slickskin 11 Posted May 28, 2018 This is regarding the form that is part of the paperwork in applying for the firearms purchaser id card about consenting to mental health records. When they ask for mental health records, how deep do they want to know or look for exactly? I saw a psychiatrist a few times for mild stuff like ADHD and slight autism. I was never hospitalized or anything like that and definitely am not a mentally unstable person. My criminal background is crystal clean also. But should I be worried that I'm going to be rejected for this? Do they even know if I went to a psychiatrist since again I was never hospitalized or went through a court or anything like that? I'm guessing something as simple as that doesn't show up on a nicks background check which takes place at the gun shop but does in the police departments search then. You may be able to search and find some of my past posts on this topic. So a few “bottomline” thoughts as follows: 1. The more relevent issue is how you will answer question #26 on the STS-033 form. IMO you clearly need to answer “Yes”. In particular , note words “ever” and “outpatient “ that are part of the question. 2. Lying on the STS-033 form is a felony. Said felony would disqualify you from ever owning forearms. Hence you must be truthful. You do not want to lie and forever have to worry about the lie being discovered, whether now or anytime in the future. 3. Given you answer "Yes" to Q#26, in the box state "See attached letter" and include a carefully written letter describing your issue and treatment. See Lambo's recommendation above. Keep it short, simple, and factual. 4. Once you answer "Yes", you will by definition always have to answer "Yes" on future STS-033 applications. But at least you will be able to make reference to the fact you have been approved in the past(ie your current application). 5. The mental health form is so they can check with the county to see if you were ever committed to a mental institution. With that said, some police depts will use that to dig deeper. 6. Hopefully your application will be processed smoothly and promptly. HOWEVER, once you start this process, you must be must be ready to see it through it's ultimate conclusion no matter what, even if it requires a doctor's note, lawyer, appeal to Superior Court, whatever. slickskin 11 Posted May 28, 2018 I mean I don't consider going to a specialist 5 years ago when I was in college and had trouble focusing to be a mental disorder. I don't see this person anymore and she wouldn't write a note saying it's safe for me to own a firearm because I'm sure she doesn't even remember me and the 30 minute conversation we had. That's ridiculous if they would discriminate for something like that and if they did I'd try to sue for violating my second amendment rights. I'd just have to wait until I eventually move to a state that respects my rights as an American citizen and I'll only have to pass the nicks background check which would be no problem since again I have no criminal background or hospitalization background. 1 Quote Share this post Link to post Share on other sites

I don't see how anything other than arrests and hospitalizations would come up on there. Medical records I think are otherwise private and frankly nobodies business. They don't talk to therapists or such and mental health professionals aren't going to say anything to the police even if they are asked unless they directly threaten to kill themselves or someone else. Revealing any of your medical information would destroy the whole basis of being someone you can safely talk to. Also, there's no database or anything with everyone's therapy/psychology records so the only searchable thing the police can find is officially reported institutionalization. I had to get a security clearance and background check regularly. I see a Psychiatrist for Insomnia, Anxiety, Depression and ADHD. I never had a problem. These are things that many people suffer from these days. I had my last background check from a US Defense/Security Agency just two months ago and was approved with no problems. However, I did as a young child have to attend court mandated family therapy due to my brother's extra legal antics and the repercussions thereof. It's never been an issue.
