New Owner Questions - Transport, Carry on Private Prop., Etc

Hi Everyone,

 

New to the forum and a new pistol owner. Grew up shooting with my father.  I finally got my FID now that I live in  town that didnt make it too much of a hassle. I drive a hatchback and dont have a "proper" trunk. I have a single pistol locking case that I leave in the trunk and put my ammo in a box on the floor of the back seat. So far everyone has told me this is perfectly fine as the gun is locked, unloaded and I cant reach it. Do I have to lock the ammo box as well?

For my rifle and shotgun, the case is too long to allow my to keep it in the trunk, it has to go in my backseat or I need to fold a seat down. What is the best way to stay legal with this? Especially because if I do get pulled over this case will be visible to the officer unlike the pistol that he wont even know is there (and I assume I dont have to declare unless asked). I do have a trigger lock and a cable lock I can use on either the rifle or shotgun.

So far everyone has told me that when transporting firearms I must go directly to and from my home to the range, and from the range to my home. No stops. This document says there are some reasonable stops allow that are on route, such as, gas, food, passengers, etc. Am I allowed to pick up a friend and transport them and and their firearm to the range as well? 

Also, this bit "A person may transport a firearm from.... between his dwelling and his place of business" does this mean I can transport the firearm from home, to work, to the range and then to home? My best option for a range is considerably closer to work and going home after work, then back tracking to the range makes it a PITA. I will do what keeps me legal but I am wondering if these exceptions apply. 

Ok, final question. I have a friend with 30+ acres and he shoots on his land for hunting, sighting in, etc. The law allows you to carry on your own private property. I watch his house and property every so often while is on vacation and that also means tending to his land while he is away. If given expressed written permission to use firearms on his property while it is in my care am I allowed to use my firearms for target shooting and carry my pistol while on his (bear laden) property. He does have neighbors that would know when he away and if they heard shots may be concerned. Should a LEO show up and question me, I would need to know I am in the right.

I am not a lawyer or law enforcement, I am stating my interpretations of the laws and what I am comfortable doing.

I have an extended cab pickup truck without a cap/cover for the bed. While transporting a rifle I keep the rifle unloaded and no mag in a rifle case. Handguns are in a handgun bag (unloaded and no mag) inside of a range bag. Ammo is in a ammo box, mags go in the ammo box (when there is room). Everything goes in the rear seat area (seat and/or floor), and gets covered with a moving blanket. Sometimes I will place the ammo in my locked bed toolbox, but that is usually too full of other stuff to allow room.

Place of business means a business you are a owner of. Going from home to where you work as a non-owner employee is, in my understanding of the law an no-no.

While going to/from a range, or FFL or gunsmith.... stopping for gas/quick meal/bank/etc... I am comfortable doing so. I will not drive 20 min out of the way to run another errand.  

I would not house-sit with my firearm. If you are house-sitting and use the owner's firearm, you have made an illegal transfer. The only workaround I see would be if a lease was written up, then you can have your firearm with you, as it would be your residence. Again, IANAL or LEO. I don't know if I would take a firearm to a friend's property for target shooting. If you are a member of a gun club that files a list of it's members to the NJSP, it gives you a little bit more leeway here and with transport laws. IANAL or LEO.

I suggest you pick one or many of the many 2A associations available, support them and they will support us.

Personally, I am a club member, I am a member of multiple 2A groups, I am a member of US Law Shield, which among other benefits allows me to talk to a lawyer for free at anytime to ask these types of questions.

Did I mention, I am not a lawyer or law enforcement and the above is not legal advice?

Just to clarify the transport answer, the whole 'directly to-from home, range, gun shop with only limited reasonable stops allowed' thing only applies to transporting handguns and/or hollow-point ammunition.    If you are transporting long guns or non-hollow point ammo, you aren't so limited.

Thanks. My pistol is the primary reason for this question so I guess im SOL.

Im SOL in regard to being legally able to drive to work with my handgun locked in a car and locked in a case, go to the range after work and then go home. Going back home after work and then to the range will eat up a lot of time but in the Socialist Republic of NJ thats what I have to do..... Its a bummer because I dont see myself going to the range on weekends much so weekdays are the best option for me.

Sooooooooo, a few things:

IANAL

RTSP is listed as your "Home Range".  They rent hand guns.  So stop-in after work to pew-pew on the same model gun & let them clean it.  You'll still have the muscle memory from the SAME gun.

Don't advertise your intentions on a gun forum.  Do whatcha need to do & be comfortable in your own skin doing it.  Take "growacet".

Learn the difference between FOPA Rules for interstate transport and NJ rules for intra-state transportation.

Never look at the actual NJ gun laws.  They're deliberately written to confuse & use wood pulp.  Read your exemptions & exceptions!

Brush-up on your HS English prior to reading NJ's exceptions & exemptions.  Punctuation changes meaning.  Like having a "securely tied package" on your front seat for instance...

All firearms in NJ start out being ILLEGAL and therefore only exist in the hands of us serfs thru the use of exceptions & exemptions.

Do not look for permission to do something in NJ gun law.  It's like asking permission to breathe air.

Remember that NJF&W game laws also cover use, possession & transportation of firearms, and a $27.50 license buys you more rights!

Thank you for the reply! I am a fisherman so I always have my fishing license on me. I am not a hunter though. I belong the the NRA and will likely support other organizations in the future as well. 

I wouldnt say I am advertising my intentions as much as asking about whether an action is possible. Either way, that action was asked by "Twism86" which is not synonymous with my real identity, SS#, address, etc..... 

I beleive along the lines of "its better to ask for forgiveness than permission" but in this state in regard to firearms laws, thats a losing battle I dont want to have to fight.

He’s telling you. Nobody talks about fight club. Are you prone to being pulled over with consistency?

Im good for 1 or 2 a year..... Its all my right foots fault. When driving with a firearm, small child, good craft beer, etc I tone it way down.
