  1. Due to a 2013 Third Circuit opinion the FOPA will not protect you when transporting through the terminal to the check in counter. You need to fit yourself under a NJ transport exemption so prepare yourself for which exemption you are going to claim if an over zealous law enforcement officer decides to make his first arrest. Also, a tip: keep your weapon case inside your suitcase until you get to the check in counter. It is not a good idea to be walking through the terminal with a gun case.

  2. Apparently Nappen says it is indeed possible to charge a BG with unlawful possesion if you shoot said BG during a home invasion or whatever.

The truth of the matter is once the projectile hits ANYTHING (wall, BG, dirt...) it won't be a hollow point any more, whether clogged with debris or deformed into a mushroom

So you 'wing him,' disarm him, call the police and while you're waiting for them fill all his pockets with hollow point rounds, ensuring that he gets life without parole.

  3. Yes!  I just took that course and got my license.  NJ Law is 6+1 (6 in tube, 1 in chamber) for semi-auto shot guns.  But NJ Fish & Wildlife policy is 2+1 when hunting or shooting on WMA ranges, etc. The chamber needs to be "blocked" to prevent more than two shells being loaded into the chamber.

That's Federal law for waterfowl as well ... that's why some shotguns come with the mag plug already installed.

  4. I personally would call the Chief's office and leave word with the Chief's secretary

that you wish to speak to the Chief personally. If the Chief does not  call you back

within a time frame you deem reasonable, than I would call the mayor's office.

Since the NJSP do not have jurisdiction  over township matters (HG permits are concidered a twp matter)

I highly doubt that will step in - jmo

Jack's got it here.  Chief's secretary, explain the situation, politely, you wanted to "see if you could resolve it in the chief's office before having to take it further."

  5. Remember it's pretty typical for Home Depot to contract with manufacturers to specifically downspec certain items to sell less expensively in their stores.   I really wouldn't consider buying anything as complex as a generator from Home Depot.

  6. We had a decent sized branch land on the top during one of the storms before Sandy and it caved it in (no mechanical damage).   Now, I have some very heavy-duty horses and 2 x 10s to protect the top if there is a heavy windstorm.   Especially important if you have large trees in the area.

  7. I've had a Generac 16KW (aluminum enclosure) since 2007.   We probably have 70 amps worth of circuits on the transfer switch, including refrigerators, pumps, alarm, outlets, lighting, A/V, computers and internet.  In addition to running off and on as needed for short outages, it has run on three occasions for 100 hours + without problems.   It gets serviced twice a year and oil changed after the 100 hour runs.  No complaints.   We run APC BackUP XS 1500s on computers, FIOS and A/V so the outage/changeover doesn't affect them.

  8. Revell is different because he was from out-of-state (Utah resident). Therefore his affirmative defense under FOPA (18 U.S. Code § 926A - Interstate transportation of firearms

) failed because his presence in NJ became treated as a destination (not his fault, but affected by his decision to retrieve his luggage)where he had ready access to firearms rather than an intermediate state or jurisdiction. Having access, such as staying overnight in a hotel, was the issue.

The question for a NJ resident is different, because NJ is the jurisdiction of origin and the trip is legal so long as FOPA transport requirements are met and possession at the destination is also legal.

IANAL of course, but I think I have this one right.

Origin: Your NJ residence (where it is legal to carry). Destination: (as checked out by traveler).

The NJSP guidelines for LEO questioning of a traveler are very clear: http://www.state.nj.us/njsp/about/fire_trans.html
