ATF Reverses Its Stance On Shouldering Stabilizing Braces

"Saint Petersburg, Fla. (April, 25, 2017) – SB Tactical™, inventors and manufacturers of the Pistol Stabilizing Brace®, is excited to announce that the Bureau of Alcohol, Tobacco, Firearms, and Explosives (BATFE) has issued SB Tactical a reversal letter containing a sensible clarification of the Bureau’s position on the lawful use of SB Tactical braces.

 
The new clarification of opinion letter states, “an NFA firearm has not necessarily been made when the device is not reconfigured for use as a shoulder stock – even if the attached firearm happens to be fired from the shoulder. To the extent that the January 2015 Open Letter implied or has been construed to hold that incidental, sporadic, or situational “use” of an arm-brace (in its original approved configuration) equipped firearm from a firing position at or near the shoulder was sufficient to constitute “redesign,” such interpretations are incorrect and not consistent with ATF’s interpretation of the statute or the manner in which it has historically been enforced.”

I think you can dump the mag for a sig brace but how do you handle the front?  Grab it around the mag well?

not to be overly negative, but this is where my head went after reading that this morning. haven't they flip flopped or at least changed their stance on pistol braces a few times now? whats to stop them from doing another letter reversing this decision?

I never got the point of the pistol ARs.

 

Even at this year's shot there was the HK MP9 pistol clone thingie.... did absolutely nothing for me.   If you want an SBR... just build an SBR... (outside of socialist Jersey ofcourse).

I got a "SBR" without having to get a tax stamp and can do in PRNJ.

 

Also... it's blasty fun.

Even at this year's shot there was the HK MP9 pistol clone thingie.... did absolutely nothing for me.   If you want an SBR... just build an SBR... (outside of socialist Jersey ofcourse).

 

I have a SP5K and it is fantastic to shoot.  I also applied for a tax stamp to SBR it like my Sig Sauer MPX-P 9mm.

I think they make slightly more sense in states where concealed carry is for pistols only. Still not sure why you'd ever want to CC an AR, though.

 

In my state loaded carry of long guns in a vehicle is a legal gray area. I bet people use AR pistols as a workaround for that as well.

Semi related question. Is a broom handle mouser with the wood holster attached to the pistol grip to form a stock a SBR?

I would say no since the purpose of the Mauser stock is to shoulder the weapon. The "braces" are primarily designed to be used off the shoulder and against the forearm to stabilize the weapon. Ostensibly for handicapped persons but with benefits to the fully capable as well.

Yes, unless the barrel of the pistol is at least 16 inches in length (and the overall length of the firearm with stock attached is at least 26 inches). However, certain stocked handguns, such as original semiautomatic Mauser “Broomhandles” and Lugers, have been removed from the purview of the NFA as collectors’ items.

[26 U.S.C. 5845, 27 CFR 479.11]

 

I'd do some further research but I remember reading about that when looking up AOW laws
