This transparency is a good step in fighting NJ's absurd stance on the 2A. It's been a long fight. Great job NJ2AS!

PK90 3,569 Posted June 29, 2019 Who cares? The manual has been in the hands of NJ2AS for years. Does it matter now with FARS?

I read the whole investigation guide - I think the biggest revelation was the detail of all the databases that are checked as part of the investigation process. I think the "win" for people in this state is when a P.D. does something like ask your employer for more than just employment verification or asks you to get fingerprinted when you've been fingerprinted previously a lawyer can now argue "why is this department deviating from the investigation guidelines provided by the NJSP?" That argument has always been there. I don't see what the difference is now. The PDs can still avoid following the guideline. I felt that it was a waste of time and money to pursue getting the guide book, especially when one was provided to them already. But what do I know. I am not a lawyer. Also, I no longer care. 1
JackDaWack 2,894 Posted June 29, 2019 A win is a win. Unfortunately, this does absolutely nothing for gun owners. When this all started it was pre operation compliance.. PD's have now been getting notices for years for violating the law... They can do what ever they want on their end provided it follows state law.. I highly doubt there is anything in there at this point that goes against the law provided they have had a copy of it for how long now?

I agree, a win is a win no matter how tiny. one important item is the part about answering yes to that psychiatrist question, it tells investigating agency exactly what the applicant needs to produce. no more no less. sorry I cant find my thumb drive with the guide right this second to quote it. one thing to remember this is just a guide. depending which way the wind blows will determine how it is rewritten and how often. kc17 622 Posted June 29, 2019 The State also had to pay "over" $100,000 to NJ2AS for legal fees.

HBecwithFn7 296 Posted June 29, 2019 What are the chances that the State will try to appeal to a higher court? Maybe even SCOTUS?

revenger 472 Posted June 30, 2019 The central committee comrades in trenton have already reviewed the document and have deemed it worthless to gun owners in the PRNJ. the lawyers fees are paid by us the taxpayers so they dont care.. as far as 100k is concerned the state wastes that much in the first 1/1000th of a second at the start of each business day. look for this document to change or be buried in some more red tape very shortly. They can appeal the attorney fee awards, but not much point in appealing the order to release the unredacted investigation guide at this point since it is already "out there".
