30 day question. Can I buy out of state, ship and have FFL in NJ hold until 31 days?

Recommended Posts

Hi.  New gun owner here.  I read the gun law primer and one gun every 30 day primer here and had a question which is not directly addressed.

I had 3 handgun permits.  Just used one a few days ago for first pistol.  So now my 30-day clock has begun.  There is a gun that I'm looking at that is out of stock almost everywhere but there is one online store out of state that has it.  My concern is they sell it before 28 days pass and I am beyond the 30 days where I can purchase my next handgun.

So does the 30-day rule apply if I purchase it online from out of state FFL today, have them ship to my local FFL here in NJ and don't go to pick up the handgun and do the transfer until after the 30 days?  I didn't know if purchasing it online breaks the 30 days or if by waiting to pick it up and do all the paperwork on day 31 is a way I can secure the gun now and get it later.  In my head I'm buying the gun then the NJ FFL dealer is just holding it for me until I come in to actually transfer it.  It seems this would be ok but this is New Jersey.....

BTW for the moderators....your NJ Gun law faq here I think still states NJ firearm for semi-auto may not have a capacity greater than 15 rounds.  You may wish to update the FAQ to reflect the current NJ law which reduced that to 10 rounds.  I know the deadline is coming up for when all 15 round mags are supposed to have been converted/pinned.

Thanks in advance for any info any of you can provide on this question!

The 30 days is when you take possession of the gun in NJ.  NJ law stops at its borders. You can buy all the guns you want out of state and have them shipped to  a FFL to be transferred to you every 30 days.

Many FFLs will charge a storage fee for keeping a gun longer than a certain time period they state.  Find this out before you start sending guns to one.

That is very good and what I was hoping was the case.  I'd like to buy a few handguns that seem to be out of stock or discontinued most everywhere and be able to grab them while I can.  As long as my FFL has them in safe keeping that is fine and I can wait the 30 days per gun.  I will check storage fee as you suggest.  Might ship to one of the ranges (both are FFL's) and probably joining there anyway so as member might not have storage fees.....plus FFL transfer fees are lower for members on the range clubs I am looking at.

Thank you

Actually you can buy more than 1 every thirty days with an exemption.  You could immediately buy as many as you want from out of state (or in-state) dealers and have them shipped to your FFL, you would then get the serial numbers of each gun and fill out a form and apply for an exemption.  Once received you can pick up all the guns at once.  This only applies when you have the serial numbers of each of the guns ahead of time.  Check the state police web site for more info.

I second what Griz said.   Last December I was in the exact situation you are.  Shortly after using one of my permits, was notified that a handgun I wanted (GP100 in 5”) was in stock at Davidsons Gallery of Guns. I purchased it on their webiste and they shipped it that same day to a local ffl. Three weeks later I picked it up.

This is great.  Now I can grab these pistols online and have my FFL here ready and waiting for me to pickup each 30 day interval or sooner if I get the exemptions. At least this way I have the serial number too so I can file for the exemptions.

I have never applied for an exemption.  So not sure of the pros vs cons of trying to do so.  In my case, I did not want to invite even more scrutiny beyond the already arduous process.   Others with experience in this regard can better advise you.

Is an exemption always granted?

AFAIK it is but it does have a denied block.

A few years ago I applied for an exemption and I got it in about two weeks.

Last year I had a two handguns I wanted to get and asked the FFL I use about getting an ecemption.  At the time he said it was taking longer than 30 days to get the exemption.  I was better off just waiting in this case.

If you have 4 or 5 you wanted to get at once it probably would be worth it.

I've had more than one, and they were all granted.

Because of the wait time, to make the effort for an exemption worthwhile you really have to be buying three or more handguns.

I’ve done the exemption s few times when my being held inventory was getting to large. I took home a dozen pistols one time and 8 or 9 one other.  You need to have all the serial numbers before you fill out the forms.
