If so - They are going to have the dealer have to buy it back, and then the dealer has to deal with the ATF on classification for resale......

of course it can.

 

i'm curious whether the atf or any "authorities" are contacting the ffl's who have sold these, and "urging" them to get them back....or if anyone's going right to the end users?

I would assume the seller can ask, but also assume the dealer would explain that IF they didn't turn it back to the dealer for amount originally paid, the dealer would tell the ATF they did not reclaim the weapon. In that case the ATF will come knocking at your door and take it - then you get nothing..........

Well john, we all know if the ATF says you can't / shouldn't have it - somebody is gonna come get it.........

And has anyone noticed that Franklin Armory started this thread to sell guns, and now has disappeared?

Most of these loopholes are one shitty administration away from closing up. 

On the other hand..... I do feel the non-NFA firearms are immune from prosecution. Hell the ATF provided you all the litigation you need to prove they are legal. While they could create a cluster fk of sorts with selling and transferring them, maybe even forced recalls.. I doubt they would have the legal justification to do so.. 

 

In this case, "upon further inspection of the law" they found that while these were not NFA regulated, they justified it under the gun control act. However, this too is not prosecutable.. because the franklin "firearm" doesn't shoot shotgun shells and is technically not smoothbore, even if the lands/grooves run straight.

 

IMO, this was a low hanging fruit for the ATF because it has as stock on it.. going after one company who doesn't have all the resources or will to fight the classification. How many of these things did they really even sell?
