They essentially got out of a speeding ticket because the cop didn't appear in court. So there's no precedent set and it wouldn't make it any easier for anyone else to sue if Northam decided to press the issue. Title of the article is pretty misleading in that it makes it seem like the DOJ agreed with the pastor when the DOJ specifically said that is not the case. Because that happens all the time. /sarcasm The DOJ worded their decision extremely precisely so as to set no ruling on whether it was Constitutional or not. Yes, that's my interpretation as well. They acknowledge that Northam's team hasn't presented yet, but they are clearly concerned that Virginia engaged in overreach here, by establishing one set of standards for this church, and a looser set of standards for other entities.
