Might be a dumb question, but what if there are 2+ bad doods. Or you are hit out of nowhere and miss the shot for some reason?

OK.. Don't yell at me for bringing this up again, and I didn't want to start another thread, but I just had a conversation with an old friend about HP use here in PRNJ. He said you can't use them for HD. I said you can and remembered this discussion. Well I just read and reread N.J.S.A 2C:39-3f and I just don't see where it says anything about use for HD. Is there something in the wording I'm missing?

How are you suppose to understand laws written, or in this case NOT written, like that? I know my buddy wont except that as an answer but I'll act like hes the dummy.

Laws don't give us permission to do things, they tell us what we can't do. If there's no law against something, then it's legal.

I should have read a few more responses down from the N.J.S.A 2C:39-3f post. I might have remember. Oh well, I can blame it on me getting so old I guess....

 now what were we talking about again???

Possession is explicitly illegal with exceptions provided. Jersey law does indeed state what you can do, and all else is illegal.

Just to clarify to someone that stumbles across this thread in a few months, Mipa doesn't mean to say that using HP for home defense is illegal. He is making a point about the posts that everything is legal unless it's made illegal.

I'm a US Law Shield member and I posted this question on their forum.

Since Nappen's law firm is affiliated with them (and who you get when you need help by using the service in NJ) I'll trust the answer they give as being definitive.

They did answer.

There is no prohibition on lawful use of JHPs in one’s home.

 

So if the discharge at home is legal, using JHP in that discharge at home is also legal.

This is the the same as shooting JHP at a range or while hunting. Which is legal to do so in NJ.

FWIW, if a body is not found in your home, how are you involved? The pig shit and fraidy scared little flits here are going to have trouble dealing with this, but reality is what it is. If you did the right thing, why would you let a hoplophobic prosecutor make his bones on you? Here in New Jerkoff, that is exactly what will happen.

This is why I'm a member of US Law Shield. Better to have pro gun lawyers watching your back in a state like this when the time comes to use your firearm outside the range.

    • In 50 years of living in NJ I've never experienced any attempt to inspect the interior of the home, and only one definite inspection of the exterior for an announced reassessment of all properties and that was a drive by. About 9 years of that was living in an apartment, but still, uncommon. Every place I lived had either a finished attic, basement, or both. But they were also included in the habitable square footage on the taxes when we got there.
