Could NYS move to dissolve the NRA?

Recommended Posts

This lawyer, via his blog, says it’s possible:

...

Read that last line again. New York State could close down the NRA entirely by moving for dissolution. You have a governor and attorney general in New York that hate the National Rifle Association. You have a Board of Directors which is too large to be effective. You have Ackerman McQueen trying to preserve its position and an outside counsel trying to take their position for himself. And then you have internal civil war going on within the organization between loyalists to one executive and friends of another leader.

The bottom line is that there are tremendous troubles within the NRA just when you need it to be steadfast in the face of outside attacks.

How bad are these troubles? A reliable source told me that Marion Hammer who hasn't attended a Board of Directors meeting since hell froze over the last time will be in Indianapolis to attend the Board meeting. It's that bad.

I have no idea what is going on with the NRA, but from a governance perspective it doesn't appear to be good.  I've been a member for years but never received a ballot.  When I called to inquire so that I could vote for Colandro I was transferred to a sales rep trying to sell me a life membership.  He seemed completely confused and disinterested when I explained I was just trying to get a ballot.  He then gave me another number at the organization and I couldn't get through after repeated attempts.  The NRA has made some valuable contributions through its litigation, but I can't help but give some credence to Youtube personalities like the Yankee Marshall who are adamantly anti-NRA and claim the whole organization is nothing more than a scheme to support Wayne Lapierre's 7 figure salary.  Claims that the board has zero actual power areprobably true.  Between their incessant marketing, dramatic scare tactics, and unsavory leadership, I'm a very reluctant member.

I you're not a 5-year (I believe uninterrupted) member, or a life member, you dont get a ballot.

The NRA is an organization of  people that believe in their rights and freedoms.  Its sentiment  can only be destroyed from within.  And, something else WILL take its place as long as there is a belief in freedom.  Perhaps if it falls apart the NARA  (The National Assault Rifle Association) will emerge... The NRA is only as good as its collective members, suck it up, Wayne...

We need the Blue Flag Laws so that the President can deport progressive statists and send them to Cuba, Mexico, Venezuala, North Korea, and Iran without due process starting with Cuomo.

Get more engaged if you are worried, but personally I wouldn't worry about this until more is released.   The opponents would love uncertainty and dissension in the ranks.

There’s a third way, a large enough donation.   It actually says that in the FAQ on their site.

Well, sure.

You can pay up-front and be a "5-year member" or, for $500 or so ($300 if you catch them right) become an instant Life member...which is why they transferred him to the membership upgrade folks.

Only Life members and above can vote, which is why you got xfer'd to sales.

http://onlygunsandmoney.blogspot.com/2019/04/everytown-files-complaint-with-irs.html

...

Everytown for Gun Safety has filed a complaint with the Internal Revenue Service asking for an investigation into the National Rifle Association and their 501(c)(4) status. Specifically, the complaint alleges that the directors, officers, and others are using income and/or assets for personal gain and that the NRA is engaged in commercial, for-profit, activities.

The letter that accompanies the IRS Form 13909 Tax-Exempt Organization Complaint (Referral) accuses the NRA of related party transactions, financial mismanagement, and lack of transparency. It ask that the IRS begin an investigation to see whether the NRA has violated Section 501(c)(4) laws and regulations. It further asks that if violations are found that the IRS consider what would be appropriate remedies including revocation of the NRA's 501(c)(4) status. ...

Interesting times ahead for the NRA - I am genuinely concerned about what's going to happen to the organization:

Much of what has been said by politicians about the NRA and everything negative that has appeared recently in the media of any sort should be considered the equivalent of sniping. It might take out one or two people but not the whole organization. That was then.

The office of New York Attorney General Letitia James (D-NY) has now fired what I would consider the preparatory barrage in the effort to dissolve the NRA. As someone noted to me, James is under pressure to act and she did on Friday.

From NPR reporting on the NRA Annual Meeting:

Even as the NRA struggled to handle its internal divisions, an external threat emerged this weekend in the form of a new investigation by New York Attorney General Letitia James.

"The Office of New York State Attorney General Letitia James has launched an investigation related to the National Rifle Association (NRA)," a spokesperson for the attorney general told NPR. "As part of this investigation, the Attorney General has issued subpoenas. We will not have further comment at this time."

The NRA has received a document preservation notice in connection with the investigation being undertaken by the New York attorney general, according to a source familiar with the matter.

The NRA responded to the announcement of the investigation by pledging its cooperation.

"The NRA will fully cooperate with any inquiry into its finances," said William A. Brewer III, an outside lawyer for the NRA. "The NRA is prepared for this, and has full confidence in its accounting practices and commitment to good governance."

 This is serious.

It is even more serious because as evidenced by the NRA Meeting of the Members today too many people think just ignoring it will make it go away. The matter is NOT going away.

Compounding this is the NRA's outside counsel who has a checkered past in terms of legal ethics. He was sanctioned in Texas and his appeal of it was upheld by the Texas Appeals Court last year.

If the NRA is going to use an outside counsel, I might suggest getting the very best - and cleanest - New York non-profit law specialist and let him or her handle it. However, given Brewer's apparent hold on the attention of certain NRA executives, I doubt this will happen.

Question.... why doesn’t the Texas AG launch an investigation into MoveOn.org? Or any other leftist organization?   Is it only the left that wants to actually fight?

I think you answered your own question

The Right has become too complacent. They wave their hands and say “that’ll never happen”. Not unlike our Fudds.

I’m not going to continue to post each article, but if you’re interested in learning about what’s going on inside the NRA without filtering through the media then you should be reading this blog regularly:

...There is no word what will happen to NRATV which is produced for the NRA by Ack-Mac. As a reminder, NRATV personalities such as Cam Edward and Ginny Simone are Ack-Mac employees  while others like Dana Loesch are independent contractors. ...

    • Sorry, both are SPF.  Being picked up this week. Win M22  22 LR SPF to Ringwoodfrank.
    • Yup I see. Looks like right now you can only purchase the 2023-2024 permit still. I assume won't be able to purchase 24-25 season permit until July.
    • Just a heads-up for anyone who might also be in this situation. I joined USLS mid-April of 2022. Some time after renewing for 2023, I changed email providers, and dutifully reflected my new address on my account page. So, I have been anticipating renewal alerts at my new address, but those never arrived. I logged in to my account the other day, and was surprised to see that my subscription expired that same day. I went to my account main information page, confimed that my email address was correct, then went to the billing page, which showed my previous two payments, but which did not give me any apparent way to pay up for the new year. I requested support using the Customer Service form on the web site, but received no reply. Today I called their support number. Apparently changing the email address from my view of my account page did nothing to change the address that they use internally for billing purposes, including expiration notifications. Maybe they also use that address for replies to the support form, even if a different email address is entered there. Also, my account was set up to auto-renew and charge my credit card without my intervention, but that setting did not show on my account page in any obvious way. So, if you have USLS and have changed your email address since you last renewed, you might want to give them a call to ensure that they send renewal information to your correct address. The prospect of having legal coverage lapse while carrying in NJ was, for me, a less that confidence inspiring experience. I will note that the telephone-based customer service was excellent.
    • F*n imbeciles. They know damned well (or should) that, even if passed by the Colorado Senate and signed into law, virtually that entire load of crap is certain to fail Bruen/Heller scrutiny, and probably sooner, rather than later (SCOTUS). What a monumental waste of time (of course, how much can a dip$h*t's time be worth, anyway?) and energy. I passed through Colorado a few times in the 70s, and visited some clients there in the 80's & 90's, and, even by the end of that period, I had the impression that it was politically fairly conservative (with a few exceptions such as Aspen). WTF happened?
