I just sent the email below to Brent Johnson.  He is the author of the article on NJ.com announcing the buy back program.  Let's see.

 

Dear Mr. Johnson,  Some individuals and myself have been unsuccessful in trying to find an answer to our question regarding the up coming Gun Turn in event.  I'm hoping considering the involvement you have had with the authorities relating to your article you may have more luck finding these answers than we have had.

 

According to the current NJ gun laws (pasted below) B.B. guns are covered as a "firearm".  In NJ one cannot purchase a B.B. gun without a Firearms Identification Card. We're curious if this qualifies them for the gun turn in.

 

“ f.   "Firearm" means any handgun, rifle, shotgun, machine gun, automatic or semi-automatic rifle, or any gun, device or instrument in the nature of a weapon from which may be fired or ejected any solid project-able ball, slug, pellet, missile or bullet, or any gas, vapor or other noxious thing, by means of a cartridge or shell or by the action of an explosive or the igniting of flammable or explosive substances.  It shall also include, without limitation, any firearm which is in the nature of an air gun, spring gun or pistol or other weapon of a similar nature in which the propelling force is a spring, elastic band, carbon dioxide, compressed or other gas or vapor, air or compressed air, or is ignited by compressed air, and ejecting a bullet or missile smaller than three-eighths of an inch in diameter, with sufficient force to injure a person. ”

 

If it is possible for you to get this answer it would be much appreciated.  I assume that the NJSP would also appreciate for this information to be cleared up rather than take up their time dealing with the people hoping to turn these in.

Regardless of what some nameless person told a caller on the phone when asked, under 2C:39-1f, BB rifles and pistols ARE considered firearms in this G-d forsaken state.

As has happened on many occasions before, the Attorney General's office is perpetrating a fraud on the People of New Jersey.

The "non-negotiable price list" they are paying on at the buyback includes BB, pellet, and Airsoft (even though they are not classified as firearms) weapons, and they are only paying only $20 per.

This is in direct conflict with the definition of a firearm, as previously quoted in 2C:39-1

And functionality is irrelevant.

This is according to Annaliese Gancarz, an Asst AG who is representing the AG's office at the Camden location today.

So take your unwanted Airsoft and non-functioning pellet guns in and get your $20 each.

Or make an old school .22 zip gun from a telescoping car radio antenna and get your $120

Otherwise, stay the hell home.

I went yesterday to the one in Trenton. Sponsored by AG's office; run by Mercer Prosecutor's Office.  I turned in two old BB gun pistols. In my time there, my observations were that there were no minorities there turning in their "burners" or "assault rifles". All white men (not from Trenton in my opinion); Couple of older men turning in non working shotguns, one gun turned a non-working over/under shotgun, one guy an older break-open pistol, and another one with older hunting rifles (some looked old; octagonal barrel and precussion cap (?) fire. 

In discussions with my sources there, no  "assault rifles" had been turned in yet. My sources said a few sawed-off shotguns had been turned in; the rest old shotguns/rifles mainly. Some new 870 pumps (who would do that?). I also inquired if any M1 Garands or 1903 rifles, etc. had been turned in. This source was not sure if any had been turned in yet, but told me they would be offered up to historical museums and not destroyed. I hope he wasn't BSing me. 

I was disappointed in seeing some of the stuff that had been turned in though. If people knew the real value of what they had....a lot more than $150.

My friend, you need to grow smart about this. I get one side of the debate " well shit, it's our money, I got junk" 

but you need to look at the beast you fuel.

please don't take this as an attack, it's a friendly suggestion to yourself and others. There's a picture, then there's a bigger picture. Etc

The state got taken.  Glad I had a soccer tournament and couldn't go.  I wouldn't have been too happy standing around all day and coming away empty handed.  A bunch of junk got turned in.  Yes selling anything to them makes you a participant in their Anti-Gun Propaganda.  However being the state was mostly sold junk it does make them look foolish to anyone in the know.  No chance I would have sold to the state but I would like to buy out from underneath them any decent Milsurps.

Not really an opportunity to. There were many Prosecutor's Detectives, few SP, Trenton PD around that you could not ask someone of they wanted to sell you their shotgun. They cleared the weapons outside on the street, then you were escorted inside the church to one line with a detective holding your weapon to a table where they recorded the make, model, serial number.  Then they gave you receipt to take to another section where they took that receipt and gave you your cash and another receipt. 

I only briefly spoke to the guy in front of me as we were walking in and then the guy behind me as we walked out together. 

 

PS:  Let me add to this. I did not want to go to this. I did it for two reasons: to assist a friend who was away that weekend and could not go. 2nd, to see for myself what went on and to be able to report it here. Most of the firearms I observed being turned in or already turned in where hunting rifles/shotguns and BB guns/rifles. Most looked like junk; some stuff was definitely worth more than what the State was paying.

The media, seemingly unconcerned with questioning the value of piles of useless shotguns and rifles, emphasized NJ Attorney General Christopher Porrino's focus on 129 "assault weapons" that were turned in.

As every informed gun owner knows, an "assault weapon" is an entirely made up term by fearmongers. The legal definition is based purely on the cosmetic appearance of the weapon and is unrelated to its function. Nonetheless, the term assault weapon makes for great propaganda, and NJ's media will never question the false narratives. The quote below by Porrino about "assault weapons" that were "taken off the street" perfectly illustrates that point:

"Assault weapons are designed to pierce body armor, and getting just one off the street has tremendous value, not to mention getting 129 off the street in two days.”

"Assault weapons" are not "designed to pierce body armor," nor does their definition have anything to do with the ballistics of the weapon. The appearance of a weapon, and that's all the legal definition of an assault weapon deals with, has no bearing on the weapon's ballistics or its ability to pierce body armor. Additionally, ANY rifle round will pierce body armor because body armor, excluding level III ballistic plates, is designed to stop handgun rounds, not rifle rounds. The quote below by the US Attorney for the State of NJ, Bill Fitzpatrick, perfectly illustrates this well-worn falsehood:

“Those are weapons of war, those are weapons designed to kill as many people as possible as quickly as possible.”

Such hyperbole isn't worthy of a counter argument, our only response is that we hope President Donald Trump replaces Fitzpatrick with someone who supports the constitution soon.
