There use to be some sort of financial threshold for small claims. I think this amount exceeds that, and he'd have to go to Special Civil, and if he's a corporation, he'll need to use a attorney to file the complaint. That gets more costly and time consuming.

Take him to small claims court for $3k then.

Or maybe you can break up the amount owed and take him to small claims court twice.  Take him once for repair costs and second time for slip fee costs.

Why were the cops involved?... sounds like if the boat was being held in placement of an unpaid bill that would be a civil matter.

What does that have to do with you pursuing this?  I understand you can't get a lien against where he lives but that doesn't prevent you from pursuing this.

Tony, I would file in Special Civi court.  I had a deadbeat tenant that owed me almost $10K in back rent when evicted.  I filed all of the paperwork myself and won by default because the renter did not respond to the complaint.  I had to file two more times to have wages garnished and got every penny owed me plus mileage and interest.  It is a very simple process that just requires documentation.  I had attorneys tell me that they would handle it for 1/3.  It cost me postage and one trip to the Ocean County courthouse.  Don't believe that you need an attorney to handle simple filings, especially when it is a clear cut case with documentation.

Agree above.   Check out the criminal aspect of it.   If you can get the police to file a report of theft by deception.  Thats your ticket.  I worked in the check cashing industry for 17 years.  I never lost a case.  If they file it.  Actually if you insist.  They can not not file it.  If he gets hit with that.  He might want to settle right then.  Its simple.  Even a default judgement works just fine.  It will follow him for the rest of his life.  If you need to play hard and get a judgement.  I can hook you up with bear swamp recovery.  Theyll take his boat back. I miss those days.  F’n with the dead beats.

If the OP is a corporation or LLC he will be required to use an attorney. Sole proprietors can represent themselves in Special Civil.

I thought I read somewhere that small claims courts won't allow you to seek partial compensation.  In other words, if the limit is 3k, they will look at the bill and see it is over that and reject the case.  So you can't claim under actual damages to stay at or below the court limit.

    • In 50 years of living in NJ I've never experienced any attempt to inspect the interior of the home, and only one definite inspection of the exterior for an announced reassessment of all properties and that was a drive by. About 9 years of that was living in an apartment, but still, uncommon. Every place I lived had either a finished attic, basement, or both. But they were also included in the habitable square footage on the taxes when we got there. 
    • 27.00 and change in tolls to drive down the shore from Rutherford,  47.00 in tolls to go out to Long island to visit dying relatives. Now I read they are going to raise the fees in the DMV. Murphy lied just to get elected when he said that seniors will get a significant tax break with his StayNJ" program to stop us from leaving.   Keep voting for democrats...this is what you get.  Tax and spend is all they know.  Never cut anything.  This state sucks.
