Illinois Circuit Judge Rules FOID Card Unconstitutional

Recommended Posts

Quote

The Court reiterates its findings and ruling in its previous Order Finding Statute Unconstitutional filed herein on February 14, 2018, that 430 ILCS 65/2(a)(l) is unconstitutional as applied to the defendant in her own home.

I believe it only applies to the IL requirement to have your FOID on your possession at all times, even in your home.

You're correct.

I think if this does make it's way to SCOTUS, it could have big implications regarding FOID laws.

That's years away though, especially with 2A cases.

Amazing, how injunctions are applied hours after laws pertaining immigration are enacted, but a 2A case takes YEARS to make its way through the courts.
