved throughout the above mentioned task..

 

1- if you obtain a RFL are you allowed to run the business from a residential area (home or garage) i know it was ok i just don't know if that still stands true.

 

2- if you obtain a RFL are you permitted to make minor repairs or fit the items you sell (ex uppers, fire control groups, sights ect)

 

3- what are some of the major pitfalls that others make? I'm slowly gathering all the info i think i need and i figured what better place to gather some info than good ole NJGF

1. I would assume so as I still have active home-based FFLs on file

2. You would need to be an 07 FFL depending on activities such as installing parts in a stripped lower, putting uppers on lowers, etc. 01s are allowed to gunsmith but not manufacture. In most cases, if you are adding value to a firearm prior to sale, that's considered a manufacturing activity subject to marking and possibly FAET guidelines.

3. Stay on top of your bound book.

People have been saying for several years that ATF is trying not to license people working out of their homes anymore but they are not bothering the people already licensed. Then every once in a while somebody says they got an FFL to work out of their home, so who knows.

 

I wouldn't be surprised if they say no.

ATF really does not care if you are home based. The issue you will have is first, complying with local zoning laws, then a NJSP inspection. ATF issued me an FFL in the mail without a visit or even an interview.

 

You can alter customer's guns as an FFL01, which can remain in your possession until done.

If you're going to have a pistol overnight that isn't yours, you most definitely need an FFL. You may install sights on a pistol as an 01 as that is gunsmithing provided you sold the pistol without the sights installed and the customer wants you to install them for him. It's stupid. Putting sights on a pistol and selling it isn't allowed as an 01 but you can sell the sights and the pistol to a customer on the same invoice then install it for them as a free service and that's okay as an 01. 07s are manufacturers. 01s are dealers. 07s can do everything an 01 can and then some.

 

Is there an ITAR fee  for 07?

 

 Yes. You can apply for an exception but they're never approved. Consider it a cost of doing business just like insurance.

ATF doesn't care if you're home based or not. As long as you're in compliance with your local ordinances, and they'll check, and you have $250 and a clean background, they'll issue the license.

Class 7 (07) pertains to mfg. and the ATF is not going to hassle you for modifying a FCG, adding

sights, ect. as you are not MFG the firearm; the firearm was mfg. buy the company that put the

serial number on the frame. While some conversions would fall under MFG., most typical mods

can be done with no issues.

 

A RL (Retai lLic) is only one part of the puzzle, you still need an FFL to legally hold, posses other

persons firearms which records are kept in either your Retail (Disposition) books or your Gunsmith books

I would argue the converse where most typical modification fall under manufacturing if done prior to the sale of the firearm.

The NJSP won't even send you the application packet until you have a letter from your town's zoning officer stating it is legal for you run a retail firearms business from the location your are licensing. And, as MidwestPX said, the ATF will also verify you are compliant with the zoning laws.

    • In 50 years of living in NJ I've never experienced any attempt to inspect the interior of the home, and only one definite inspection of the exterior for an announced reassessment of all properties and that was a drive by. About 9 years of that was living in an apartment, but still, uncommon. Every place I lived had either a finished attic, basement, or both. But they were also included in the habitable square footage on the taxes when we got there.
