Margarita Rodriguez, of Passaic, caught a bus to Trenton on Monday morning after her graveyard shift. She wanted to be there when lawmakers voted on a bill that would allow her, and other immigrants without legal status, to get a driver's license.

The New Jersey Assembly and Senate passed the bill in separate votes on Monday afternoon, sending the bill to Gov. Phil Murphy, who has already said he would sign it. Supporters erupted with cheers of "Si, se puede" after the Assembly passed the bill.

Rodriguez couldn't remember the number of times she'd come to Trenton in the last two years, the number of times she'd skipped sleep to show her support for the bill.

“We want our representatives to know that we are here, the people are present and that we need it," she said in Spanish, with Rosa Lopez of the advocacy group Make The Road New Jersey translating. "It doesn’t matter our immigration status. We still have the right to a life with dignity and respect. Just like anybody else we work here and we pay taxes.”

The bill creates two types of licenses, one compliant with federal Real ID rules that allows people to access federal buildings and board planes, and a standard state license that can only be used for identification and driving.

While opponents raised concern the bill would lead to voter fraud, advocates portrayed it as a public safety measure that would allow people who are driving illegally to get licenses and get car insurance.

"It brings us one-step closer to ensuring all motor vehicles and drivers are insured thereby creating safer roadways for all New Jersey residents," Assembly Speaker Craig Coughlin, D-Middlesex, said in a statement after the 42-30 vote. Five Assembly me

Republican senators spoke in opposition to the bill, saying it provided protections for criminals and immigrants who were breaking the law.

"We can't allow New Jersey to be the weak link in our nation's security," Sen. Mike Testa, R-Cumberland, said. 

The bill is expected to generate $21 million in revenue from permit, title and driver's license fees in the first three years, according to an analysis by New Jersey Policy Perspective, a left-leaning think tank.

Anyone applying for the standard license would have to meet the same six-point identity verification system currently used by the Motor Vehicle Commission, but would have to show just one document confirming they live in the Garden State instead of two, according to the latest version of the bill.

The bill includes provisions to protect the information of immigrants who do not have legal status and who obtain standard licenses. Personal information obtained by the Motor Vehicle Commission will not be a government record, and cannot be disclosed for federal immigration purposes without an individual's consent, a warrant from a judge or other subpoena or court order, the bill says.

New Jersey is home to an estimated 450,000 undocumented immigrants, and about 338,000 residents would get driver's licenses under the bill in the first three years, according to New Jersey Policy Perspective.

Those numbers include moms like Rodriguez, who moved here from Mexico 18 years ago. Rodriguez works nights at a shipping warehouse for an online company.

Because she cannot get a driver's license, she cannot get to her son's soccer games to cheer him on, she said. 

Because she cannot get a driver's license, she takes public transportation and taxis, a significant drain on her paycheck, she said. 

Because she cannot get a driver's license, she relies on buses to get to medical appointments, even when her family's health is at stake, she said.

Rodriguez's youngest son, 4, was born with fluid in his ear, she said. Every six months since the boy was six months old, they must visit a specialist in Hackensack. In May, the boy had ear surgery in Paramus, she said. 

What would be a 20 or 30 minute drive from their home Passaic can take as long as 2 hours on the bus, she said.

“It’s extremely hard," she said. "That's why I have a night shift, so I can do all this in the morning. Many nights I don’t sleep.”

Losing sleep on Monday was worth it. 

"Having a driver’s license is not a luxury, it’s a necessity," Rodriguez said. “It’s a tremendous win for our community."

How does giving an illegal a drivers license guarantee they will get car insurance?????

I would like PA to declare that all NY and NJ plated vehicles will be routinely stopped and their drivers investigated to see if they're illegals.  If they are they will be arrested.  PA will no longer give full faith and credit to NJ's drivers license.  Then issue non-resident PA DLs and some kind of sticker to put on NJ plates.

What we need is for TSA to say any state that give a drivers license to illegal aliens, who don’t have proper ID, that states drivers licenses can’t be used to get on an airplane.

Allegedly, the illegal alien licensees will not get "Real IDs" for air travel.

Yeah, I read that, but I think they should just not accept drivers licenses from any state that issues them to illegals. It’ll piss off the legal residents of those states when they need to get some other ID TSA will accept.

I agree that this recently passed legislation makes no sense and is not just unfair, but will cause more problems than it attempts to solve.

Also, the NJ Motor Vehicle Commission is not the most smoothly nor efficiently run state government agency so who knows how this will all play out....

For example, all of us NJ residents will be required to obtain an updated NJ Driver's License that conforms to the national REAL ID specified criteria.  Yet after registering on the NJMVC website to be notified when any of their centers located in my home region will be offering this service, they sent me an email saying that I can now set up an appointment to get this required REAL ID NJ Driver's License.  Yet when I attempt to set up an appointment, using their link redirecting me to their upcoming three (3) month calendar, I discover that every appointment for every day for the next three months is not available.... WTF!   This rivals the poor launching of the online registration for the Affordable Care Act....  Disgraceful!

It is a shame that you and some others here feel the need to exacerbate polarization by forcing a generalized label on someone, especially if it is inappropriate or incorrect.  
Did you ever stop for a moment to think that not everyone is so black & white in their political views and beliefs as you may be...?
I believe that I, along with most of my friends and relatives are not so dogmatic or absolutely in lock-step with the views and programs and legislation proposed by either the Republican or Democrat elected representatives in Congress or the NJ State Assembly.
I have stated what my political beliefs are on this forum on numerous occasions in various threads, so I will not repeat myself here.  If you care to see them then you can do a search for them.

BTW, all you have to do to confirm my point is look as some of the posts made by others here on NJGF for their conflicting views on our POTUS and his actions and programs.  FYI - I do believe that no political party or individual politician is free of some level of corruption, nor are they unwilling to tell lies in support of achieving their political goals.

It’s laughable to think that these illegals will be buying car insurance.  They’ll get a license, whenever they are able to get one... then drive some pos car.

Now.... not only are you, me, your family and friends vulnerable to criminal acts by the low life’s among the illegals..... you can get run over, or T-Boned by one too on a Saturday night after the bottle runs dry.

Say hello to more people’s kids getting killed and higher insurance rates.

@AVB-AMG mentioned above that there are problems that this bill passage attempts to solve.   This solves exactly zero problems.  These DLs will do nothing regarding identifying any of them.  They can’t even come close to proving who they are.

The purpose of this bill is one thing and one thing only.

Illegals voting in NJ elections.  That’s it.  There is no other reason.

With the NYS law taking effect this week, and the NJ law about to be signed by Gov Gopher, I sincerely hope that Homeland Security and the TSA invalidate the use of ALL NY and NJ Drivers Licenses as Real ID documents used for flying or entry into Federal facilities.

Yes, it will create a massive problem for many NY and NJ residents. OFW. The blowback will ultimately fall on the elected a$$holes running both states, the vast majority of whom belong on trial for treason.

Well I disagree.  The point of this effort acknowledges the fact, whether or not we like it, that there are many illegal aliens who are living in the State of New Jersey.  I believe that is important (and a good thing), for these people to have some sort of STATE identification card that permits them to legally drive an automobile in this state, as well as to obtain the corresponding legally required automobile insurance, that will ultimately be to everyone's benefit.  But as I said earlier, the NJ bill, as written and passed, has some real problems.

Where I disagree with the NJ Bill on this subject is that they are creating two types of “licenses”, where one is what I described above and the other is one that is compliant with the Federal REAL ID rules. IMHO, that is taking this too far.  Also, I realize that the passage of this bill will result in additional revenue being generated for the state, which was just one more incentive on the part of the state.

Yes, I understand that this bill requires that for someone to obtain the REAL ID version of this license, that the applicant would still have to comply and meet the same 6-point identity verification system employed by the NJ Motor Vehicle Commission, that we have to, but I do not think it goes far enough

There are a number of other States who have passed similar laws over the past 15+ years, where the NJ State Assembly could have learned from and incorporated additional sensible restrictions and requirements into the NJ bill, but did not.  For example:

I think that the law passed by Utah back in 2005 makes more sense.  That law establishes a one-year driving privilege card for unauthorized immigrants.  Applicants without a Social Security number must prove Utah residency for 6 months and provide a tax identification number. The card is expressly prohibited from being used for any identification purposes by a governmental entity.

Also, Maryland’s law, passed in 2014 has some additional provisions that make sense.  Their law authorizes the issuance of driver’s licenses to those who do not have lawful status or a valid Social Security number.  New applicants must provide evidence that the applicant has filed at least 2 years of Maryland income tax returns or proof of residency or have been claimed as a dependent by an individual who has filed Maryland income tax returns.  The licenses are not valid for Federal identification purposes.

Finally, Connecticut’s law, passed in 2015 has some additional requirements before they will issue this license.  Their law provides driver's licenses to applicants who submit a valid foreign passport or consular identification and proof of residency, regardless of legal presence in the United States. Applicants must file to legalize as soon as he or she is eligible.

... and therein lies the problem.  The state should not be doing anything to coddle to anyone here illegally, they are breaking the law!

The problem is both states have 2 tiers of licenses. One is RealID accepted for Federal purposes like flying and access to Federal buildings. Illegals will get the regular ones.

I just renewed my CDL in Jan 2019. If I want a RealID i have to pay again. My current one is good till 2023 so i'll take a pass. I don't fly very often so I really don't need it. I wonder what will happen if I get called for Federal jury duty again. If they won't let me in the building I can't serve on the jury.

It was reported on NJ101.5 that the DMV was looking at waiving the fee for someone looking to get the Real ID before current DL expires. They consider it a duplicate.

I have wondered the same thing re: being called for Federal Jury Duty.

I may have to get a Real ID before my current DL expires; I occasionally need to visit Federal properties for work. I may get a passport card instead; I imagine that'd be less painful.
