Transporting from FL to NJ

So, I have a bit of a dilemma here. I am living in NJ but both of my rifles are in Florida still. I plan on moving one or both of them back to the state after I visit my family for Christmas. My question to the fine folks here is whether I am legally able to do so and if one of my rifles is legal in the state or not. I have read and been told different things by different people.

1. According to njsp.org it seems that I can legally transport my firearms into the state if I am moving here without an NJ firearms purchasers permit.

2. Another gun owner I spoke with told me that you need a permit to legally transport into the state.

3. Officially I have been living here for 2 years, but I am still legally a Florida resident. Would this effect my ability to transport firearms into the state?

4. I have an Inland M1 Carbine. From my research before it seems like they are on the list of rifles generally banned as "Assault Weapons" but I was also told by a gun owner friend that as long as it doesn't posses two or more of the "assault weapon features" i.e. pistol grip, bayonet lug, etc. that it would be legal to posses here. Does anyone know if the M1 Carbine is legal to own in the state?

 

If anyone can help me with any of these questions It would be greatly appreciated! I've been told too many different things at this point to be sure one way or the other.

1. Yes, you may move anything that is legal in NJ that you already own (as long as it was legally purchased while resident of another state) to your new residence.  The FPID is mostly just for purchasing ammo and long firearms.  That being said, once you get settled and have your license transferred, it is highly recommended that you apply for one and carry it whenever you are going to the range just to avoid any potential issues with mis/uninformed LEO.  Having an FID technically allows you to carry a long gun unloaded, but I'm not sure I would recommend testing this out...

2. That owner is incorrect.  Like I said above, as long as you legally purchased them while a resident of another state and they are NJ compliant (magazine capacity, evil features, etc.) you may transfer them unloaded DIRECTLY to your new residence - you're technically not allowed to make any stops or deviations on the way.

3. This would be a question for an attorney (Evan Nappen?).  My guess would be that if you're still a Florida resident on paper, you would have to be in the process of establishing new residence here.  But, IANAL.

4. From everything I've ever heard, M1 Carbine is explicitly banned here.  Again, consult with a lawyer to be sure.  If it's on the banned list, it doesn't matter whether it has evil features or not - it's banned.

1.  You can bring any firearms that are legal to NJ.  Without a NJ FPID you are limited to transporting your long guns to your NJ home and directly to and from the range or hunting.  The NJ FPID also allows you to transport an unloaded long gun anytime as long as it is not a prohibited location  (school for example).

2.  You need no permits to transport NJ legal guns to your NJ home.  There is no mandatory firearms registration in NJ.

3.  Not sure what you mean that you've been here officially for 2 years but still a FL resident legally.  Where do you vote, pay taxes, have your car registered, which state you have your driver's license?  None of these are really the deciding factor.  Are you a dual state resident and maintain homes in each state?

If you have dual residence or moving to NJ you can move your NJ legal firearms.

In any case I can't see why you can't bring NJ legal guns to your NJ home. IANAL but if you want you can pay Nappen $500 to tell you the same.

4.  Inland Carbine is a "M1 Carbine Type" listed as an assault weapon and is illegal in NJ. Read NJ''s assault weapon list.  Evil features don't come into play  as it's banned by name.

The only way one can own a M1 Carbine legally in NJ is if:

a.  It was registered before the AWB took effect.

b. You get a permit to own one which is the same as getting a full auto firearm.  No one has permits for either of these.

Once again you can pay an attorney to tell you the same thjng.  You cannot bring your M1 Carbine to NJ.

As others have said if it is on the list of explicitly named guns it is a no go no matter what features you have on it.  Since I recently made the move from the socialist people's republic of New Jermany to the semi-Free state of Florida feel free to bring it to my house where I will adopt it and give it a home.  I'll even allow supervised visits.

Thanks guys, Just one last question, I have seen a couple different lists regarding what is and isn't officially a banned via. The one on Wikipedia includes the carbine, but a couple others I have seen don't. Is there a particular official list I should use? Or is the wikipedia list a good reference?

I would not trust wikipedia with my freedom.  Go to the actual law.  Here is the current proposed laws which has a list of the banned by name guns, I don't think they have made any changes but have not researched it:

4. No it is not. I live in both Fl and NJ and if you want to sell it and transfer it to me in Fl tell me how much you want for it.

It is staying with family in FL for now so I won't be selling it any time soon. I appreciate the offer though :)
