are significant, and that they have a right to due process when their constitutional rights are infringed."

I wonder if this will carry over to due process of red flag laws?

Nope ....hard working, law abiding citizens do not fall under those protections only those here illegally and/or those involved in questionable activities enjoy due process and breaks/charges reduced or dropped all together (especially when they are repeat offenders and truly guilty)

Will be business as usually on the border... just like border search authority and the Fourth Amendment.

Literally had one of these happen Thursday, which I was lucky to be assigned with the intelligence officer at the port (got to do some fun stuff). It did suck for the guy, being it was a name match with nothing else, but you treat them with respect... and most are happy to comply.

Doubt there will be any change, as you aren’t put on any list just for being Muslim. Plenty of Muslims go through ports of entry each day and are not bothered. There is a tie with each person on that list with a terrorist group. Might be a weak tie, but a tie is present. And if there is a mismatch, it should be notated correctly... so next time it is easier to handle for all parties (traveler, included).

It's not about being a on a list because you're Muslim, the entire ruling was in reference to being on a list with zero due process. That... I'm sure that guy will be hassled again just for being on the list.. somewhere somehow again, when he tries to get on a plane or go through security...

While the US government can hide behind some things at the border for violating rights, this doesn't seem to be one... Since the violation originates at some state run agency where the lists are created.. just wait.. no directives have come out yet on what to do next.

Sad, isn't it....   But Trump......  :no2:

Yes and what’s worse is these are the “good times” .......it’s going to be akin to Kristallnacht after the next election.

*For those not familiar with the reference, edited to today’s situation:

  • Hitler (next president) signed a new gun control law in 1938 (2020), which benefitted Nazi (Democratic) party members and entities, but denied firearm ownership to enemies of the state. Later that year, in Kristallnacht (the Night of the Broken Glass), in one fell swoop, the Nazi (Democratic) regime disarmed Germany’s (United States) Jews (Conservatives). Without any ability to defend themselves, the Jewish (Conservative) population could easily be sent to concentration (re-education) camps for the Final Solution.
