  1. I recall hearing about a lawsuit a few months ago in NY over tasers. From what I remember NY was still not recognizing the SCOTUS ruling that said they cannot be prohibited. So, I would recommend thorough research before carrying one in NY.

     

    Didn't the NJSP come out with guidance on carrying tasers in NJ? Anyone have it?

    In reality cops don't have as much discretion as they used to. Everything is being filmed and recorded these days. Yes, legally the cop would have the authority to let him go and send him back to PA to unload his gear, but if something goes sideways the cop who cut him slack is going to have a real problem that could easily be career ending. Would you risk that if you were that cop? I recall reading in an article about this story that the cop asked him if he was "coming from or going to a range", so it sounds to me like the cop was trying to give this guy a leg to stand on, but the guy answered "no". So there is only so much they can do when people do stupid things.

    I hope this guy fights this to the end. There are two ways we might see NJ oppressive gun laws overturned in court - civil lawsuits or, like this case, a criminal case that sets new precedents.

    I have a friend who is a State Trooper and he told me  a few years ago when the NJSP got new handguns that the state paid to have the old Sig 229's cut in half down the middle and then offered to sell the one half back to the Troopers who carried them. Apparently no one took the state up on the offer so they paid to have the remains of these pistols destroyed. When it comes to their antigun ideology, no amount of your tax dollars is too much to spend.

    Tony, I would file in Special Civi court.  I had a deadbeat tenant that owed me almost $10K in back rent when evicted.  I filed all of the paperwork myself and won by default because the renter did not respond to the complaint.  I had to file two more times to have wages garnished and got every penny owed me plus mileage and interest.  It is a very simple process that just requires documentation.  I had attorneys tell me that they would handle it for 1/3.  It cost me postage and one trip to the Ocean County courthouse.  Don't believe that you need an attorney to handle simple filings, especially when it is a clear cut case with documentation.

    If the OP is a corporation or LLC he will be required to use an attorney. Sole proprietors can represent themselves in Special Civil.

    If a dealer did that the dealer would be responsible for collecting the Federal Excise Tax that is required on complete firearms and as PK90 is alluding to, manufacturing license. There is no FET on gun parts, that's why it's cheaper to build an AR than buy a complete one. Many dealers are reluctant to sell you all the parts to assemble a complete firearm, even if you assembled it yourself.

    That is exactly what I did the last time I exercised one. If you'd feel more comfortable, have your FFL call the Firearms Unit and verify that sequence before you pull the trigger.

    You can do both the non exempt and the exempt on the same day - you just need to wait for the non exempt NICS to come back before submitting the exempt NICS

    Middle names or initials are not submitted when your information is sent to the NICS unit.

    Problem with all this is the NJSP FIU is not going to make any decisions about the legality of a firearm. That will be left up to the NJ AG's office - which, considering the current administration, I can't see approving anything controversial.

    About 8 or so months ago we were told we needed to do it in reverse.... First exemption then Single purchase. - Did they send out an email on this? I haven't heard this, but then it's been a little while since I've done an exemption.

    End of the day customer still got his Exemption + 1 but just needed to do it backwards.

    Personally i still think it should be ran 1 + Exemption but thats me.

    Someone with a NJ FID with an out of state could buy long guns at a FFL unless that changed.  Being that all transfers have to be at a FFL it's no different for long guns as if he still lived in NJ.

    The only thing that would change with guns is he couldn't take delivery of a handgun in NJ.  Why would anyone want to go through the NJ permit process if they didn't have to.  If he changes everything and wanted to buy a handgun in NJ he would have to pay shipping and transfer fee at a FFL in PA. 

    I've had a couple different people who were dual residents get NJ boat licenses to use as ID to buy in NJ. Their ID looks like a DL but says "Boat Only" on it and still uses the same number they had when they had an NJ DL.

     

    Non NJ residents with NJ FPID cards can buy long guns in NJ, but if the OP is going to maintain a NJ residence why not just keep his NJ address on his FPID card? It is perfectly legal to do so if they have a residence here.

     

    I agree buying guns in PA would be a lot less hassle and will probably be doing most or all of their buying there, but I don't see a good reason to change the address on the FPID if he still lives at that NJ address. If the OP sees a handgun they like for sale in NJ they would have the option of getting a NJ PPP or shipping it to a PA FFL, why not keep all options open?

    This is my 'theory' based on actual experience. I have not seen anything in writing to back it up. But it's apparently how it works. The MHE will not trigger a violation within 30 days of a P2P purchase. But the reverse will.

     

     

    ^^^^^This is how it works, using an an exemption restarts the 30 day clock on any non exempt transfers.........
