Legality of homemade 1911 from 80% blank

Recommended Posts

I’m looking for some guidance about a 1911 that I made from an 80% blank. I made the gun while living in PA and brought it with me when I moved to NJ. I did put a serial number on the gun in case it was ever lost or stolen. I’m wondering if it is legal to have the gun in NJ.

i have a FID card and have also gotten p2p permits for several handguns over the past 3 years. I am a member of the ANJRPC Cherry Ridge range and tried calling one of the attorneys that members can call for questions, but they don’t call back. I now have the gun stored at a relatives house in PA but I would love to bring it home.

If you’ve got documentation for purchase of the blank while a resident of PA, I’d hold on to it.

Unfortunately I don’t have the documentation and in-fact I bought it while living in NJ before moving to PA and then moving back to NJ. I can get a statement from my brother and his neighbor attesting to the fact that the machining of the 80% blank was done in PA.

I feel you're over thinking this. There are plenty of people with plenty of guns they acquired legally before they moved to NJ.  I haven't heard of anyone with any problems because of this.

Maybe you’re right. I just get nervous that some over zealous cop will want to arrest me and I’ll end up spending thousands on legal fees.

So you risk it all and post this question on the internet?

It’s not necessary.  You can buy the blanks in NJ you cannot finish them.  There is a new law that may prevent the purchase of 80% receivers.

This begs the question, can you go to your friend's home in PA and build a 1911 then drive back to NJ with your property? I've always maintained that NJ firearm laws do not apply while you are in PA and as far as I know there are no laws in PA prohibiting you from building a gun, resident or not. That card we all have is for long gun purchase (older ones like mine say long gun carry as well) and the PPP is for buying a handgun. Neither of these is for possession of a firearms so if it's yours,  you should be able to transport it from a place you can legally posses it to home in NJ.

Hate to say it but it's not worth having to explain in court about the purchase date, where it was made, soft proof, etc. Did you read the ghost gun law NJ has on the books now. While technically legal when you did it, is it too much to imagine one of New Jerseys plentiful activist judges to say that they "feel" that the spirit of the law was to prevent people from having 80% blah blah blah guilty. Enjoy appealing and likely winning from prison.

Caspian has good deals on foster frames. Do that.

My attitude is I wouldn't worry about it.  There are thousands of guns in NJ that people owned before they moved to NJ. Many of these guns changed hands several times before they wound up in NJ.

Yes, it's a different thing but remember it's up to the prosecution to prove your guilt.  Having things to prove your innocence helps but they have to prove your guilt.

Defense attorney and time away from work is not free. New lower is $200-$500...

Do what you want, and I'll donate to your defense fund, but I do not have the time for such, and too much to lose.

On Griz's defense, 1911s are not high on their list of guns being identified as ghost guns.   They aren't evil AR15s and evil Glocks.  I do disagree on the sentiment that you are innocent until proven guilty.  That isn't necessarily the case in NJ.

    • In 50 years of living in NJ I've never experienced any attempt to inspect the interior of the home, and only one definite inspection of the exterior for an announced reassessment of all properties and that was a drive by. About 9 years of that was living in an apartment, but still, uncommon. Every place I lived had either a finished attic, basement, or both. But they were also included in the habitable square footage on the taxes when we got there.
    • 27.00 and change in tolls to drive down the shore from Rutherford,  47.00 in tolls to go out to Long island to visit dying relatives. Now I read they are going to raise the fees in the DMV. Murphy lied just to get elected when he said that seniors will get a significant tax break with his StayNJ" program to stop us from leaving.   Keep voting for democrats...this is what you get.  Tax and spend is all they know.  Never cut anything.  This state sucks.
