  1. I don't think this is correct. It would have to be a complete firearm. I tried to purchase an AR complete lower, with an A2 stock in PA and the dealer (knowledgeable in EBR's as they are a large part of his business) said that it had to be handled the same as an out-of-state handgun purchase 0 that is: shipped to an FFL in your home state and received through them. The law does not make a distinction whether there is a stock attached or not - it is a receiver, period. I think this has only changed recently, with the addition of the "receiver" box on the 4473.

    I was told by dealers in PA it can be sold that way, but I'm not surprised to here conflicting info on this issue.


  2. I think I remember the SP sending out a memo last year insisting that all issuers remember to collect the $18.00 fee, no matter how much time has elapsed since the last application.

    Yea, what BS that is, like it takes very long to check if you committed a crime in the last day, week , month since you last got permits.


  3. No, but there were some chiefs who would downcheck an app for anything other than "Target Shooting", and Self-Defense was an automatic denial. None of MY Chiefs did this when the question was on there, but i do know of somw who did. In those towns the guy who handled the applications usually did his best to steer the applicant away from that answer without blatantly telling him or her what to put.

    I remember people (not gov workers) telling me to make sure to write "Target Shooting" on the app when I first put in for my FID for that very reason.


  4. There is tax on the NICS because the NJSP uses a 900 number, which is taxable.

    Just think of the NICS fee as $16.05.

     

    Transfer fees are taxable because NJ says so.

    How the NJSP collects the money is just semantics, your still paying sales tax on a tax.

    Transfer fees I can understand since this is for a service that is being provided by a private company, just like most other services you buy it is subject to sales tax.

    That was a different ATF rule, or new "interpretation" of the existing rules that began at the beginning of last year.

    You must now buy stripped lowers and pistol grip shotguns in your home state.

    Lowers with stocks attached and shotguns with folding stocks can still be bought out of state.

  6. i dont know if it was posted here but Century Arms wouldnt ship the Polish AK here I went to J&G sales I should have it mid week :icon_e_biggrin:

    Century is a pain like that, they won't ship any gun that can accept a high cap mags to NJ (including WASR 10's that already have a welded muzzle nut and cut bayonet lug).

     

    FYI - also no ammo to non FFL's - they think you need to present a FID card in person to buy any ammo in NJ.


  7. Yes, Mcdonald Extended the Decision in heller to Include the states. The Justices SPECIFICALLY did not define what "Reasonable" meant, because again, the case was to determine a SPECIFIC ISSUE, to wit, the Constitutionality, or lack thereof of a total ban like DC and Chicago had. The Justices will not allow the discussion of these cases to stray outside those lines, Which will mean it will take time to turn thing sback. that said, Doing it that way, case by case, decision by decision is actually better for us in the long run, even if it doesnt seem so in the short. Think Chess as opposed to Checkers. (This is going to delve into Politics for a Bit and I Apologize Mak, but it IS germane to this issue) As screwed up as the current POUTS is, there is still no REAl Garuntee that he will be replaced by a Republican in 2012. Especially if the RNC insists on choosing tired old reruns as their candidates. While Alito, Roberts and Thomas are Relatively young, Kennedy and Scalia are not. All it takes is ONE of them to leave for some reason, and the entire tone of the court will be dependant on the White House. When you have large, sweeping decisions, all it takes os ONE case to overturn it. Whereas, if something like the RKBA is defined over a dozen or so cases, the gains you make can be eroded far less easily. "Reasonable" is a relative term..and having a set definition for it makes me uncomfortable, especially considering WHO might be the person or persons deciding. You tell me, Who would you rather see making that call?? Alito and Scalia, or Breyer, Kagan and Sotomayor?

    Point well taken about multi rulings vs one ruling.

     

    But like you said, we are only one justice away from getting nothing more, or worse yet going backwards.

    Lets hope they can lay this out before SCOTUS changes for the worse.


  8. I didn't realize it was that easy to get a certificate of exemption...What the hell was the point of the 30 day law, man this state is tarted.

    The point of the law was to get Corzine reelected - we see now how well that worked.

    Even the state police realize the 30 day rule was unnecessary, straw purchases are not a problem in NJ.

    It just creates another layer of BS to go through when making purchases.


  9. Make sure to check state laws. Some states haw "contigous states" laws in that residents of that state may only purchase in bordering states, and residents of bordering states may purchase in that state.

     

    For example. Residents of New Mexico can purchase a long gun in TX, OK, CO, UT and AZ, and residents of TX, OK, CO, UT and AZ may purchase a gun in NM. But a resident of, say, Nebraska (or any other state) could not purchase a long gun in NM.

     

    Many states have laws like this, I know North Carolina and Ohio do.

    I've been told conflicting information on this.

    I was in Las Vegas and Kentucky and was told in both places that the ATF was behind this "contigous states" rule, and that they have gone back and forth on this rule several times.

    I have had dealers in PA tell me they never heard of this rule.

     

    Maybe there is an FFL on the site that can clarify this for us.

    Agreed, all the "fees" you pay at motor vehicle are actually taxes.

    My point is they are charging sales tax on a tax. You pay sales tax on the firearm and then also on the NICS check.

    It would be like paying sales tax on the car and then also on the registration.
