  1. A former New York police department sergeant has filed a $10 billion federal civil rights lawsuit against a list of law enforcement and court officials in New Jersey

    JACKSON, NJ, January 05, 2021 /24-7PressRelease/ -- A former New York police department sergeant has filed a $10 billion federal civil rights lawsuit against a list of law enforcement and court officials in New Jersey (MARCHISOTTO v. MALIK et al (3:20-cv-20426), New Jersey District Court).

    The case is not about the money, he said, but justice. In the court filing, he says, "I would gladly donate every penny to a charity. But it's time to send a message to the New Jersey Courts run by clown judges, who believe they are above the law."

    John Marchisotto says his civil rights were violated when officers came into his home to take away his guns. The invasion and everything that happened after that are retaliation for Mr. Marchisotto filing another federal lawsuit against many of the people named in this case.

    The complaint filed in the US District Court in New Jersey says in part, "Middlesex County Sheriff's Police Officers … New Jersey State Police along with dozens of heavily armed police personnel, entered my home displaying their high-powered military-style long guns drawn, terrorizing my family. They came to my home to execute a false TERPO petition to seize my licensed firearms. However, their basis of the TERPO search warrant was a complete sham to punish me for the Federal Lawsuit I filed against the State of New Jersey, Middlesex County, the judicial and non-judicial defendants. They knew I was a retired NYPD police sergeant and out of retaliation, they came after my guns."

    TERPO is an Extreme Risk Protective Order act. It was created in New Jersey in 2018 and allows anyone to seek the protective order against anyone else who "poses a danger of causing bodily inquiry to self or others by possessing or purchasing a firearm."

    Mr. Marchisotto said he does have guns. He is a retired law enforcement officer. Furthermore, he bought those guns according to NJ and federal laws. As a police officer, he also received extensive training in the proper use of guns.

    "It's revenge. Pure and simple, revenge. They got mad at me because I know my rights and my rights were violated so I filed suit against them. They want to intimidate me. They hope to scare me into dropping my lawsuit. All they did was make me more determined to make sure justice prevails," the retired police sergeant said. "So, I filed this suit as well."

    He said his rights guaranteed under the First, Second, Fourth, Sixth and 14th Amendments were more than ignored. His rights were intentionally violated.

    "They knew what they were doing. They knew it was illegal. They set things up to try and make it legal, but I know differently. I spent my adult life as a police officer and I know what is legal and what is not," he said. "Yes, I worked in New York, but federal law applies the same in New York as in New Jersey.

    Mr. Marchisotto requested a jury trial. He wants a jury to hear the matter because as many people as possible need to see how he was treated.

    "I've seen what judges in New Jersey will do. I am a victim of their illegal and unethical actions. I want a jury to hear this because I know a whole jury will find the truth and tell the judge. When the judge hears the jury's verdict. He has no choice. He has to go along with what the jury decides," Mr. Marchisotto said.

    Guy shouldn't have to move to a free state (he lives in the US of A), shouldn't have to do the paperwork or pay any fee.

     

    Unfortunately, people are products of their environment.

    It could be argued that NJ is even worse than CA and NY, although its very close.   

    For those who have grown up in this setting, freedom is a scary and foreign concept.

    Who else is is buying monocore baffles in hollow fuel filters and passing them off as "solvent traps"

    NFA isn't really a law that you fuck around with and then when caught ask "where's the victim",  that's not reality

    Are you saying that its somehow less of a victim-less crime if its a federal level infringement as opposed to a state level infringement?

    I was under the belief the items were legal, im sure he was too.  He most likely saw in the news recently people were getting arrested for these things..he's one of many over the past few months. He tried to get rid of them, which was smart..

    If there  is no victim, there is no crime.

    It can be difficult to determine a "tone" from a text post. 

    It seemed like you were implying that the guy purchased the items intentionally and in doing so, he deserved what he got.

    Even if it wasnt a mistake, do you really think that a man should be stripped of his freedom, his home raided, for committing a victim-less crime?

    Wheres the victim?

    It was all a part of Trump's plan to defang the Left so they couldnt conflate bumpstocks with semi-autos in an effort to essentially ban all firearms...

    And nothing about the fact that Trump did it by decree which sets the precedent for future gun grabbers like Harris who is now threatening to do the exact same thing...

    At my direction, the Department of Justice banned bump stocks.  Last year, we prosecuted a record number of firearms offenses.

  10. They keep raising taxes, forcing people to flee, reducing the population, netting less tax revenue which then results in more tax increases...

    Maybe cut spending?

    If people could easily flee the state, what percentage of the NJ population do you guys think would simply leave?

    I would guess that 70% of the people would get up and leave NJ tomorrow if it was easy to do so.

  11. Yes, I did receive my firearm. 

    I also updated the OP with something that I had completely forgotten:

    "Dick" had me complete an additional form which he himself created... 

     

    Many, if not most of you, have suggested that I mention his name here. 

    Here are my thoughts on doing that. 

     

    I dont think hes a "bad" guy. 

    I just think he is, as someone else mentioned, a Fudd FFL, making it even more difficult to buy a firearm in NJ, as though it wasnt already difficult enough.  *facepalm*

     

    I always try to maintain good relations with people and if at all possible, resolve any kind of disagreement in a diplomatic and tactful way. 

    Throughout this whole process, I think he was relatively "normal" and I always try to conduct myself in a mature, adult fashion.  :-)

    So, theres no "animosity", atleast not on my part and I dont believe any on his either. 

     

    The only thing which left me wondering was his insistence on getting my social security number. 

    The stories and "lies" which he was telling me in order to try and get this info...  SMH.

    BTW, I went to my FFL today to start NICS and was told that it takes about a week to get through. Really??? The things got that crazy or it was a little lie?
