  1. He'll probably be fine. From what I've read across the forums and blogs, if he puts yes to that question, attach a note from his doctor saying he is fine to own and operate a firearm and that would be enough. In extreme cases, they deny you, you go to appeal it, and the judge gives you a chance to get a police level psych evaluation costing hundreds of dollars (close to $1000) and renders his judgment based on the results of his psych eval.

  2. The problem we are running into is a large reduction in manpower. through attrition, we are down 19 percent in manpower. So administrative tasks wait while background investigations wait. A lot depends on how many areas of responsibility the officer in charge of the BI has currently. It varies greatly from season to season and from department to department.

I can tell you this. The live scan fingerprint submission has cut down the wait for prints to return from four to six weeks to a matter of a few hours in many cases. That was a shocker the first time it was used in my department.

Sorry I couldn't be more specific but there are just too many variables involved. Our two try to push and their only failing is that they will chew your ear off for hours talking about guns when the applicant comes in for the card.

Thanks man, I appreciate your feedback! B)

  3. To any police officer here that knows how these background checks work. About how long would you say it takes the detective to actually do the background check once he or she has all the pieces of the applicants background at their disposal? Example, once detective Doe gets the background from the njsp, the reference letters, the mental health info necessary, and whatever other info they look into, how long would it take Detective Doe to complete his part if he had no prior obligations, his desk was clear, and all he had to do all day was process FID and PP apps?

Just curious because I'm on day 64 waiting for mine. There were some snafus with one of my letters not being returned and that was resolved on Dec 21 when I bought the reference letter to the station myself so I guess the official clock started then? One lady told me it would only be another two weeks since the detective had everything else in place. Another lady told me it would be another one to two months!

  4. Very cool I remember you. Ya I thought the class was great I learned a lot. I just bought a .22 rifle so I think Im going to take the rifle class next. The other basic pistol class they where talking about sounded good also. Have you been back to shoot there yet?

Not yet. I dont think they have been open on a weekend since due to the weather. Myself and the other guy have been trying to go ever since but its been closed I think.

Congrats on your rifle purchase! When I get one ill take that class as well. I signed up for the basic pistol class when I was there.

    My rant...

Where is the public debate and dialogue on this issue?

Any other sweeping legislation (especially one with Constitutional ramifications) has advocates on both sides coming out of the woodwork. There are demonstrations and counter demonstrations, rallies and fundraisers, expert pundits from both sides, public outcry from both camps and an ongoing public debate.

The absence of such activity from both sides just shows how beaten down we are, and how arrogant and overconfident the other side is.

We've heard virtually nothing from Miller and his minions. Is it because they so firmly believe that Fortress New Jersey will spend every penny of our money fighting every word and nuance of a decision all the way up to the SCOTUS, until we just can't take it any more?

We've seen precious little from the advocates for our freedom within the state. We depend on outside help, and then complain when nothing immediate happens. Our local contribution to the struggle has so far been limited to the efforts of a couple of groups. Where is the statewide cry for attention to the return and preservation of our freedom?

The letter from Carroll is strong and persuasive, but does it have any teeth? Who is standing publicly behind him with the power and voice of thousands or tens of thousands of NJ citizens?

Certainly we can get some attention to the cause. Write letters to everyone, in Trenton and in the media, explaining the facts and deflating the lies and hyperbole of the opposition. We can't get the media on our side, but maybe we can draw some attention to ourselves. It's really time to stop cowering in the shadows and come forward and join the effort.

You all know that I'm ambivalent on some aspects of CCW in NJ, but I'm never against restoring the right of any law abiding New Jerseyan to make the choice for themselves. It's not about guns, it's about freedom from fear and security for ouselves and our families.

    Start writing.

    rant over.

  6. I have the Kimber brochure around here somewhere and I think I do remember seeing like two or three choices available in 9mm. You might wanna check their site.

    Edit:

Yes, the Kimber Pro Carry II can be had in 9mm. This might actually be my first 1911 too.

Van Drew and Sweeney need to be made to understand that putting a bandaid on NJ gun laws simply won't work. Trying to fix or expand the existing exemptions won't do it. However, I think we need to assume that they won't be willing to entertain eliminating the purchase permit process. IMHO, a realistic "ask" would be:

    1. Revamp the permit system so that one permit is applied for and issued once, which then covers all purchases of all firearms, subject to NICS checks. The purchase permitting system was not an issue in the Aitken case, so perhaps Sweeney isn't even thinking about it.

    2. Delete the provision that makes it illegal to posses a handgun without a permit to carry. Ownership/possession of a firearm should be presumptively legal, as long as the firearm was (1) purchased legally in another state or (2) purchased in NJ in accordance with the statute. Only the carrying of a loaded firearm (ie with ammunition loaded in the firearm) on one's person should require a separate carry permit.

    3. Fix the carry permit system to make it shall issue, with training requirements.

Makes a WHOLE lot of sense.

  8. 2C:39-5. Unlawful possession of weapons. a. Machine guns. Any person who knowingly has in his possession a machine gun or any instrument or device adaptable for use as a machine gun, without being licensed to do so as provided in N.J.S.2C:58-5, is guilty of a crime of the second degree.

tab.gifb.tab.gifHandguns. Any person who knowingly has in his possession any handgun, including any antique handgun, without first having gone through a NICS CHECK, the same as provided in N.J.S.2C:58-4, is guilty of a crime of the third degree. if the handgun is in the nature of an air gun, spring gun or pistol or other weapon of a similar nature in which the propelling force is a spring, elastic band, carbon dioxide, compressed or other gas or vapor, air or compressed air, or is ignited by compressed air, and ejecting a bullet or missile smaller than three-eighths of an inch in diameter, with sufficient force to injure a person. Otherwise it is a crime of the second degree.

tab.gifc.tab.gifRifles and shotguns. (1) Any person who knowingly has in his possession any rifle or shotgun without having first obtained a firearms purchaser identification card in accordance with the provisions of N.J.S.2C:58-3, is guilty of a PETTY OFFENSE not punishable by more than a fine of $500 and a personal prohibition on firearms for a period of 6 months. of the third degree.

tab.gif(2)tab.gifUnless otherwise permitted by law, any person who knowingly has in his possession any loaded rifle or shotgun is guilty of a crime of the third degree.

In addition, I'd add, fully remove any part of NJ law that prohibits people from traveling around the state with a firearm inaccessible in their vehicle to places OTHER THAN the range, gunsmith, or gunshow. In other words, NJ residents should be able to transport their firearms wherever they see fit throughout NJ with no prohibition other than sensitive places (and thats only if that is their destination).

Furthermore, GET RID OF THE WHOLE NJ PERMIT SCHEME COMPLETELY!!! A Drivers license and a NICS check is PLENTY SUFFICIENT!!! Why do police officials have so much say in regards to our rights when it comes to firearms???
