Stack on "Personal" Safe tax exempt?

First off let me start by saying:

 

I know stack on safes aren't the best, I know some can be broken into with a paper clip, or by banging on the top etc....

 

My wife and I just had a daughter a few weeks ago, and though I keep most of my guns in the large safe, I used to keep one pistol in my nightstand in case we ever needed it....

 

And I know a newborn can't open a drawer (yet), so I wanted to buy something cheap to keep it locked away but still accessible ......

Long story short, I had a 100 gift card to Lowes so I got a stack on "personal" safe...

I had to order it, they didn't have any, and when paying for it, I asked the cashier if it were tax exempt, and she said no....

 

I said gun safes are tax exempt in NJ and she said never heard of it.....

She called over another cashier... The other cashier said I need to take the receipt to the town for a refund... I kept my mouth shut thinking this was complete crap....

 

My only idea of why it may not be tax exempt is because it is a "personal" safe and not classified as a gun safe.... It's not coming in for a week or so, so now is the time to do my research...,

Gun safes are tax exempt.  The link says this is a personal safe, not a gun safe.   I suspect that's the problem.

This is what I bought...I had no idea it was tax exempt. I guess the guys at the LGS are more familiar with gun laws than Gidget at Lowe's.

I just bought a Sentinel 64+4 gun safe on Black Friday sale. Made by Stack on. It came with a free stack on personal safe. The sale was tax exempt and they didn't collect sales tax on the free personal safe inside the big safe. The picture on the box of mine shows the personal safe with a handgun in it. I would call that a "personal gun safe".

 

No offense to Checko here, I believe he is a smart guy. My next statement doesn't apply to him. I have to say there's a reason "the body" working the cash register at Lowe's, is working the register at Lowe's, need I say more?...

I agree with what everyone has said.... I think when I return to pick up I will speak to the manager.......

The next "next size up" is a personal gun safe.... You can't make this stuff up....

Tell them they are in violation of the

"Secure firearms storage act" and you plan on turning them into the state department of taxation.

 

In CT, Walmart was violating a similar law they have on the books. The state forced them to reemburse every customer that purchased a gun safe, from the date the law went into the tax code.

Just as a point of usage.  That is NOT a quick access safe.  I have one with a similar lock and it takes a few seconds to open it, even in a stress free situation.

Lowes probably considers this as a personal safe instead of a "gun safe" and proceeds to charge sales tax. With that said it does say, as OG pointed out, it is Cali approved. I personally, would refund the tax for you. It can't be overridden before the sale but can be refunded after.

If you have any issues with the manager give me a call and I can refund you the tax at my store over the phone.

I think that's an unfair statement. Most of my register people are part time college kids and older folks looking to supplement the family income. They are not trained in NJ tax laws (let alone specifically on gun safes) and generally default to what the computer says (which is 95% of the time correct). Idle threats of "Turning them into the dept of taxation" mean very little since it means very little to the store level. Calmly speaking to the manager on duty and explaining what happened, especially with the doj approval and tax law, will usually do the trick. It makes sense and its only a couple bucks. Once you go full retard on me I lose any interest of bending over backward for you.

This safe isn't regularly stocked at my local store, holmdel, so I ordered it in the store and paid for it. I think they said it will come in next week, so when I pick it up I will discuss with the manager to try to get my tax back.

I was a college kid once, I was an idiot then. I would never give them a hard time doing their job, I'm not an A-hole. I would do exactly what you said and ask for a manager. You get more flies with honey. Trust me I deal with the general public every day myself, I wouldn't treat anyone badly for just doing their job. Cool part about America is if I don't like your store policy I complain to you about it and I get no action, I'm free to buy someplace else. I definitely wouldn't let something like collection of sales tax get my blood pressure up.
