This sounds incredible. Please someone explain in VERY PLAIN LANGUAGE. Or please throw that cold bucket of water over my head so I can wake up from this pipe dream.

 

Got this via email a few minutes ago:

 

In a blockbuster announcement today, Governor Christie conditionally vetoed two pieces of anti-gun legislation (A3689 and S816), imposing dramatic conditions that would change them into pro-gun measures establishing shall-issue right-to-carry and repealing New Jersey's 2002 "smart gun" law mandate with no strings attached.

The "conditional veto" procedure allows the governor to reject legislation that reaches his desk and propose a re-written version to the legislature. If the legislature concurs in the conditions imposed by the governor, then the measure as re-written becomes law immediately. Otherwise, the legislation dies.
 
"Governor Christie has made a bold and defiant statement to the legislature in support of the Second Amendment," said ANJRPC Executive Director Scott Bach. "Not only has he rejected their medieval schemes to block self-defense, but he has fired back in a way that forces them to choose squarely between citizen empowerment or victimization in the post-Orlando era of terror attacks on U.S. soil."
 
"One inescapable truth is that government cannot protect you when evil strikes," continued Bach. "The only solution is citizen empowerment, and it is the legal, moral and Constitutional imperative of government to facilitate and not block self-defense."

Governor Christie's conditional veto of A3689 rejects this attempt to freeze the definition of justifiable need for all time, and instead completely eliminates justifiable need as a requirement to obtain a carry permit in the first place! It would turn New Jersey into a shall-issue state, and Governor Christie specifically calls for New Jersey to become shall-issue - making him the first governor in state history to both acknowledge and try to implement shall-issue carry! 
 
Here is a key quote from Governor Christie's veto message on A3689: "For decades, law-abiding residents of New Jersey have had their Second Amendment right to self-protection burdened by gun laws that are among the most unreasonable in the country. . . . Rather than doubling down on the unreasonable requirements for law-abiding residents of New Jersey to obtain a concealed carry permit, I propose having New Jersey join the 42 other states that have adopted a "shall-issue" standard for approving such applications."

OK humor me. What is the craziest outcome here? You know I'm cynical about these email barrages but what if each democratic legislator got 50,000 emails telling them to do the right thing?

 

500 from everyone who reads this.

 

2000 from emailing four people you know asking them to email 8000, 32000, 100,000? 

 

Has this ever been tried?

It's not a grandstanding move. This moves forces the Legislature to accept the changes, or have their bills die. So either way, it's a win or win big situation for gun rights in NJ.

 

ETA: I'm not saying this is going to pass, but this is the closest we've been to becoming a Shall Issue state. At the very least, the anti gun bills die.

These are vetoes.  So there is a practical effect.  He stopped the legislature from passing their new law defining justifiable need and the new smart gun mandate.  

 

Next he proposes eliminating Justifiable Need and making New Jersey shall issue, including the specific legislative changes necessary to effect that outcome.  

 

Even though it is extremely unlikely the legislature will take it up, they should have to hear from all of us again and again about how and why they should, IMO.

Below is an explanation from the NRA.

 

"Today, Governor Chris Christie took a historic step on behalf of the state’s beleaguered gun owners by vetoing A.3689 and S.816.  These two anti-gun bills were opposed by NRA in recent weeks but were ultimately adopted by anti-gun politicians in Trenton.  Gov. Christie issued conditional vetoes which return the bills back to the Legislature with suggested language, which if adopted, would drastically improve a pair of draconian gun laws.  If the Legislature rejects the Governor’s suggested amendments, the bills will die.

 

Today’s action solidifies earlier action by Governor Christie with respect to the state’s “justifiable need” standard for the issuance of a concealed carry permit.  Under current law, the state’s standard is so onerous that it requires applicants to prove a specific threat.  The law has the net effect of blocking virtually all concealed carry applications.  However, the Christie Administration issued an executive order earlier this year which made an incremental improvement to the state’s issuance of concealed carry permits by requiring a showing of only a more generalized threat.  In retaliation, anti-gun lawmakers fast tracked A.3689 to codify the “justifiable need” standard claiming “legislative intent” where neither have been proven to previously exist.  Rather than “freeze” a bad standard into law for all time, today’s positive reform would significantly improve a broken concealed carry law which has always devalued the constitutional right to self-defense.

Also, the reworked smart gun legislation would remove the 2002 Smart Gun law's mandate, which threatens a backdoor gun ban once smart guns are certified as commercially viable by banning all future traditional handgun sales.  In addition to removing the 2002 mandate, Christie’s conditional veto also strikes the bill’s new mandate that forces gun dealers to offer smart guns for sale, thereby blocking any attempt to ban traditional handguns.  NRA previously testified that the bill forced market acceptance of a technologically unviable product which is harmful for self-defense and is nothing more than a tricky gun ban.

This transformation would move New Jersey into conformity with the vast majority of other states which value the right to self-defense and have strong carry laws.  Governor Christie has expressed to us that, “for decades, law-abiding residents of New Jersey have had their Second Amendment right to self-protection burdened by gun laws that are among the most unreasonable in the country. . . .  Rather than doubling down on the unreasonable requirements for law-abiding residents of New Jersey to obtain a concealed carry permit, I propose having New Jersey join the 42 other states that have adopted a “shall-issue” standard for approving such applications.”

Please contact your state Senator and Assembly members and respectfully urge them to support the changes offered by the Governor in today’s veto message.  Encourage your family, friends and fellow gun owners to do the same."

IMO - *nothing* will demonstratively change the opinion or state of the anti's in the legislature from either party - the whole idea of citizens carrying a firearm for self defense is unconscionable to them as a matter of course in thier lives.

 

No matter how many emails, no matter how many letters, no matter how many stand in the cold and snow at the state house - they will not and cannot vote for it -

 

The only way to win is by legal action by bringing them kicking and screaming to the table - vote them out of office and replace them with those that have the people's best interests at heart - or revolution.

Another strategy is civil disobedience a la civil rights protests in the '60s. Those folks were risking misdemeanors, occasional black eyes. It takes balls to take on five-to-ten years at Rahway.

Go back to watching F troop and complaining on this forum. There are plenty of gun rights groups who promise to try to correct NJ's problem (just join and send in your dues and remember "your dues is NOT enough") Here is a chance although slim to try and do something for free! Over one million gun owners in the state and if everyone called multiple times it would over load the switchboard. I for one am not going to sit back and do nothing and complain on the forums and chat rooms. I forwarded this to everyone in my address book and hope they do the same.

They are they copied and released their e-mail directly from the ANJRPC e-mail that was sent out earlier.

Again the NRA jumps on the coattails when something happens with out any help from them

42 out of 50 states are shall issue and we have to live like animals and beg for our dinner. Amazing.

 

Btw I got a letter from oroho today in response to an email I sent him opposing this legislation. In it he explained how he's sponsoring or authoring (forget which) a bill to overturn the FID, one gun a month provision, 15rd mag cap and basically everything from the ridiculous gun laws here

 

As ive said in many other threads here, there's always hope...

Dear XXX,

 

Governor Christie has proposed changing existing legislation to grant New Jersey citizens the same rights as residents of forty-seven other states, namely the right to keep and bear arms outside the home. The legislature is almost certain to ignore this request. However, something positive may come of this if gun owners swamp legislative email in-boxes with requests to consider the proposed changes. Please email all the gun owners you know and ask them to send an email message to every state legislator (addresses are here), and to contact every gun owner they know and ask them to do the same.

 

Here's the suggested message. You may change it of course but please be respectful:

 

Governor Christie has recently proposed changes to A3689 that would grant citizens of New Jersey the same rights to defend themselves as citizens of 47 other states. I urge you to consider these changes and to vote to implement them. 

 

Approximately fifteen million Americans carry firearms in their everyday lives. They do so legally, responsibly, and safely. Moreover tens of thousands of New Jersey residents hold concealed carry licenses in other states. We deserve the same trust and consideration from our own legislature in our home state.

I plan on calling every day... but the reality is, this man below has to accept the changes in the conditional veto, along with his colleagues that feel the same as he does.

ANJRPC & NRA-ILA are one & the same here in NJ. These emails are always sent out in tandem.  This gesture is just political ping pong between a vehemently anti demorat legislature and a rino trying to stay relevant on the national level in the republican party. Where was he 6-7 yrs ago? We all can now say we were  here at the hi point of ccw in NJ....

If the political posturing of a Rino trying to stay relevant on the national level, opens the door to elimination of justifiable need, where is the harm in that?
