There use to be some sort of financial threshold for small claims. I think this amount exceeds that, and he'd have to go to Special Civil, and if he's a corporation, he'll need to use a attorney to file the complaint. That gets more costly and time consuming. Or maybe you can break up the amount owed and take him to small claims court twice. Take him once for repair costs and second time for slip fee costs. Good luck. I worked in the check cashing industry for 17 years. I never lost a case. If they file it. Actually if you insist. They can not not file it. If he gets hit with that. He might want to settle right then. Its simple. Even a default judgement works just fine. It will follow him for the rest of his life. If you need to play hard and get a judgement. In other words, if the limit is 3k, they will look at the bill and see it is over that and reject the case. So you can't claim under actual damages to stay at or below the court limit.
